According to Clause 3, Article 53 of the 2008 Road Traffic Law, vehicles wishing to participate in traffic on the road must be registered and have license plates issued by a competent State agency.
In case a vehicle is on the road without registration and license plate, it may be subject to administrative penalties. Specifically, Decree 100/2019/ND-CP (amended and supplemented by Decree 123/2021/ND-CP) stipulates:
- Car drivers will be fined 2-3 million VND if they commit one of the following violations: driving a vehicle without a vehicle registration certificate as prescribed or using an expired vehicle registration certificate (including trailers and semi-trailers); driving a vehicle (including trailers and semi-trailers) without a license plate (for vehicles that are required to have a license plate)... In addition, the driver will also have his/her driver's license revoked for 1-3 months.
-For motorbikes and scooters (including electric motorbikes), the fine is from 800,000 to 1 million VND.
Meanwhile, according to Circular No. 24/2023/TT-BCA of the Ministry of Public Security "Regulations on granting and revoking registration and license plates of motor vehicles" issued on July 1, 2023, effective from August 15, 2023, Clause 1, Article 19 stipulates: "Newly purchased vehicles after temporary registration are only allowed to be moved from the port warehouse, factory, or vehicle dealer to the place of vehicle registration or to other dealers or storage warehouses".
According to Clause 1, Article 22 of this Circular, newly purchased vehicles are granted a temporary vehicle registration certificate valid for 15 days and can be renewed once for a maximum period of 15 days. However, temporarily registered vehicles are only allowed to participate in traffic according to the period, route and scope of operation stated in the temporary vehicle registration certificate.
Notably, when a vehicle has not been officially licensed but the driver freely travels outside the route and operating range stated in the temporary vehicle registration, the following fines will be imposed:
- For motorbikes: Fine from 800,000 VND to 2 million VND for individuals; from 1.6 to 04 VND for organizations (according to point g, clause 5, Article 30, Decree 100/2019/ND-CP, amended by Decree 123/2021/ND-CP).
-For cars: Fine from 14 to 16 million VND for individuals; from 28 to 32 million VND for organizations (according to Clause 10, Article 30 of Decree 100/2019/ND-CP, amended by Decree 123/2021/ND-CP).
According to Circular No. 24/2023/TT-BCA, new car buyers can now easily carry out temporary vehicle registration procedures on the National Public Service Portal or the Ministry of Public Security Public Service Portal.
The time limit for processing this procedure is 8 working hours from the time the Public Service Portal receives a complete and valid application (based on Clause 5, Article 7 of Circular 24/2023/TT-BCA). The temporary vehicle registration fee is determined to be VND 50,000/time/vehicle.
People will receive the results online, then just print the temporary registration certificate and temporary license plate to use when traveling.
Thus, to be able to circulate during the unregistered period, vehicle owners can carry out temporary vehicle registration procedures by registering on the National Public Service Portal.
