Effective use of land funds on both sides of the Red River and Duong River

On May 24, 2024, the Politburo issued Conclusion No. 80-KL/TU on the Hanoi Capital Planning for the 2021-2030 period, with a vision to 2050, and the Project to adjust the Hanoi Capital Master Plan to 2045, with a vision to 2065.

In particular, the Conclusion points out the need to research, supplement planning and decide on orientation planning to effectively use land funds on both sides of the Red River and Duong River for socio-economic development, especially for tourism and service development.

Regarding this issue, in the Draft Law on the Capital (amended), on the planning of construction and development of the Capital, according to the Law Committee of the National Assembly, absorbing the opinions of National Assembly deputies, the Draft Law has added provisions on concentrating resources, prioritizing the implementation of the zoning plan of the Red River and Duong River in accordance with the Capital Planning and the General Planning of the Capital, ensuring the safety of dikes and flood prevention and control.

At the same time, the Draft Law has added the content of assigning the Hanoi People's Committee the authority to approve projects to build works on river banks and floating beaches on diked rivers in the city, ensuring conditions according to the provisions of the law on dikes. Accordingly, land on river banks and floating beaches can be used to invest in building works serving the development of cultural industry, developing ecological agriculture combined with sightseeing, experiential education, and experiential tourism to promote and effectively exploit the potential of land funds, geographical location, and cultural space in these areas.

This is a new content compared to the current legal regulations, transferring the authority to approve investment projects from the Prime Minister to the city, demonstrating strong decentralization for local authorities in promoting potential, taking advantage of available agricultural land funds but still consistent with the goals of managing and protecting dikes, preventing and combating natural disasters. At the same time, ensuring the orientation stated in Conclusion No. 80-KL/TU of the Politburo on "Paying more attention to exploiting the advantages of Hanoi's rivers and lakes, especially the potential of West Lake, Red River, Duong River, To Lich River".

The draft Law has assigned the Hanoi People's Committee to report to the City People's Council to consider and decide on the location, boundaries, and area of ​​land to be recovered in the vicinity for urban reconstruction, on-site resettlement, housing, commercial, and service development before the zoning plan and detailed plan are approved. Accordingly, the above contents will be considered, evaluated, and specifically determined in the plans to have appropriate implementation solutions, ensuring feasibility.

Creating superior institutions for Hanoi to implement planning

Conclusion No. 80-KL/TU of the Politburo clearly stated that solutions to implement planning need to be associated with perfecting the legal system and implementing laws in a synchronous, unified, effective and efficient manner with priority and outstanding mechanisms and policies to develop the Capital, associated with the Law on the Capital (amended).

The National Assembly is allowing cities such as Da Nang, Hai Phong, Ho Chi Minh City and some other localities to pilot the exercise of authority to locally adjust urban master plans and functional zone master plans according to resolutions on piloting some specific mechanisms and policies. The content that can be locally adjusted has been specifically limited in the Law on Urban Planning.

Therefore, the Draft Law on the Capital (amended) stipulates that the decentralization of authority to the City People's Committee to locally adjust planning under the Prime Minister's decision-making authority is appropriate and has a practical basis. The assignment of the City People's Council to specify the procedures for locally adjusting planning is to simplify administrative procedures, reduce processing time, and promptly meet the requirements for the construction and development of the Capital.

Conclusion No. 80-KL/TU provides the direction: "There is a roadmap, mechanism and policies to effectively implement the relocation of production and medical facilities that are not in accordance with the planning; move universities, headquarters of agencies, headquarters of large enterprises outside the inner city area".

Regarding measures to ensure the implementation of the planning, the Draft Law has added many contents to thoroughly resolve the shortcomings in relocating polluted facilities, hospitals, universities, and vocational training facilities out of the inner city area such as: allocating budget funds to support relocation, new construction, and land allocation for subjects subject to relocation; clearly defining the authority of the Prime Minister and the City People's Council in deciding on the list, measures, and roadmap for relocation.

The draft Law also assigns the Government and city authorities, when developing the Capital's General Plan, zoning plans, and detailed plans of the city, to clearly identify the agencies, organizations, and enterprises that must be relocated, ensuring consistency between the city's planning and national-level planning.

At the 7th session, the National Assembly will give direct opinions on the Hanoi Capital Planning for the 2021-2030 period, with a vision to 2050, and the Project to Adjust the Hanoi Capital Master Plan to 2045, with a vision to 2065, ensuring that these plans are comprehensive, have a strategic vision with a clear implementation roadmap. The Capital Planning is under the approval authority of the Prime Minister after receiving comments from the National Assembly. At the same time, the National Assembly will also consider and approve the Draft Law on the Capital (amended) to further improve the institutions for the development of the Capital, contributing to the implementation of the goals set out in the planning projects.
