Reclaiming more than 38 hectares of land due to the enterprise partially terminating the project's operations

(LĐ online) - On March 17, Lam Dong Provincial People's Committee issued a notice to reclaim the land leased to Hop Phat Technology Investment and Development Joint Stock Company due to the termination of part of the project's activities.

Accordingly, based on the provisions of law and considering the proposal of the Director of the Department of Natural Resources and Environment, the People's Committee of Lam Dong province has issued a notice to reclaim a part of the land area leased to Hop Phat Technology Investment and Development Joint Stock Company (address: No. 06, Lane 594, Lang Street, Lang Ha Ward, Dong Da District, Hanoi City) according to Decision No. 508/QD-UBND dated March 8, 2010 and Decision No. 1606/QD-UBND dated July 27, 2011 of the Provincial People's Committee.

The total recovered land area is 38.34 ha, including: Area of ​​30.62 ha leased under Decision No. 508/QD-UBND dated March 8, 2010 of the Provincial People's Committee and granted Land Use Right Certificate No. BA 010571 dated April 9, 2010; area of ​​7.72 ha leased under Decision No. 1606/QD-UBND dated July 27, 2011 of the Provincial People's Committee. The above area belongs to part of sub-areas 108, 109, Da Tong commune, Dam Rong district.

The reason for land reclamation is that the Company partially terminates the investment project activities as prescribed in Point d, Clause 1 and Point d, Clause 5, Article 82 of the 2024 Land Law. The State does not compensate for land and assets attached to land as prescribed in Clause 3, Article 101 and Clauses 1 and 2, Article 105 of the 2024 Land Law.

Previously, on September 19, 2023, the Department of Planning and Investment (now Lam Dong Department of Finance) issued a decision to partially terminate the investment project activities of this Company.

Within 45 days from the date of receipt of this Notice, Hop Phat Technology Investment and Development Joint Stock Company, the owner of the property attached to the land, and the person with related rights and obligations (if any) shall be responsible for organizing the handling of the property on the land in accordance with the provisions of law. After the deadline specified in this Notice, Lam Dong Provincial People's Committee shall issue a decision to reclaim the land in accordance with the provisions.

• On the same day, Lam Dong Provincial People's Committee also issued a document directing the review of contents related to the land recovery leased to Hop Phat Technology Investment and Development Joint Stock Company in Dam Rong district; handing over to the Serepok Protective Forest Management Board and the People's Committee of Da Tong commune, Dam Rong district for management.

Accordingly, the Provincial People's Committee requested Hop Phat Technology Investment and Development Joint Stock Company to conduct an inventory of the current status of forest resources on an area of ​​38.34 hectares of land that the Department of Natural Resources and Environment (now the Department of Agriculture and Environment) proposed to recover, submit to competent authorities for appraisal and approval; promptly fulfill all financial obligations to the state budget according to regulations; proactively coordinate with the People's Committee of Dam Rong district and related agencies and units to organize the clearance of an area of ​​about 1.4 hectares of land that people have encroached on and occupied for agricultural production, building corrugated iron houses, etc.

The Provincial People's Committee assigned the People's Committee of Dam Rong district to direct functional agencies to coordinate with Hop Phat Technology Investment and Development Joint Stock Company to clear the land area encroached upon by people.

In addition, the Provincial People's Committee assigned relevant departments and branches, based on their assigned functions, tasks, authorities and fields, to monitor, take charge of inspecting, reviewing and collecting financial obligations and monitor, urge and guide Hop Phat Technology Investment and Development Joint Stock Company to implement the contents as required by the Provincial People's Committee; appraise and approve the results of the inventory of the current status of forest resources according to regulations.

The Provincial People's Committee requests that before May 10, 2025, the Department of Agriculture and Environment synthesize all results of the implementation of the above contents (along with the content of the proposal to reclaim the land leased to Hop Phat Technology Investment and Development Joint Stock Company to implement the project in Dam Rong district); report and propose to the Provincial People's Committee for consideration and settlement in accordance with the provisions of law.

Hop Phat Technology Investment and Development Joint Stock Company leased land to implement a project, including cold-water fish farming, in Dam Rong district. However, the project has been delayed by more than 10 years, although the project has been extended many times but has not yet completed the contents according to the Investment Certificate.
