Solving the existing land problem

On the afternoon of June 21, the National Assembly discussed in the hall the project of "1 law amending 4 laws": namely the Law amending and supplementing a number of articles of the Land Law, Housing Law, Real Estate Business Law, and Credit Institutions Law.

The real estate market is expecting a "break of the ice"

National Assembly Delegate Nguyen Tuan Anh (Binh Phuoc Province Delegation) highly appreciated the Government's determination and efforts in proposing to adjust the effective date from August 1, 2024 for the above laws.

According to the delegate, the early promulgation of the Land Law is beneficial to land users. Specifically, allowing individuals who are not directly involved in agricultural production to receive transfers or gifts of land use rights for rice cultivation, along with conditions to preserve agricultural land areas, is consistent with the current trend of developing high-tech agriculture and large-scale agriculture.

This also creates conditions for agricultural development in the new context, increases the economic value of rice cultivation, and develops the country's agriculture in general. At the same time, it creates conditions for households and individuals to transfer more conveniently or change jobs to ensure their livelihood.

In addition, the initial investment cost of greenhouses, closed houses, and automatic irrigation systems is quite high, but when not in use, the recovery value is very low... Therefore, when the 2024 Land Law comes into effect, allowing enterprises and economic organizations to receive the transfer of rice-growing land up to tens of hectares, it has removed the bottleneck for enterprises, economic organizations, and households when investing in the agricultural sector.

In addition to increasing the efficiency of agricultural land use, delegate Nguyen Tuan Anh said that the real estate market is also expecting a "break of the ice" when the Land Law soon takes effect.

Delegate Nguyen Tuan Anh analyzed that real estate businesses said that the real estate market has been in a "waiting state" recently. Especially waiting for legal problems to be resolved (accounting for 70% of the problems of real estate businesses), this is the decisive factor in the formation and development of real estate projects, the key issue that needs to be resolved to create momentum to help the real estate market recover - especially problems related to land policies.

In particular, many businesses are waiting for the law to take effect so they can switch to leasing land and paying rent annually, reducing the financial burden during the initial stages of project implementation. From there, real estate prices will also have the opportunity to be adjusted to a more reasonable level.

Delegates proposed that the Government be more determined and commit to the National Assembly in promptly issuing documents guiding implementation as well as supporting provinces in developing and promulgating regulations related to local authority.

Prepare carefully, ensure progress and quality of guidance documents

Speaking at the discussion, National Assembly delegate Nguyen Truc Anh (Hanoi Delegation) said that speeding up the law's implementation by 5 months will resolve current problems in implementing land-related issues.

“The government has made many innovations in law making and enforcement. The sooner the draft laws are enforced, the sooner they will have a positive impact on the economy and society,” said delegate Nguyen Truc Anh.

Sharing the same view, National Assembly delegate Nguyen Quang Huan (Binh Duong Provincial Delegation) said that putting the laws into effect early will have a positive impact on GDP growth in the last 6 months of 2024 because the laws will remove obstacles and promote investment in production and business.

According to delegate Nguyen Quang Huan, there are FDI enterprises that want to expand production but are currently having to stop because of the law. FDI enterprises have plans to allocate capital, if delayed, it may lead to restructuring or changing investment areas. Therefore, the sooner the law is issued, the better. The delegate suggested that the Government urgently issue decrees so that localities can organize training and provide guidance on implementation.

Speaking at the meeting, National Assembly delegate Pham Van Hoa (Dong Thap province delegation) supported the policy of bringing the above laws into practice soon. However, according to the delegate, some provisions in the laws can be implemented immediately but there are still many contents that need detailed guidance documents.

Therefore, delegates suggested that the Government carefully prepare and ensure the progress and quality of detailed guidance documents - especially those developed by localities; organize propaganda and widely disseminate laws, create unity in awareness of law enforcement, and ensure effective implementation of these laws when they come into effect.
