Giving opinions on the draft Law on Forces Participating in Protecting Security and Order at the Grassroots Level, National Assembly deputies said that it is necessary to clearly define this as a support force for the communal police in order to clearly and appropriately define the functions, tasks and policies for this force to ensure its effectiveness.

On the morning of June 24, continuing the 5th Session, the National Assembly discussed in the hall the draft Law on Forces Participating in Protecting Security and Order at the Grassroots Level.

The majority of National Assembly deputies agreed with the necessity of enacting a law to build and strengthen the mass movement to protect security, order, and social safety at the grassroots level, led by the Party, managed by the government, and implemented by functional forces, with the People's Public Security playing the core role.

Deploy forces according to population and security situation in the area

Participating in the discussion session, delegate Do Thi Lan (Quang Ninh delegation) said that the draft law stipulates that, based on the number of security and order protection teams established and the total number of security and order protection team positions decided by the People's Council of the province or centrally-run city, the People's Committee at the commune level, upon the proposal of the commune-level police, decides on the minimum number of people to establish the security and order protection team and the maximum number of members of the security and order protection team.

According to the delegate, this regulation is still inadequate because there are no principles or criteria as a basis for determining the number of security and order protection teams in villages and residential groups, and the number of team members participating; the administrative procedures for deciding the number of people participating in the security and order protection force at the village and commune levels are still cumbersome and take a long time to implement.

The delegate proposed to add a specific provision, or assign the competent authority to stipulate the principles and criteria for determining the number of security and order protection teams, the maximum number of team members participating in the security protection team, based on the number of households in the village, residential group and the complexity of security and order at the grassroots level.

At the same time, the delegates proposed to assign the Provincial People's Council to stipulate the maximum number of teams, the number of team members participating, along with a number of regimes and policies for the forces participating in protecting security and order at the grassroots level in the province.

Sharing the same view, delegate Huynh Thi Phuc (Ba Ria-Vung Tau delegation) also suggested that forces participating in protecting order and security at the grassroots level should be distributed according to administrative boundaries and population size, paying special attention to terrain and key locations that require close coordination and flexible application of conditions, including the principle of "internal coordination with external coordination, regular coordination with the people".

Ensure operating conditions and policies for the force to promote efficiency.

Giving opinions on ensuring operating conditions for forces participating in protecting security and order at the grassroots level, delegates said that the draft law stipulates many policies and operating conditions for this force. However, it is necessary to review and evaluate to ensure harmony with other mass forces at the grassroots level.

Many opinions say that to implement the regulations as in the draft law, a relatively large budget resource is needed, so it is necessary to design a more specific financial mechanism to ensure feasibility when the law comes into effect.

Contributing to the discussion, delegate Nguyen Cong Hoang (Thai Nguyen delegation) stated that currently, security and order protection forces at the grassroots level are receiving subsidies from the budget as prescribed by the provincial People's Council according to the positions they hold.

Emphasizing that ensuring security and order at the grassroots level is an important foundation for socio-economic development, delegate Hoang said that strengthening security and order at the grassroots level is the core issue, the root cause for social stability to develop the economy, care for people's lives, and move towards comprehensively ensuring human security issues.

The delegates proposed that the Government develop a comprehensive project on providing facilities to serve the activities of the regular commune police force, the commune military command and the force participating in protecting security and order at the grassroots level, gradually arranging working headquarters and ensuring other facilities for this force to effectively perform its functions and tasks according to the provisions of law.

According to delegate Quang Thi Nguyet (Dien Bien delegation), the regulations on policies for forces participating in protecting security and order at the grassroots level are reasonable, but it is necessary to ensure that these regulations are effectively implemented in practice.

Delegates suggested that it is necessary to calculate and carefully regulate the funding sources to implement these policies for forces participating in protecting security and order at the grassroots level, and at the same time suggested that there should be content on balancing the central budget to support localities, especially areas with difficult economic conditions in mountainous border areas.

Sharing the same view, delegate Van Thi Bach Tuyet (Ho Chi Minh City delegation) suggested that the Government should pay attention to the budget for this force after its establishment, especially in localities where the central budget must support.

The delegate also said that it is necessary to clearly define this as a support force for the communal police, in order to clearly and appropriately define the functions, tasks, finances and budget for this force. The delegate recommended that the National Assembly and the Government study and have appropriate regulations on the tasks of the force participating in protecting security and order at the grassroots level.

According to the delegate, it is not appropriate to include most of the tasks of the communal police in the previous law on communal police as the tasks of the force participating in protecting security and order at the grassroots level, because this is only a support force in protecting security and order at the grassroots level, not a formally organized force. Specifically, the delegate said that it is necessary to review the provisions in Articles 7, 8, 9, 10, and 12 to make them appropriate, clearly defining the tasks at the grassroots level so as not to prescribe tasks that are too complicated, beyond the capacity of this force.
