Da Nang strives to implement 3 laws on Land, Housing, and Real Estate Business

DNO - On the morning of October 8, the inspection delegation of the Ministry of Natural Resources and Environment on the implementation of the 2024 Land Law, the 2023 Housing Law, the 2023 Real Estate Business Law and decrees detailing the above laws, led by Director of the Department of Planning and Land Resources Development (Ministry of Natural Resources and Environment) Dao Trung Chinh, worked with the People's Committee of Da Nang City. Speaking at the meeting, Vice Chairman of the City People's Committee Le Quang Nam affirmed that in recent times, Da Nang has made great efforts to implement the three laws on Land, Housing and Real Estate Business, especially the departments have simultaneously developed and completed the content of legal documents implementing the three laws under the authority of the city to submit to the City People's Committee and the City People's Council for approval.

However, with a large, complicated and difficult workload, especially the issuance of many legal documents under the city's authority, Da Nang cannot "arrange horizontally" to implement all issues due to lack of human resources, but has been implementing priority and urgent issues, especially early implementation of regulations to remove obstacles and difficulties; create favorable conditions for people and businesses; create motivation and promote socio-economic development...

Vice Chairman of the City People's Committee Le Quang Nam also requested the Ministry of Natural Resources and Environment to continue to pay attention to and remove some obstacles and difficulties for the city and supplement regulations and instructions for implementing some new regulations, including adding the purpose of commercial and service use in underground space.

Director of the Department of Planning and Land Resources Development Dao Trung Chinh highly appreciated the work that Da Nang city has done in implementing the three laws on Land, Housing and Real Estate Business.

The city needs to promptly complete a report on the implementation of the three laws and send it to the working group, clearly reflecting the city's characteristics as well as difficulties and obstacles so that ministries and branches can promptly guide and resolve them. Through this, ministries and localities can also unify the understanding of the content of the regulations, avoiding the situation where each locality does things differently.

At the same time, it is recommended that the city continue to pass and promulgate legal documents on the implementation of the three laws and detailed decrees.

According to the report of the Department of Natural Resources and Environment, after issuing the plan to implement the 2024 Land Law, the City People's Committee continued to issue 14 documents directing the implementation and urging the implementation. On October 7, the City People's Committee continued to issue documents adjusting the plan to implement the 2024 Land Law in the direction of updating the implementation of the Government's decrees.

Of the 19 contents under the authority of drafting legal documents of the city, there are 2 contents under the authority of the City People's Council to issue resolutions (land policy for ethnic minorities; criteria for deciding to conduct bidding to select investors to implement projects using land suitable to the actual situation of the locality).

Regarding 17 contents under the authority of the City People's Committee, it has been divided into 5 documents (decisions) regulating the land limit assigned to religious organizations and affiliated religious organizations in the city; compensation, support, and resettlement when the State reclaims land; regulations on a number of contents in the field of land in the city...

The City People's Committee has issued a decision to announce the list of administrative procedures in the field of land under the jurisdiction of the Department of Natural Resources and Environment, People's Committees of districts, wards and communes in the city.

According to Director of the Department of Construction Phung Phu Phong, to implement the two laws on Housing and Real Estate Business, the city plans to issue 6 legal documents detailing and implementing state management measures in the area, of which the City People's Committee will issue 4 decisions and the City People's Council will issue 2 resolutions.

Regarding some difficulties and obstacles in reviewing, amending and supplementing local legal documents, Da Nang has the characteristic of having the largest housing fund and social housing fund invested by state budget capital in the country with about 10,400 apartments for rent.

Reviewing the arrangement of apartments and managing the use of housing funds to comply with newly issued legal regulations must avoid major impacts on people using these apartments.
