Decree 34/2025 amending and supplementing a number of articles of the Decrees on the maritime sector, effective from April 10, adds many regulations on the management of sailboats, sport boats, and personal tourist boats.
Specifically, regarding the requirements for vessels operating in port waters and areas under the management of the Maritime Port Authority, the new regulation requires that only diving activities (diving for inspection, repair, and maintenance of vessels) may be carried out;
Diving to salvage ships, sunken property, repair activities, lowering lifeboats or underwater work related to maritime activities after being approved by the Maritime Port Authority.
Sailing vessels and private tourist boats operating in port must always maintain at least one crew member to dispatch or handle emergencies.
For diving activities to clean the lower part of sailing boats, sport boats, and private tourist boats when anchored at ports or wharves reserved for sailing boats, sport boats, and private tourist boats, approval from the Maritime Port Authority is not required.
Regarding the on-duty activities when ships operate at ports, the Decree requires that when anchored in seaport waters, at least 2/3 of the ship's crew must always be maintained on board with appropriate titles. Of which, there must be a captain or chief mate and a chief engineer or second engineer to maneuver the ship or handle emergencies.
For sailing boats, sport boats, and private tourist boats, at least one crew member must always be maintained to dispatch or handle emergencies. In cases where the port or wharf owner arranges personnel to keep watch, be ready to dispatch, and ensure safety, there is no need to arrange a watch.
The new Decree also has requirements for vessels operating in port waters and areas under the management of the Maritime Port Authority.
Accordingly, ships entering and leaving the maritime area in a seaport must carry out procedures as ships entering and leaving the seaport, except for sailing ships, sports ships, and private tourist ships.
However, sailing vessels, sport vessels, and individual tourist vessels operating in port waters must notify the Maritime Port Authority in writing, by fax or email of their vessel operation plan for monitoring.
