The Office of the Hanoi People's Committee has just issued Notice No. 320 announcing the conclusion of the Chairman of the Hanoi People's Committee, Tran Sy Thanh, at the meeting on the results of the inspection and review of the implementation of non-budget capital projects using land that are slow to be implemented in Cau Giay district.
According to the report of the Department of Natural Resources and Environment, in Cau Giay district, there are 50 projects with non-budgetary capital that are behind schedule. In order to strictly and effectively implement the instructions of the City Party Committee, the City People's Council, and the City People's Committee, for 11 projects that have been remedied, constructed works and put the land into use, and are subject to continued monitoring and supervision, relevant departments, branches, and units are responsible for inspecting, supervising, and guiding project investors to promptly complete the investment and construction of the project to put it into operation and use.
“Relevant departments and branches should proactively consider removing difficulties and obstacles in planning, investment, and related procedures without having to wait for land use extension procedures to create conditions for investors to soon implement projects and put land into use,” the conclusion document stated.
Specifically, the head of the City People's Committee requested the Hanoi Land Fund Development Center (under the Department of Natural Resources and Environment) to urgently complete auction procedures according to regulations for the project at land lots A3/NO*, A4/NO, A5/NO of Nam Trung Yen Urban Area, Yen Hoa Ward, Cau Giay District.
For 11 projects that have had decisions to extend land use for 24 months, during the extension period affected by the Covid-19 epidemic, the city assigned the competent authorities to base on the regulations, urgently advise on resolving each specific case, and report to the City People's Committee before July 15, 2023.
For 4 projects that have had a decision to extend land use for 24 months and are in the process of extension, it is necessary to continue to monitor and speed up progress. For 13 projects that have proposed to extend land use, it is necessary to base on regulations to provide specific instructions to investors on procedures. The deadline for completion is before August 10, 2023.
With 4 projects being reorganized and handled public assets, there is a project to build office headquarters for member units at plot B2, Yen Hoa New Urban Area, invested by Urban Infrastructure Development Investment Corporation UDIC, which needs to be urgently inspected. The remaining 3 projects are assigned to the Department of Finance and competent authorities for handling. The results need to be reported to the City and competent authorities before July 15, 2023.
As for the Survey and Construction Company - USCO, which still owes social insurance and tax, the competent authority must request completion before July 30, 2023, and report to the City before August 10, 2023.
Meanwhile, 4 projects with investor problems include the Project at plots C3/CC2, B9/CC1, B9/CC3 of Nam Trung Yen Urban Area, invested by Handico - Thuy Duong Trading and Service Joint Stock Company; the project to build a residential area at 179 Trung Kinh invested by DEVYT Joint Stock Company; the project to invest in and operate a complex of office buildings, hotels and ancillary services at 222 Tran Duy Hung invested by Thang Long Property Company Limited; and the project to build a resettlement housing area at lane 204 Tran Duy Hung, which was assigned to the management agency for handling and handover before July 15, 2023.
Hanoi Chairman Tran Sy Thanh directed the handling of slow-moving non-budget capital projects using land in Cau Giay district.
Accordingly, Chairman of Hanoi People's Committee Tran Sy Thanh requested that during the review of projects, if any inappropriate content or potential risk of violation is discovered when implementing current regulations and procedures, it is necessary to resolutely correct and overcome it immediately.
"Doing it without fear or avoidance will affect the interests of the person proposing or using the land, leading to civil lawsuits," Mr. Thanh requested.
Next, in cases where projects cannot be continued or cannot be adjusted or corrected to continue, due to slow implementation, or are no longer in accordance with current legal regulations on planning, bidding, investment, and land, they will be resolutely abolished, revoked, stopped, or terminated.
At the same time, develop bidding and auction plans to select investors to implement the project according to current regulations.
Adjustments and remedies create conditions for investors to implement projects, must ensure the principle of not increasing population density, mechanical population in the area, not forming housing in sensitive areas. Priority is given to adjusting to increase the function of trees, public works invested with budget capital.
In case the projects have been adjusted, but now after review and comparison with current regulations, it is not possible to continue implementing the adjusted plan, it is necessary to consider readjusting the initially approved planning objectives and functions for implementation.
In case of failure to implement, the project will be terminated and revoked for bidding or auction to select an investor to implement the project according to current legal regulations .
