On November 4, at the 8th Session of the 15th National Assembly, participating in the discussion in the hall, delegate Nguyen Thi Viet Nga, member of the Provincial Party Committee, Deputy Head of the National Assembly Delegation of Hai Duong province, gave comments on the Government's report on the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the National Assembly Standing Committee in 2024.
According to delegate Nguyen Thi Viet Nga, to improve the quality of drafting legal documents, it is necessary to focus more on soliciting opinions from all walks of life, agencies and organizations on draft legal documents.
The Government's report shows that from 2021 to August 2024, 3,001 business regulations will be reduced and simplified (accounting for 18.9% of the total number of reviewed regulations).
Delegate Nguyen Thi Viet Nga assessed that this is a very large number. Unnecessary and cumbersome administrative procedures in business are bottlenecks and major obstacles for people and businesses. These unnecessary procedures waste time and social resources, as well as investment opportunities for businesses.
“The number of more than 3,000 procedures being cut and simplified brings both good and bad signals. Good signals because this is the result of active, responsible and scientific review. But bad signals because this number is also the result of limitations in the work of building and promulgating legal documents in recent times,” analyzed delegate Nguyen Thi Viet Nga.
To minimize the situation of issuing administrative procedures and then reviewing them to cut them down, delegates said that the most effective solution is to focus on reviewing right from the stage of drafting and promulgating legal regulations, in which special attention should be paid to soliciting opinions and synthesizing.
Currently, the Law on Promulgation of Legal Documents 2015 has fully prescribed the steps and procedures for soliciting public opinions, but the effectiveness is not high.
There are forms of consultation that completely agree with the draft, but when it is issued, the agencies and organizations that completely agree make recommendations about the problems and inadequacies of the legal document.
Delegate Nguyen Thi Viet Nga pointed out two main causes of this problem : laziness in reading and research of some individuals and the academic way of asking for opinions from all walks of life, sending the full text of the draft.
Meanwhile, what people are interested in is a thorough and concise analysis of changes and additions to regulations and the reasons, benefits and effects of the changes and additions.
Delegate Nguyen Thi Viet Nga also assessed that the current Vietnamese legal code is wasteful because not many organizations and individuals know about and use it.
Delegates said that in the process of reviewing legal documents, if problems or inadequacies are discovered, in addition to amending regulations, it is necessary to actively resolve the consequences that have occurred, especially when there are negative impacts on the rights and legitimate interests of the people.
