No interruption in handling administrative procedures
The Prime Minister requested ministers, heads of ministerial-level agencies, and chairmen of People's Committees of central provinces to focus on implementing key tasks to ensure the inheritance of implemented results, and not to interrupt the management, monitoring, reception, and settlement of administrative procedures for people and businesses when restructuring the apparatus leading to changes in regulations on administrative procedures.
Regarding the amendment of regulations and the announcement and publicization of administrative procedures, competent agencies and individuals shall promptly develop and promulgate within their authority or submit to competent authorities for promulgation legal documents to amend, supplement, or abolish legal documents containing regulations on administrative procedures that need to be adjusted due to the acquisition of new functions, tasks, and powers.
While waiting for amendments and supplements to the above legal documents, the competent agencies and persons shall assume the functions, tasks and powers to implement administrative procedures based on the provisions of Clause 3, Article 13 of Resolution No. 190/2025/QH15 of the National Assembly on handling a number of issues related to the arrangement of the state apparatus to guide and organize the implementation of administrative procedures to ensure continuity, smoothness, efficiency, and no interruptions, and to be completed before March 1, 2025.
Ministries and ministerial-level agencies shall strictly implement the direction in Clause 1, Article 5 of Resolution No. 190/2025/QH15, promptly announce and publicize administrative procedures, update them on the National Database on Administrative Procedures, as a basis for localities to announce the list of administrative procedures applicable in the province or city.
Regardless of administrative boundaries
Regarding receiving and handling administrative procedures, the Prime Minister requests that the receiving and handling of administrative procedures be carried out in accordance with the provisions of Clause 2, Article 5 and Clauses 1 and 2, Article 10 of Resolution No. 190/2025/QH15.
For administrative procedures under the authority of receiving and handling by local authorities and vertical agencies of the Central Government located in the locality, the Provincial People's Committee and vertical agencies of the Central Government located in the locality shall organize the reception and handling of administrative procedures according to the instructions of the ministries and agencies receiving the functions, tasks and powers after the apparatus is reorganized, ensuring the maintenance of stability, continuity, smoothness, efficiency and no interruption. The instructions of the ministries and agencies receiving the above functions, tasks and powers must be completed before March 1, 2025.
Ministries, agencies and localities shall perfect the one-stop-shop departments at all levels and implement them in a direction that puts people and businesses at the center, promoting the reception of administrative procedures regardless of administrative boundaries on the basis of applying information technology; strictly digitizing records, papers and results of handling administrative procedures during the reception and processing at the One-stop-shop Department; promptly amending and issuing identification codes of affiliated agencies and units according to the guidance of the Ministry of Science and Technology, synchronizing and updating on the National Document Interconnection Axis and the National Database on Administrative Procedures.
The Prime Minister directed ministries and agencies to promptly implement solutions to adjust, merge or upgrade the information system for handling administrative procedures at the ministerial level according to new functions and tasks. Provincial People's Committees proactively adjust or upgrade the information system for handling administrative procedures at the provincial level according to their authority, ensuring the inheritance of information, data, safety, security and the continuous, smooth, effective and uninterrupted reception and handling of administrative procedures.
Ministries, agencies and localities urgently complete internal procedures and electronic procedures for handling each administrative procedure according to changes in regulations on administrative procedures when rearranging the organizational apparatus; adjust the code of administrative procedure handling records according to the code set of the new ministry, agency and unit; use a unified domain name for the information system handling administrative procedures according to regulations. Update the shared data categories of the National Public Service Portal according to regulations in Article 6, Article 50 of Decision No. 31/2021 of the Prime Minister and on the information system handling administrative procedures at the ministerial and provincial levels.
The Prime Minister assigned the Ministry of Science and Technology to preside over and coordinate with ministries and agencies to develop and submit to the Prime Minister for promulgation a decision amending and supplementing Decision No. 20/2020 of the Prime Minister according to the simplified procedures and order in accordance with the organizational structure of the Government after consolidation and to provide instructions for ministries, branches and localities to announce and update the identification codes of agencies and organizations to avoid interrupting the connection and sharing of data between ministries, agencies and localities (such as sending and receiving electronic documents, receiving and handling administrative procedure records, etc.), to be completed before March 15, 2025.
The Government Office is responsible for monitoring and urging the implementation of tasks related to the implementation of administrative procedures for people and businesses after the organization and streamlining of the apparatus; promptly synthesizing and reporting to the Prime Minister on issues beyond its authority.
