Lawyer Nguyen Phuong Tuyen, Hanoi Bar Association, said that in one year, up to 4 officers and employees were prosecuted at Bac Thang Long Hospital (under Hanoi Department of Health), showing that the hospital leaders and related deputies have not yet strictly controlled the hospital's officers and employees.
As reported by Dai Doan Ket Newspaper, in 2024, the Criminal Investigation Agency for Public Service Organizations (CSO), Ministry of National Defense, issued 4 decisions to prosecute 4 officers and employees of Bac Thang Long Hospital, under the Hanoi Department of Health. Also in 2024, Mr. Vu Thanh Chung, Director of Bac Thang Long Hospital, had to report twice the incident that occurred at the hospital to the Hanoi Department of Health regarding the 4 prosecuted employees.
The first time, on August 5, 2024, Mr. Vu Thanh Chung, Director of Bac Thang Long Hospital, sent report No. 711/BVBTL-KHTH to the Hanoi Department of Health regarding the decision of the Department of Criminal Investigation, Ministry of National Defense to prosecute the case and prosecute 3 employees working at the Hospital in the case of "Fraudulent appropriation of property" and "Forgery in work".
The document states that the Department of Criminal Investigation, Ministry of National Defense is investigating the case of “Fraudulent appropriation of property” and “Forgery in work” that occurred in Hanoi City and Thai Nguyen Province related to MB Ageas Life Insurance Company Limited. This case is related to the medical examination and treatment activities of a number of doctors and medical staff of Bac Thang Long Hospital.
Three hospital employees were prosecuted by the Department of Medical Examination and Treatment, Ministry of National Defense, including: Phan Thi Thu Ha, working at the Department of Functional Exploration; Dao Thi Quyen, working at the Department of Infectious Diseases and Hoang Thi Tuyet, working at the Department of Emergency.
The second time, on December 26, 2024, Mr. Vu Thanh Chung, Director of Bac Thang Long Hospital, continued to report to the Hanoi Department of Health. The report showed: “… On December 26, 2024, the Hospital received: Decision No. 1247/QD-VKSTĐ-B1 dated December 26, 2024 of the Hanoi Capital Military Procuracy approving the Decision to prosecute Ms. Nguyen Thi Thanh Xuan, Head of the Department of Infectious Diseases, Bac Thang Long Hospital”. Ms. Nguyen Thi Thanh Xuan was prosecuted for the crime of: “Forgery of documents of organizations”.
It is noteworthy that all 4 officers and employees were prosecuted after February 23, 2024. This is also the time when the hospital director issued a Notice on the assignment of tasks to members of the Board of Directors of Bac Thang Long Hospital. The Notice shows: “The hospital director is the head of the hospital responsible to the Hanoi People's Committee, the Hanoi Department of Health and before the law for all activities of the hospital; Presides over the organization, implementation and inspection of the implementation of the Party's guidelines and policies and the State's laws and policies; In charge of the following areas: General responsibility for the entire hospital; Anti-corruption work...”.
Analyzing the above incident, from a legal perspective, Lawyer Nguyen Phuong Tuyen, Hanoi Bar Association, said that although the hospital had developed a plan to prevent and combat corruption and negativity, the fact that 4 officers and employees were prosecuted in one year showed that the hospital's leaders and related deputies had not yet strictly controlled the hospital's officers and employees.
“To clarify the responsibilities of the head and deputy head in the work of preventing and fighting corruption, it is necessary to have the inspection and examination of the hospital’s superior agency, the Hanoi Department of Health and the Hanoi People’s Committee. Clarifying the responsibilities of the hospital head when a subordinate is prosecuted will strengthen the trust in the fight against corruption that the Party and State are currently vigorously carrying out,” said Lawyer Tuyen.
At the national online conference to review 5 years of implementing the Law on Anti-Corruption on December 24, 2024, Deputy Inspector General of the Government Le Tien Dat stated that in the period of 2020-2024, 264 heads and deputy heads were disciplined for lack of responsibility for corruption; 73 people were criminally prosecuted for lack of responsibility for corruption.
