The Long Eyes project truth
Recently, people reported to Nguoi Dua Tin about the situation of selling land products of The Long Eyes project in Song Thao commune (Trang Bom district, Dong Nai province) with many signs of ambiguity and false advertising.
According to Mr. Dinh Van Thang (living in Bien Hoa city), "I have saved some capital and want to invest in real estate to make a profit. Looking at the electronic information pages, I found The Long Eyes project in Song Thao commune, Trang Bom district, invested by Asian Holding Real Estate Joint Stock Company.
After that, I contacted a person named TP who introduced himself as a real estate sales staff of The Long Eyes project, which was selling land. Here, this person introduced me to a lot of information related to the project's utilities and legality.
Next, I went directly to the above land project and was surprised to see the actual site, much different from the extremely grand introduction of the staff named TP.
Seeing many unusual things, I kept asking the TP staff about information about this project, but received the answer that there was no The Long Eyes project. I hope the authorities will soon intervene to take measures to avoid many people like me being deceived by this virtual project."
According to information found by PV, recently, on electronic information pages, land products of the project named The Long Eyes in Song Thao commune, belonging to Asian Holding Real Estate Joint Stock Company, represented by Nguyen Van Hau, with headquarters address at Trung Son Residential Area (Binh Chanh District, Ho Chi Minh City) as the investor, are being advertised for sale.
According to information from electronic information sites, The Long Eyes project has 98 land products, with areas ranging from 80 - 120m2 , selling prices range from about 960 million VND for a land product.
The project is located on the frontage of Song Thao - Bau Ham street (Trang Bom district), occupying a prime location, bustling and bustling. Owning the Dragon Eye location associated with the image of Carp overcoming Vu Long Mon, along with the land of Dragon coiled Tiger sitting, is the inspiration to create The Long Eyes. A place that gathers the most quintessential values in feng shui, attracting prosperity to bring prosperity to the owner.
The project has been approved for planning with standard infrastructure, spacious internal roads. Large green areas, campus, sidewalks… bring a comfortable and pleasant living environment for future residents.
Posing as a person who wants to buy land for investment, the reporter contacted phone number 09x6.755.xxx, a real estate agent who is selling The Long Eyes project. Here, the reporter was introduced to the land products and procedures related to the legality, infrastructure and other utilities of the above project by this person.
This employee also committed to 100% profit for the investor. This person also added that we have sold almost all of this land product, only a few lots left, so if you (PV) buy, you will get priority discount.
To verify the above information, the reporter went to Song Thao commune (Trang Bom district) and found the place that was said to be selling land in The Long Eyes project.
Here, the reporter noted that at the location believed to be The Long Eyes project, there was no information about the project name when observing the surroundings. In this land, there is only one asphalt road about 5m wide and 200m long leading inside.
Along both sides of the road, there are boundary markers that have been divided into lots, each lot has an area of over 80 square meters. The drainage is roughly covered with pieces of wood, some sidewalk areas have degraded and damaged.
Revealing the truth
To have objective information, Nguoi Dua Tin reporters contacted and scheduled a meeting with the People's Committee of Song Thao commune to verify the above project.
On January 29, Song Thao Commune People's Committee issued Official Dispatch No. 12/UBND-DC on providing information about The Long Eyes project.
Accordingly, through reviewing and comparing the information reported by the reporter, the area advertised as The Long Eyes project is invested by Asian Holding Real Estate Joint Stock Company, headquartered in Trung Son Residential Area (Binh Chanh District, Ho Chi Minh City).
This place is actually land of individuals who received the transfer. Then, they set up procedures to change the land use purpose from agricultural land to residential land for housing and transfer and donate the land use rights. There is absolutely no project named The Long Eyes as introduced by electronic information sites and real estate agents.
Regarding traffic items, on June 28, 2013, Dong Nai Department of Natural Resources and Environment signed approval for land plot No. 138, map sheet No. 45, Song Thao commune, which is public traffic land managed by the Commune People's Committee.
On March 3, 2023, households with land in this area submitted a petition to the People's Committee of Song Thao commune, requesting to use their own funds to build a hot asphalt concrete road according to the existing road area and the households agreed to donate an additional 1m of land depth to make a sidewalk.
However, the commune government is in the process of reviewing the content of the petition of the households, to ask for instructions from the competent authorities, but these households have arbitrarily built roads and poured asphalt without the consent of the authorities.
Currently, the road built by the households has not been accepted and put into management and use by the People's Committee of Song Thao commune.
Through the above reflection, we request that the competent authorities intervene to clarify and strictly handle whether there is any act of deceiving customers by creating a "virtual" project with false information of Asian Holding Joint Stock Company to sell to customers.
There should be specific measures to warn customers and to consider carefully before trading and buying real estate in any form to avoid unfortunate incidents.
According to the provisions of Clauses 1, 2, 3, 4, Article 8 of the Law on Real Estate Business 2014, which stipulate prohibited acts in real estate business, The Long Eyes project by Asian Holding Real Estate Joint Stock Company has signs of providing false information about land products in Song Thao commune, which is a violation of regulations on real estate business.
Depending on the nature and severity of the act of enticing customers, deceiving, or providing false information to customers, the investor may be subject to administrative sanctions or criminal prosecution.
Depending on the specific behavior, if the violator provides incomplete or inaccurate information about the real estate he/she brokers, he/she will be administratively sanctioned with a fine of up to VND 50,000,000 according to the provisions of Point B, Clause 3, Article 58 of Decree 139/2017/ND-CP dated November 27, 2017 of the Government.
