Important legal basis to remove difficulties and resolve problems

During the development process, Da Nang has achieved many important achievements in creating breakthroughs in planning, changing the urban appearance towards modernity. However, the use of land resources still faces many obstacles, affecting the socio-economic development of the city.

During the period 2012 - 2020, the city had 4 Conclusions of the Government Inspectorate: Conclusion 2852/KL-TTCP dated November 2, 2012; Conclusion 34/KL-TTCP dated January 8, 2019; Conclusion 269/KL-TTCP dated September 16, 2019; Conclusion 1202/KL-TTCP dated July 20, 2020 and 3 Criminal Appeal Judgments. In Son Tra peninsula, there are 13 projects that have not been able to complete procedures on investment, planning, and land; 1,313 cases related to the granting of Certificates of land use rights for production and business purposes but granted for a long term need to be resolved to free up resources.

Conference on Disseminating and implementing the Conclusions, Resolutions, Decrees, and Plans of the Central Government and Da Nang City on specific mechanisms and policies to remove difficulties and obstacles related to projects and land in the conclusions of inspections, examinations, and judgments in Da Nang City.

The main cause of the problems related to the implementation of inspection conclusions and judgments is due to the long-standing problems, especially Inspection Conclusion 2852/KL-TTCP from 2012 to now, more than 10 years; related to many subjects, wide scope, in different localities, through many periods with changes in policies and laws; there are no specific legal regulations to handle or there are regulations but they are not suitable for practice; due to the fault of state management agencies, the law protects bona fide third parties in civil transactions; Many projects have been transferred to many investors, some housing projects have been transferred to people to live stably for many years... The need to implement some contents with difficulties and obstacles according to the conclusions of inspections, examinations, and judgments has and will lead to complicated complaints, affecting the political security situation, social order and safety, and the legitimate rights and interests of people and businesses.

Speaking at the conference, Chairman of the City People's Committee Le Trung Chinh said that in recent times, implementing the recommendations of the inspectorate, Da Nang City has mobilized many resources and drastically implemented remedial measures. In particular, the leaders of the City People's Committee participated as members of the Prime Minister's Working Group in Decision No. 153/QD-TTg dated January 29, 2022; at the same time, established a Working Group to inspect and review difficulties and problems related to projects and land in the inspection, examination and judgment conclusions related to Da Nang City, directly participated and had 3 Reports proposing cases of difficulties and problems.

On May 2, 2024, the Politburo issued Conclusion No. 77-KL/TW on the Project "Plan to remove difficulties and obstacles related to projects and land in inspection, examination and judgment conclusions in a number of provinces and cities". On November 30, 2024, at the 8th session of the 15th National Assembly, Resolution No. 170/2024/QH15 was passed on specific mechanisms and policies to remove difficulties and obstacles for projects and land in inspection, examination and judgment conclusions in the provinces and cities of Ho Chi Minh City, Da Nang and Khanh Hoa. And in the near future, the Government will issue a Decree guiding the detailed implementation of Resolution 170 of the National Assembly.

Thus, after many efforts, Da Nang city has had an important legal basis to remove difficulties and resolve problems related to projects and land in the inspection, examination and pending judgment conclusions in the past.

“This is a very important conference to strengthen the information and propaganda work, the Central Government's guidelines and policies for the city's development; at the same time, thoroughly grasp and deploy to all agencies, units and localities of the political system in the city about important contents and direct the implementation work; contributing to creating momentum for the sustainable and comprehensive development of the city in the coming time", the Chairman of the City People's Committee emphasized.

At the Conference, delegates were informed of the basic and core contents of Conclusion No. 77-KL/TW dated May 2, 2024 of the Politburo, Resolution 170/2024/QH15 dated November 30, 2024 of the National Assembly, the draft Decree of the Government as well as the Implementation Plan of the City Party Committee and the City People's Committee on implementing Conclusion No. 77-KL/TW and Resolution No. 170/2024/QH15 in the city; raising awareness and responsibility of Party committees at all levels, cadres and Party members in implementing tasks in the city, especially in the coming time.

