Clarifying the relationship between urbanization and new rural construction

On April 22, the National Assembly Standing Committee gave its opinion on the draft Law on Urban and Rural Planning. Agreeing with the necessity of promulgating the Law, Mr. Bui Van Cuong, General Secretary of the National Assembly, said that promulgating the draft Law on Urban and Rural Planning aims to institutionalize the Party's guidelines and policies, meet the requirements of sustainable development, and is an important law project, along with the draft Law on Land, the Law on Housing, and the Law on Real Estate Business.

According to Mr. Cuong, this draft law will contribute to perfecting the legal framework for land management and infrastructure development. However, it is necessary to review the regulations on functional areas in the Construction Law and the Land Law to avoid conflicts and overlaps, ensuring consistency in legal regulations.

From the process of participating in the review of the Law project with the National Assembly's Economic Committee, Mr. Le Quang Huy, Chairman of the National Assembly's Committee on Science, Technology, and Environment, suggested that it is necessary to compare, review, and re-evaluate the technical economic indicators, standards, technical regulations, on what basis and how to issue them, and review the relationship of the Law on Urban and Rural Planning with the planning and related specialized laws. Especially, review and compare with Article 46 of the Law on Planning.

According to Chairman of the National Assembly's Law Committee Hoang Thanh Tung, the draft Law is basically built on the basis of inheriting the provisions of the 2009 Law on Urban Planning; inheriting the provisions on rural planning and functional area planning of the 2014 Law on Construction.

Mr. Tung assessed that the draft Law has been reviewed to ensure consistency with the 2017 Planning Law. However, Mr. Tung suggested that the drafting agency should continue to review to determine the level of detail and the relationship between types of planning in the urban and rural planning system, ensuring clear distinction of roles and functions of each type of planning and planning levels, thereby avoiding duplication and overlap between types of planning.

Speaking at the meeting, National Assembly Chairman Vuong Dinh Hue assessed that the draft Law has inherited the current Law on Urban Planning. Along with that, it concretizes the contents, adds a number of new regulations, removes difficulties and inadequacies, and ensures consistency in the legal system.

According to the National Assembly Chairman, the draft Law needs to be reviewed to clarify and resolve the relationship between urbanization and new rural construction. The National Assembly Chairman also proposed a review to ensure the legal system is consistent with related laws, including draft laws such as the Law on Urban Development Management, as well as current laws such as the Law on Planning, Law on Public Investment, Law on State Budget, Law on Forestry, Law on Environmental Protection.

Concluding the meeting, Vice Chairman of the National Assembly Nguyen Duc Hai said that the National Assembly Standing Committee proposed that the Government continue to review to more fully institutionalize the Party's policies on planning, construction, management, and sustainable development of Vietnamese urban areas, and complete urban and rural planning to meet the requirements of sustainable and long-term development, ensuring harmony between economic development and cultural and social factors, environmental protection, linking urban and rural spaces, and supporting the development of regions across the country.
