Accordingly, implementing Document No. 5774/VP-KTTH dated June 17, 2022 of the City People's Committee on the establishment of an interdisciplinary inspection team at the Hanoi City Pilot Urban Railway Construction Investment Project, Nhon - Hanoi Station section (according to the audit results in Notice No. 485/TB-KTNN dated December 29, 2020 of the State Audit).
Many problems remain after inspection at Nhon Metro - Hanoi Station
In particular, the inspection of the use of more detailed evaluation criteria than the evaluation criteria for the bidding documents approved in the bidding documents (the package won by the contractor Posco); the signing of a contract with a contractor when the site clearance was not completed on schedule, the site handover plan was not determined, obstacles were moved but no negotiations were made to adjust the site handover plan (Packages CP-01, CP-02, CP - 03); the supervision and use of subcontractors participating in the implementation of the Hanoi City Pilot Urban Railway Construction Investment Project, Nhon - Hanoi Station section (Packages CP-01, CP-02).
In the inspection conclusion, the City Inspectorate pointed out a number of shortcomings and limitations. For example, the supervision and use of subcontractors participating in the implementation of the Hanoi City Urban Railway Pilot Construction Investment Project, Nhon - Hanoi Station section (Package CP-01, CP-02):
At the time of adjusting the price of the CP01 and PC02 packages, the investor had not yet prepared the adjusted estimate according to the direct offset method, adjustment coefficient or construction price index adjustment method as prescribed in Clause 2, Clause 3, Article 11, Decree No. 112/2009/ND-CP dated December 14, 2009 of the Government on management of construction investment costs; Clause 3, Article 36 of Decree No. 48/2010/ND-CP dated May 7, 2010 of the Government on contracts in construction activities and Clause 1, Article 7 of Circular No. 08/2010/TT-BXD dated July 29, 2010 of the Ministry of Construction guiding the method of adjusting construction contract prices "when adjusting contract prices according to formula (1), the input database for calculating price adjustment must be consistent with the content of work in the contract" leading to inaccurate payment and settlement of bidding packages CP01, CP02.

Regarding the progress of land acquisition and site clearance, it is still slow. Dong Da District People's Committee issued a notice of land acquisition in 2012 and handed over the site (Station S10, 11) from 2016 to 2022 to complete (the delay is mainly in the period 2016 to 2020); Hoan Kiem District People's Committee issued a notice of land acquisition in 2013 and handed over the site (Station S12) from 2017 to 2019 to complete; Ba Dinh District People's Committee issued a notice of land acquisition in 2013 and handed over the site (Station S9) from 2016 to 2022 to complete, which is not in accordance with the time limit prescribed in Articles 67, 68, 69, 70, and 93 of the 2013 Land Law; Clause 2, Article 108 of Construction Law No. 50/2014/QH132: "The construction site clearance deadline must meet the requirements of the approved project implementation schedule or the decision of the competent authority"; the site clearance schedule has not been properly implemented according to the direction of the Hanoi City People's Committee.
The relocation of the Project's technical infrastructure has not been completed, leading to the extension of the Hanoi City pilot railway project, the Nhon - Hanoi Railway Station section.
Thereby, the City Inspectorate has recommended the City People's Committee to assign the Department of Home Affairs to review the responsibilities of organizations and individuals for the existence of the problems mentioned in the conclusion to advise the City People's Committee to handle them according to regulations.
Direct the Hanoi Urban Railway Management Board to organize the inspection and review of unit prices applied in the preparation, appraisal and approval of initial estimates for bidding packages CP01 and CP02 as a basis for price adjustment according to regulations for contractors implementing bidding packages CP01 and CP02, on the basis of inspection and review as a basis for payment and settlement with the units implementing bidding packages CP01 and CP02 as stated in Part 2 of the Conclusion.
Urgently carry out the relocation of technical infrastructure works to hand over the site to the contractor to implement the Project.