Through the Conference, the Da Nang City government wishes to coordinate with relevant businesses and investors to implement with the spirit of "faster, more drastic and more responsible"; contributing to unblocking resources, putting assets into circulation, avoiding loss and waste, promoting socio-economic development.

Speaking at the conference, Secretary of the City Party Committee Nguyen Van Quang stated that these extremely important policies were achieved thanks to the responsible and impartial participation of central ministries and branches, especially the close participation and dedication of central leaders, as well as leaders at all levels and branches of Da Nang city.

“Continuing the process of organizing and developing relevant policy documents on removing obstacles for projects and land, Da Nang City has been clearly demonstrating its determination and consensus in directing and organizing implementation. Together, we have determined that these obstacle removal policies are very good opportunities, the foundation to promote the city to develop more rapidly,” the Secretary of the City Party Committee emphasized.

To effectively implement Conclusion No. 77-KL/TW and Resolution No. 170/2024/QH15, Secretary of the City Party Committee Nguyen Van Quang requested that Party committees at all levels, Party organizations, agencies, localities and units in the city, especially the leaders, fully absorb and grasp the viewpoints, principles and directives of the Politburo, the National Assembly and the Government related to policies to remove difficulties in order to consistently implement them in the city in a drastic and urgent manner, with high determination and great efforts, in accordance with the actual situation and conditions in the locality and unit; in which, the organization of implementation must identify "clear people, clear work, clear responsibilities, clear resources, clear time and results achieved", identifying this as a key task in 2025 and the entire 2025-2030 term.

Member of the Party Central Committee, Secretary of the City Party Committee, Head of the City National Assembly Delegation Nguyen Van Quang delivered a speech directing the conference.

“Request the Standing Committee of the City Party Committee to direct the City People's Committee to fully publicize the contents of Resolution No. 170/2024/QH15 and the Government's guiding Decree to investors and related parties with rights and obligations. Absolutely do not allow corruption, negativity, and waste in the process of organizing and implementing policies. This is one of the highest requirements of Conclusion 77 and Resolution 170,” the City Party Secretary stated.

According to Secretary Nguyen Van Quang, the City People's Council, the City People's Committee, departments, branches and localities need to focus on immediately developing and promulgating documents under their authority in accordance with the direction of the Central agencies and Plan No. 232-CT/TU of the Standing Committee of the City Party Committee. In the process of developing and implementing tasks, it is necessary to seek guidance from relevant Committees, ministries and branches; listen to comments and suggestions from the business community and investors to ensure feasibility and effectiveness in practice.

The Propaganda and Mass Mobilization Department of the City Party Committee is responsible for presiding over and coordinating with relevant agencies to develop a Plan to guide and propagate the implementation of Central documents as soon as possible; especially having solutions to propagate and mobilize people to strictly comply with policies and regulations on removing difficulties and obstacles related to projects and land in inspection, examination and judgment conclusions.

“The City Party Committee's Internal Affairs Committee shall preside over and coordinate with the City Party Committee's Inspection Committee, the City Party Committee's Organization Committee and relevant agencies to advise the City Party Committee's Standing Committee to monitor, inspect and supervise the implementation of the City Party Committee's directives; advise on strict handling of organizations and individuals who avoid, push aside, conceal violations or take advantage of the implementation to commit corruption and negativity. This is one of the five viewpoints and principles of handling that the Politburo has clearly stipulated in Conclusion 77,” Secretary Nguyen Van Quang directed.

The Secretary of the City Party Committee once again emphasized that the organization and implementation of conclusions, Resolutions, Decrees and plans related to specific mechanisms and policies to remove difficulties and obstacles related to projects and land in the inspection, examination and judgment conclusions in Da Nang city is a key task in 2025 and the entire period of 2025-2030, and must focus on drastic implementation, striving to complete as soon as possible and as quickly as possible the contents assigned by the Central Government to the city.
