5th Session, 15th National Assembly: Approval of Resolution on taking a vote of confidence

Continuing the program of the 5th Session, on the afternoon of June 23, the National Assembly voted to pass the Resolution on taking a vote of confidence, a vote of no confidence for people holding positions elected or approved by the National Assembly and People's Councils (amended), with 470/473 delegates present in favor (accounting for 95.14% of the total number of National Assembly delegates). The Resolution takes effect from July 1, 2023.

According to the Resolution, the National Assembly will take a vote of confidence for those holding the following positions: President, Vice President; Chairman of the National Assembly, Vice Chairman of the National Assembly, member of the National Assembly Standing Committee, Secretary General of the National Assembly, Chairman of the Nationality Council, Chairman of the National Assembly Committee; Prime Minister, Deputy Prime Ministers, Ministers, other members of the Government; Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy, State Auditor General.

The People's Councils at provincial and district levels take a vote of confidence for: Chairman of the People's Council, Vice Chairman of the People's Council, Head of the People's Council Committee at provincial and district levels; Chairman of the People's Committee, Vice Chairman of the People's Committee, members of the People's Committee at provincial and district levels.

In case a person holds multiple positions at the same time, the vote of confidence is conducted once for all those positions.

The vote of confidence and vote of no confidence aim to improve the effectiveness and efficiency of the supervision activities of the National Assembly and People's Councils; improve the quality and efficiency of the state apparatus; contribute to assessing the prestige and results of the performance of assigned tasks and powers of those who are voted for, and vote of no confidence, helping them see their level of trust to continue to strive, practice, and improve the quality and efficiency of their work; serve as a basis for competent agencies and organizations to consider planning, training, fostering, arranging, and using cadres.

The resolution clearly states that the results of the vote of confidence are used to evaluate cadres, serving as a basis for planning, mobilizing, appointing, recommending candidates, dismissing and implementing regimes and policies for cadres.

A person who is voted on for a vote of confidence and has more than half to less than two-thirds of the total votes for "low confidence" may resign; in case of not resigning, the National Assembly Standing Committee shall submit to the National Assembly, and the People's Council Standing Committee shall submit to the People's Council for a vote of confidence at that session or the nearest session.

If a person subject to a vote of confidence receives a "low confidence" rating of 2/3 or more of the total votes, the agency or person with authority to recommend that person for election or approval by the National Assembly or People's Council shall be responsible for submitting the case to the National Assembly or People's Council for dismissal at that session or the nearest session.

Previously, presenting the Report on explanation, acceptance and revision of the draft Law, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the National Assembly Standing Committee accepted the opinion of not regulating the vote of confidence for commune-level officials to ensure consistency with the scope of subjects eligible for the vote of confidence according to Regulation No. 96-QD/TW of the Politburo on the vote of confidence for leadership and management positions and titles in the political system. The vote of confidence is only carried out at the People's Councils at the provincial and district levels.

Some opinions suggest adding all subjects elected or approved by the National Assembly and People's Councils to the list of subjects eligible for a vote of confidence (such as members of the National Defense and Security Council, Judges of the Supreme People's Court, Deputy Heads of the People's Council, and Jurors of the People's Courts at the provincial and district levels).

The Standing Committee of the National Assembly believes that, according to current legal regulations, the total number of people holding positions and titles elected or approved by the National Assembly and People's Councils is quite large.

Therefore, to ensure the practical effectiveness of the vote of confidence, the Resolution only identifies the subjects eligible for the vote of confidence as those holding positions that have important influence on the promulgation and implementation of policies or those holding positions at agencies with a role in leading and directing regular activities (such as the Standing Committee of the National Assembly, the Government, the Standing Committee of the People's Council, the People's Committee) and does not apply it uniformly to all positions and titles elected and approved by the National Assembly and the People's Council such as Judges, People's Assessors or deputies at the Committees of the People's Council.

For members of the National Defense and Security Council and members of the National Election Council, the Resolution has stipulated the vote of confidence for other positions elected or approved by the National Assembly that members of the above agencies concurrently hold (President, Chairman of the National Assembly, Prime Minister, Minister of National Defense, Minister of Public Security, Minister of Foreign Affairs, Vice Chairmen of the National Assembly and some members of the National Assembly Standing Committee).
