Land acquisition for Indochina Quang Binh Resort construction project

(QBĐT) - The Provincial People's Committee has just announced the revocation of land used by Indochina Central Joint Stock Company to implement the construction project of Indochina Quang Binh Resort in Quang Phu commune (Dong Hoi city) due to incomplete fulfillment of financial obligations to the State.

The central land area where the project is to be implemented has been abandoned for many years.

Accordingly, the Provincial People's Committee announced the recovery of ^71,373m2 of land used by Indochina Central Joint Stock Company which was leased in Decision No. 2854/QD-UBND, dated November 4, 2010 to implement the project of building Indochina Quang Binh Resort and was granted a certificate of land use rights, house ownership rights and other assets attached to the land by the Department of Natural Resources and Environment (now the Department of Agriculture and Environment) on April 12, 2019.

The reason for the revocation is that Dong Duong Mien Trung Joint Stock Company did not fully fulfill its financial obligations to the State when using land to implement the project. Specifically, as of December 5, 2024, Dong Duong Mien Trung Joint Stock Company still owed more than 23 billion VND in taxes for the Indochina Quang Binh Resort construction project. This tax debt violates the provisions of Clause 9, Article 11 of the 2024 Land Law.

The office headquarters of Dong Duong Mien Trung Joint Stock Company in the project area is deserted and abandoned for a long time.

According to the announcement of the Provincial People's Committee, the tax authority has taken measures in accordance with the law to force Dong Duong Mien Trung Joint Stock Company to comply. However, up to now, the Company has not yet complied.

The above violation of Dong Duong Mien Trung Joint Stock Company falls under the case of land recovery as prescribed in Clause 6, Article 81, Land Law 2024; Article 30, Decree No. 102/2024/ND-CP, dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law.

An item of the office headquarters project of Dong Duong Mien Trung Joint Stock Company at the project has been abandoned for many years.

The Provincial People's Committee requests Dong Duong Mien Trung Joint Stock Company to complete the handling of assets on the land within no more than 45 days from the date of receiving the land reclamation notice. The Department of Finance shall preside over and coordinate with relevant departments, branches and localities to determine the remaining value of the investment price in land or assets attached to land (if any) according to regulations for handling in accordance with the provisions of law.
