Assign and delegate tasks clearly to people and jobs, overcoming the problem of document backlog

On the afternoon of June 1, continuing the program of the 5th Session, the National Assembly discussed the approval of the 2021 state budget settlement; the work of practicing thrift and combating waste in 2022. National Assembly deputies assessed that the backlog of documents still exists, affecting policy implementation, and at the same time proposed solutions to improve the efficiency of document management and issuance.

Document backlog affects policy implementation

Discussing at the meeting, delegate Tran Thi Thanh Lam (Ben Tre) said that the work of law-making in issuing guiding documents and detailed regulations is still slow, has backlogs, and policy responses are not really timely. This is a situation that has lasted for many years, through many terms, although it has gradually improved but has not achieved the desired results, although the National Assembly and the Government always focus on the priority of institutional improvement.

The delegate gave examples of detailed regulations in the fields under the responsibility of the Social Committee that have not met the requirements on the issuance deadline. The Law on Prevention and Control of Harmful Effects of Alcohol and Beer, the Law on the Elderly, the Law on the Disabled, the Law on Labor Safety and Hygiene, the Ordinance on Incentives for People with Meritorious Services to the Revolution, etc. still have a situation of delay in issuing guiding documents.

According to the delegate, the delay and delay in promulgating legal documents directly and indirectly affect the organization and implementation of policies for target groups, especially groups of people with revolutionary contributions, vulnerable groups (the elderly, the disabled), and the protection of the rights and legitimate interests of workers in social insurance in regulations on workers' representative organizations and collective bargaining.

"Although it is difficult to weigh, measure, and count the obstacles and disadvantages of debt and slow issuance of documents, it can be seen that the system of slow issuance of documents and debt is the obstacle blocking the path of State policies to the people," the delegate emphasized.

Agreeing with the above opinion, delegate Ly Thi Lan (Ha Giang) said that a synchronous and complete legal system, along with a system of norms, standards, regimes and norms, is the most important measure and basis for practicing thrift and fighting waste. In 2022, the Government, ministries and local branches have done a relatively good job in this work. However, the Government needs to report and assess more clearly the shortcomings, limitations and waste, especially waste arising from the untimely and incomplete promulgation of legal regulations. This is one of the causes leading to waste, even corruption and negativity in the management and use of public investment budgets.

The delegate said that the backlog of legal documents and detailed instructions has not been resolved, leading to difficulties in implementing plans and tasks. The delegate emphasized that this delay causes a waste of opportunities to implement the program, as well as a waste of opportunities for people, especially ethnic minorities and mountainous areas, to enjoy state policies.

From the above issues, delegate Tran Thi Thanh Lam (Ben Tre) proposed that it is necessary to focus on quickly completing national databases to serve digital transformation, administrative reform, social governance and organize implementation in a practical manner. On the other hand, it is necessary to urgently develop specific roadmap projects to implement salary reform, creating motivation for the administrative apparatus, for cadres, civil servants and public employees to dedicate themselves and feel secure in their work; improve responsibility and ethics in performing public duties. At the same time, it is necessary to soon have regulations on legal responsibilities for relevant agencies and organizations in performing assigned tasks if there is a debt situation, and slow issuance of guiding documents to remove difficulties and obstacles in practice.

Delegate Tran Van Khai (Ha Nam) proposed that the National Assembly Standing Committee assign the Law Committee to preside with the National Assembly agencies in 2024 to conduct thematic supervision of "the implementation of legal policies by cadres and civil servants according to the Law on Cadres and Civil Servants in 2022" nationwide. In particular, focusing on the obligations and rights of cadres and civil servants (Chapter II) and the things that cadres and civil servants are not allowed to do in Section 4, Article 18, which stipulates prohibited things related to public ethics: Evading responsibility, shirking assigned tasks, causing factions, disunity, voluntarily quitting work or participating in strikes.

In addition, the delegate of Ha Nam province said that it is necessary to continue to perfect the institution in the direction of focusing on individualizing responsibilities, especially the responsibilities of leaders. Each level, each sector, each locality should build a process to personalize the responsibilities of each job and each field, taking actual effectiveness as the basis for evaluating cadres; continue to direct the tightening of discipline in the entire political system, assigning and assigning tasks to clear people, clear tasks, clear deadlines, along with regular inspection and supervision. When each agency, unit, organization, and locality is interested in and determined to individualize responsibilities, the strength of the political system will certainly be increasingly consolidated.

Delegates recommended that the National Assembly and the Government direct ministries and branches to strictly implement legal regulations on promulgating legal documents, minimizing waste in organizational arrangement, overcoming shortcomings and limitations that have been pointed out to further improve the results of practicing thrift and fighting waste.

Unblocking resources, creating conditions for the economy to absorb capital flows

Discussing at the meeting hall, delegate Nguyen Truc Son (Ben Tre) was interested in three contents: adjusting medium-term public investment capital, the socio-economic recovery and development program, and budget management.

Regarding the adjustment of medium-term public investment capital, delegates agreed with the content of the Finance and Budget Committee's Review Report and said that the Government's adjustment this time has compiled a list of works, projects and appendices to submit to the National Assembly that is very complete and consistent with the proposals of the localities. In particular, for the Mekong Delta region, the provinces and cities are eager to soon implement the coastal road project connecting 13 provinces and cities in the region.

To implement this route, delegates recommended that the National Assembly and the Government pay attention to removing some bottlenecks, allowing the implementation of some support mechanisms such as: Re-lending mechanism for provinces and cities in the Mekong Delta region, at a ratio of 90 - 10 (90% of allocated capital and 10% of re-borrowed by the provinces). For inter-provincial projects (such as large bridges connecting the two provinces of Ben Tre - Tien Giang, Ben Tre - Tra Vinh), it is proposed that the Government allow access to capital in the direction of the Government allocating 100% of loan capital (the Ministry of Transport can be assigned as the investor) or assigned to the People's Committee of a province as the investor to implement. 13 provinces and cities in the Mekong Delta approached 6 different groups of sponsors, delegates suggested that the Central Government assign a Ministry to take the lead and negotiate with 13 localities on this issue to ensure synchronous implementation.

Regarding the Socio-Economic Recovery and Development Program, delegate Nguyen Truc Son said that with a 2-year period (2022 - 2023) as stipulated in Resolution No. 43/2022/QH15 and the current disbursement progress, it is very difficult for localities to complete the programs and projects by the end of the year, especially localities assigned capital in 2023.

Delegates recommended that for localities allocated capital in 2023, the National Assembly supports the Government's proposal to extend the implementation period to 2024 - 2025, and at the same time recommends flexible regulation between the two Socio-Economic Recovery and Development Programs and the Medium-Term Public Investment Program 2020 - 2025 because the implementation periods of the two programs are close together, in order to free up resources and create conditions for the economy to absorb capital flows.
