National Assembly Chairman Vuong Dinh Hue affirmed this when talking to the press on the occasion of the Lunar New Year 2024, about the innovation and results of the National Assembly's activities in recent times, especially a series of "first-time" decisions in 2023.
Over the past year, the National Assembly has continued its spirit of proactive legislation, development creation and long-term vision. In 2023, the National Assembly passed and commented on 46 draft laws and resolutions, of which 15 draft laws, 12 resolutions and 19 other draft laws were passed. At the 5th Extraordinary Session in early 2024, the National Assembly also passed two very important draft laws: the Land Law (amended) and the Law on Credit Institutions (amended).
This is a record number of draft laws in 2 regular sessions and 1 extraordinary session so far, especially prioritizing laws in key areas of key significance, high feasibility, creating breakthroughs in socio-economic development, solving and removing immediate difficulties, creating conditions for the country to develop sustainably and integrate deeply into the world.
National Assembly Chairman Vuong Dinh Hue said that for the first time, the National Assembly Party Delegation proactively submitted to the Politburo the Conclusion on the program for building laws and ordinances for the entire term at the beginning of the term. On that basis, the National Assembly Standing Committee issued Plan 81 for implementation, which clearly defined what to do, who to do it, and when to do it, so that there should be proactive research early and from afar; overcoming the situation where what is needed is not yet available and what is available is not necessarily necessary, or the situation of "waiting for rice from others" or lacking long-term orientation.
During the implementation process, based on reality, some things were added and some content was removed from the program, but in general, there was a plan. This is a very valuable experience that has been drawn from the previous terms and will probably continue to be applied to the next term. Therefore, although it is only the middle year of the term, by the end of the 6th Session, the National Assembly has completed 114/137 tasks, reaching 83.21% according to Plan 81.
In order to implement the requirement of “closely linking law-making with law enforcement, ensuring that laws are implemented fairly, strictly, consistently, promptly, effectively and efficiently”, for the first time, the National Assembly held a conference to deploy laws and resolutions issued by the National Assembly from the beginning of the term to the end of the 5th session. Since the 6th session, this dissemination has been carried out annually because “when it becomes a routine, it can be promoted”, contributing to overcoming the weak point of implementation.
According to the National Assembly Chairman, another highlight of the past year was the overall review of the legal system. Overlapping, contradictions, and inadequacies in some regulations are real, but the extent and how must be clear, not everything that cannot be done or does not dare to be done must be blamed on the law. Through Resolution No. 101/2023/QH15, the National Assembly assigned the Government to preside over and coordinate with relevant agencies to organize a review of the system of legal documents (from laws, ordinances, resolutions of the National Assembly, the Standing Committee of the National Assembly, decrees, circulars, etc.), focusing on 22 key areas and other areas with many problems as recommended by localities, people, and businesses.
The results of the report to the National Assembly at the 6th Session showed that the reviewed legal documents were basically consistent with the Party's policies and guidelines, the provisions of the Constitution, and compatible with international treaties to which Vietnam is a member. More importantly, the discovered problems and shortcomings were all included in the working program of the term for handling, such as in the Law on Property Auction, the Housing Law, the Land Law, etc.; sub-law documents were required to be immediately remedied.
“Vietnam is a developing country, the need to amend and supplement the legal system to meet the reality is completely normal. However, there cannot be overlaps, contradictions, and legal loopholes to the point that officials cannot do it,” Mr. Vuong Dinh Hue emphasized, and said that in 2024, a general review of administrative procedures will be conducted to see what “sub-licenses” are and to what extent.
“Completing the legal system, promoting administrative reform, and improving the investment and business environment. These are policies that demonstrate putting people and businesses at the center,” according to the National Assembly Chairman.
The supervision work remains consistent with the spirit of the General Secretary's assignment from the opening session of the first session of the 15th National Assembly, which is to take innovation in supervision work as the central and key step to innovate the activities of the National Assembly.
Concerned first with perfecting the institution for supervision, the National Assembly has devoted a lot of effort and enthusiasm to resolve to soon amend the Law on supervision activities of the National Assembly and People's Councils to be closer to reality, more feasible, more substantial, and to improve capacity, effectiveness and efficiency. The National Assembly Standing Committee has a resolution guiding the supervision work of People's Councils and is considered a handbook, resolving many difficulties at the local level.
The National Assembly Standing Committee is currently drafting a resolution to guide the implementation of the explanation sessions at the National Assembly and the agencies of the National Assembly. “Strengthening the explanation will be more flexible and closer to real life, especially on outstanding issues, but there are currently no instructions. Many explanation sessions end without conclusions, and without a resolution, there is no validity. Therefore, this time the National Assembly Standing Committee is determined to issue it, creating strength for the National Assembly and the agencies of the National Assembly,” Mr. Vuong Dinh Hue emphasized.
