Kinhtedothi - The People's Committee of Binh Phuoc province has just issued Decision No. 10/2025/QD-UBND, specifying the land area permitted to build works directly serving agricultural production.
The above decision will officially take effect from March 20, 2025, applying to agricultural land that has converted its crop and livestock structure, including rice-growing land.
The aim of the regulation is to facilitate agricultural production activities while ensuring that land management is carried out strictly and effectively.
According to regulations, construction on agricultural land must strictly follow the principles: ensure the correct purpose of use, not affect agricultural production capacity and must comply with construction regulations.
Specifically, the scale of construction works on agricultural land (excluding rice-growing land) is regulated as follows:
For land with an area from 200,000m² to under 300,000m²: maximum construction area is 300m².
For land with area from 300,000m² to 500,000m²: maximum construction area is 400m².
For land with an area of over 500,000m²: maximum construction area is 500m².
Particularly for rice-growing land, the area of construction directly serving agricultural production must not exceed 500m².
Construction works on agricultural land are only allowed to be built in a single location on the land, are not allowed to build basements and are only allowed to build a maximum of 1 floor. In addition, the construction site must be outside the safety corridor as prescribed by the 2024 Land Law.
The decision also emphasizes that construction must strictly comply with construction laws and related documents. Clearly defining the area and location of construction works not only helps limit the misuse of land but also ensures harmony between economic development and protection of agricultural land funds.
The People's Committee of Binh Phuoc province assigned the People's Committees of districts, towns and cities to direct the implementation, inspect and handle violations. These units will be responsible to the People's Committee of the province if there are violations in land management in the area.
The issuance of new regulations is expected to create more favorable conditions for people and businesses in agricultural production activities, while helping local authorities more closely control land use.
