On the morning of March 10, the National Assembly Standing Committee gave opinions on the draft Law on Railways (amended).

According to the submission, the draft Law supplements regulations to maximize the mobilization of local resources and other economic sectors to participate in investing in the construction of railway infrastructure. In particular, there are regulations on encouraging all organizations and individuals to participate in investing in the development of railway infrastructure through the form of contracts.

The draft also adds regulations allowing localities to use their budgets to participate in compensation, resettlement support, and investment in the construction of some items of the national railway infrastructure.

Regarding the management and exploitation of railway infrastructure, the draft amends and supplements regulations on the classification of Vietnam's railway system, including national railways, local railways and specialized railways. This regulation aims to address the practical needs of localities such as Binh Duong, Tay Ninh, Thanh Hoa... that have a need to invest in conventional railways (not urban railways).

Commenting on the draft Law, Chairman of the Delegation Work Committee Nguyen Thanh Hai expressed concerns about prohibited acts such as encroachment on railway traffic corridors and railway construction protection areas.

Ms. Hai raised the question, this is a regulation for new projects, but what about existing projects. She cited the example of the coffee street along the railway, which is only about 1km from the National Assembly, but is very busy with business, services and tourism, or along Giai Phong Street, where houses are close to the railway.

Ms. Hai said that a huge amount of money would be needed to relocate households out of the railway corridor. Because if this law comes into effect, many houses, roads, and spontaneous openings, especially tourist business areas and famous check-in points in Hanoi, will be in violation.

National Assembly Chairman Tran Thanh Man said that the revised Railway Law should remove provisions that are not under the authority of the National Assembly but under the authority of the Government and the Ministry of Construction.

He cited examples of regulations on railway staff directly serving train operations; regulations on train driving licenses; fees and prices for using railway infrastructure. He suggested carefully reviewing relevant laws to ensure strict regulations.

The National Assembly Chairman raised the issue of why Vietnam's railway sector has been developing slowly despite the 2017 Railway Law having been in effect for 7 years. According to him, the reason for this is due to lack of proper attention, lack of investment funding, or only attention being paid to roads and aviation while railways and waterways have not received much attention.

According to the National Assembly Chairman, there are only a few months left until the 50th anniversary of National Reunification Day, but the reunification train remains unchanged, with only a change in equipment but the speed remains the same as 50 years ago.

In Hanoi, there is the 12km Cat Linh - Ha Dong elevated railway that took more than 10 years to build, and in Ho Chi Minh City, there is the 20km metro line No. 1 that was just inaugurated. The National Assembly Chairman said that these projects are very slow, the National Assembly has approved them many times, "is it because the thinking, vision, and investment are not enough, so they are patching things up?"

Therefore, the National Assembly Chairman believes that it is necessary to study and amend the law to make it concise and effective, to make a breakthrough and develop the country.

"The issue of developing high-speed railways and urban railways needs to be regulated in a separate chapter, with priority mechanisms on resources, technology and specialized human resource training, and learning from international experience," Mr. Man proposed.

In addition, according to the National Assembly Chairman, it is necessary to establish an inter-sectoral mechanism between the Central and local governments to resolve difficulties in project implementation. He reiterated the recent National Assembly decision on the Lao Cai - Hanoi - Hai Phong railway project, with a view to Hanoi - Lang Son...

Explaining later, Deputy Minister of Construction Nguyen Danh Huy said that the ministry had visited 6 countries with world-leading railway technology to consult and learn, especially China, and work with domestic enterprises.

Mr. Huy said that our country has mastered the technology from the bottom of sleepers, cables, long tunnels...; but the upper-level architecture from the rails up has not been mastered.

Construction enterprises have proactively entered into joint ventures and are ready to enter into joint ventures as long as there is a construction market. Currently, there are 7 domestic and foreign joint ventures preparing to participate in construction policy mechanisms, with the goal that by 2035, Vietnam can be completely self-sufficient in construction technology.

According to Deputy Minister Nguyen Danh Huy, the State needs to have a mechanism to ensure product output, with support policies such as land lease. Enterprises developing the railway industry also need a mechanism for the Government to place orders.

For example, in China, for each project to invest in developing locomotives and rolling stock, the country bought technology and spent 10 years continuously conducting R&D with an annual budget of 2 billion USD to have the railway industry as it is today.

Therefore, the Government needs to assign tasks and place orders to "leading" enterprises selected by the Government, ensuring the output market. Thus, enterprises will be ready to invest.
