Citizen identification card is an important identity document of a citizen. Vietnamese citizens are issued their first Citizen Identification card when they are 14 years of age or older.
Pursuant to Article 10 of Decree 144/2021/ND-CP, violations of regulations on the issuance, management and use of Identity Cards, Citizen Identification Cards or Citizen Identification Cards will be punished as follows:
1. Warning or fine from 300,000 VND to 500,000 VND for one of the following acts:
a) Failure to present Identity Card, Citizen Identification Card, Citizen Identification Card or Identity Card Number Confirmation Certificate when requested for inspection by a competent authority;
b) Failure to comply with legal regulations on granting, changing, and re-granting Citizen Identification Cards;
c) Failure to return the Identity Card, Citizen Identification Card or Citizen Identification Card to the competent authority when the person is given up, has his/her nationality revoked, or has the decision to grant Vietnamese nationality revoked; failure to return the Identity Card, Citizen Identification Card or Citizen Identification Card to the agency executing the temporary detention order, the agency executing the prison sentence, the agency executing the decision to send to a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility.
2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for one of the following acts:
a) Appropriating or using another person's Identity Card, Citizen Identification Card, Citizen Identification Card or Identity Card Number Confirmation Certificate;
b) Erasing, modifying or otherwise distorting the content of the Identity Card, Citizen Identification Card, Citizen Identification Card or Identity Card Number Confirmation Paper;
c) Destroying or intentionally damaging the Identity Card, Citizen Identification Card, Citizen Identification Card or Identity Card Number Confirmation Certificate.
3. A fine of from VND 2,000,000 to VND 4,000,000 shall be imposed for one of the following acts:
a) Forging or using fake papers, documents, or data to obtain an Identity Card, Citizen Identification Card, Citizen Identification Card, or Identity Card Number Confirmation Certificate;
b) Providing false information or documents to obtain an Identity Card, Citizen Identification Card, Citizen Identification Card or Identity Card Number Confirmation Certificate.
4. A fine of from VND 4,000,000 to VND 6,000,000 shall be imposed for one of the following acts:
a) Forging Identity Card, Citizen Identification Card, Citizen Identification Card or Identity Card Number Confirmation Paper but not being prosecuted;
b) Using fake Identity Card, Citizen Identification Card, Citizen Identification Card or Identity Card Number Confirmation Certificate;
c) Mortgage, pledge, accept pledge of Identity Card, Citizen Identification Card or Citizen Identification Card;
d) Buying, selling, renting, leasing Identity Cards, Citizen Identification Cards or Citizen Identification Cards;
d) Borrowing or lending an Identity Card, Citizen Identification Card, or Citizen Identification Card to commit an act contrary to the provisions of law.
In addition to the above-mentioned warnings and fines, violations related to the issuance, management and use of Citizen Identification Cards/ID Cards will also be subject to additional penalties and remedial measures as prescribed.
Thus, according to Decree 144/2021/ND-CP/ND-CP, in case people cannot present their Citizen Identification Card/ID Card when requested for inspection, they will be warned or fined from 300,000 - 500,000 VND.
Citizens are allowed to use their Citizen Identification Card/National Identity Card as personal identification and must carry it when traveling and making transactions. At the same time, they are obliged to present it when a competent authority requests to check or control it.
Will I be detained if I don't bring my ID card/Citizen ID card on the street?
Some cases where people could not present their ID card/Citizen ID card when requested for inspection were detained, this led many people to believe that not bringing an ID card/Citizen ID card would result in "arrest" - administrative detention. However, this is a completely incorrect statement.
According to Dan Tri , only the following 5 cases are subject to administrative detention according to Article 16 of Decree 142/2021/ND-CP, specifically:
- It is necessary to immediately prevent and stop acts that disturb public order and cause injury to others.
- It is necessary to immediately prevent and stop smuggling and illegal transportation of goods across the border.
- To execute the decision to send to a reformatory school, compulsory education facility, or compulsory drug rehabilitation facility.
- People who commit acts of domestic violence violate the decision to prohibit contact according to the provisions of the law on prevention and control of domestic violence.
- To determine drug addiction status in illegal drug users.
Thus, in addition to the above cases, people who do not carry an ID card/Citizen ID card will not be administratively detained, but the police will only invite them back to verify their identity.