In addition, the National Assembly Standing Committee is also focusing on coordinating to amend the resolution on voters' contact with National Assembly deputies and People's Council deputies to make it more substantial, in-depth, and closer to the requirements of life.
The elected bodies belong to the people, represent the people, so the spirit of placing the word "people" is the key and core factor. The 15th National Assembly made a breakthrough when it considered the work of people's petitions on a monthly basis. In 2023, for the first time, the National Assembly discussed in the hall the results of monitoring the settlement of voters' petitions. This spirit also creates a new breeze in the locality. Only then will people put their trust in the elected bodies.
“There are also newspapers asking that when taking the oath of office, the National Assembly Chairman said that all decisions must put people and businesses at the center. Have the National Assembly and the National Assembly Chairman done so so far? I would like to report that all of the above are directed towards people and businesses,” said Mr. Vuong Dinh Hue.
Then, the questioning and answering activities have increasingly been explored and innovated. The questioning and answering session at the 6th Session was assessed as "innovative", "special", even "unprecedented" when considering the scope of the questioning, the way it was conducted, and looking back over more than half of the term.
Regarding thematic supervision, it is still a bright spot. It is clearer that the viewpoint of supervision must also create development, focusing on monitoring what is happening, not "post-auditing". Even during the supervision process, changes have been created and at the end of supervision, it has been further promoted. For example, the National Assembly has passed a number of specific mechanisms and policies to accelerate the progress of the 3 National Target Programs.
“With the above spirit, in 2024, the National Assembly will have supreme supervision over real estate and social housing. Only when the market is frozen like this, supervision is needed, but when it is operating normally, there is no need to do so. The spirit is to supervise to create development. As people often say, to supervise is to be close, to be close is to be supervised” – the National Assembly Chairman emphasized.
The recent National Assembly's permission for the 2022 state budget capital (including 2021 capital transferred to 2022) that has not been fully disbursed in 2023 to be extended to 2024 to continue implementing the 3 National Target Programs is also unprecedented.
Explaining this, he said that on the one hand, tightening discipline and administrative discipline is not a fait accompli so we have to follow it, but he feels that extending the allocation will be much better than canceling the budget and finding other sources to arrange, which may cause even more congestion. Similarly, with the 4 important national projects, if we rigidly say cancel the budget and arrange other capital, it is also okay, but the budget may take a few years, and then determining the investment source, where is the money...
The National Assembly recently passed a resolution to implement a comprehensive reform of the wage policy from July 1, 2024. Emphasizing the significance of this decision, National Assembly Chairman Vuong Dinh Hue said that the principle of people's participation is for the innovation to be successful, and if people do not enjoy the fruits of the innovation, the meaning of innovation will also be reduced, not to mention that after the pandemic, the health of people and businesses will be eroded. Spending on people is also spending on development investment.
“When we said that there was a source of 560,000 billion VND to prepare for salary reform from 2024 to 2026, many countries were surprised. People said that they thought that all the money Vietnam had would be used to build highways. But that's not true, each job has its own job. The increase in central budget revenue must be set aside 40% for salary reform, and the increase in local budget revenue of 50-50 must be set aside half for salary reform. The Central Resolution states it directly, there is no room for change, only by being persistent like that will there be resources to do it” – National Assembly Chairman Vuong Dinh Hue added.
Or right when the 6th Session was taking place, the National Assembly decided to adjust and add to the 2023 Law and Ordinance Development Program two draft resolutions for consideration according to the procedure at a session and the National Assembly worked for half an extra day. In particular, in order to "relax the people's strength", based on the Government's submission, the National Assembly decided to continue to reduce value-added tax to promptly support people and businesses.
“The National Assembly now follows the spirit of working together to resolve urgent issues for the country and its people, based on the Government’s submission or proactively discussing with the Government to make timely decisions. Recently, localities and ministries used the Buddhist term “joy” when the recent National Assembly resolved the matter very correctly and accurately,” said National Assembly Chairman Vuong Dinh Hue.
However, the National Assembly Chairman also noted that, in addition to focusing on removing immediate bottlenecks and bottlenecks, we must always look at fundamental, long-term issues. Institutional and policy building must comply with the Party's guidelines and resolutions. Urgent issues that are ripe, clear enough and have received high consensus should be legalized for implementation; urgent issues that are not ripe, clear enough and have not received consensus should continue to be studied. Those that are permitted by competent authorities should be piloted but with specific scope, address and time.
The achievements are not small, but there are still many difficulties and challenges ahead. However, according to National Assembly Chairman Vuong Dinh Hue, opportunities always exist, especially with the foundations that have been established in recent years and sometimes we have to turn “danger” into “opportunity”, and then “when the rain stops, the sky will be clear again!”
