The truth about The Long Eyes project
Recently, residents have reported to Nguoi Dua Tin (The Informer) about the sale of land plots in The Long Eyes project in Song Thao commune (Trang Bom district, Dong Nai province), raising suspicions of ambiguity and false advertising.
According to Mr. Dinh Van Thang (residing in Bien Hoa City): “I have saved some capital and want to invest in real estate to make a profit. After researching on various websites, I found the The Long Eyes project in Song Thao commune, Trang Bom district, developed by Asian Holding Real Estate Joint Stock Company.”
After that, I contacted someone named TP who introduced himself as a real estate sales agent for The Long Eyes project, selling land plots. There, he provided me with a lot of information regarding the project's amenities and legal aspects.
Next, I went directly to the land project site and was surprised to see that the actual site was very different from the grandiose presentation given by the employee named TP.
Noticing several irregularities, I repeatedly asked the staff member named TP about information regarding this project, only to receive the answer that there is no such project as The Long Eyes. I hope that the authorities will soon investigate and take action to prevent many people like me from being deceived by this fictitious project."
According to information gathered by our reporter, recently, online platforms have been advertising land plots from the project called The Long Eyes in Song Thao commune, owned by Asian Holding Real Estate Joint Stock Company, represented by Nguyen Van Hau, with its headquarters located in Trung Son Residential Area (Binh Chanh district, Ho Chi Minh City).
According to information from online sources, The Long Eyes project has 98 land plots, ranging in size from 80 to 120 square meters , with prices around 960 million VND per plot.
Located on the main road of Song Thao – Bau Ham (Trang Bom district), the project occupies a prime, bustling location. Possessing a Dragon's Eye location, associated with the image of a carp leaping over the Dragon Gate, along with the auspicious land formation of a coiled dragon and a seated tiger, it serves as the inspiration for The Long Eyes. It brings together the finest values in feng shui, attracting auspicious energy and bringing prosperity to its owners.
The project has been approved with a master plan featuring standard infrastructure including spacious internal roads. Large areas of greenery, landscaped grounds, and sidewalks create a comfortable and pleasant living environment for future residents.
Posing as someone interested in buying land for investment, the reporter contacted the phone number 09x6.755.xxx, a real estate agent selling The Long Eyes project. There, the reporter was introduced to the land plots and the related legal procedures, infrastructure, and other amenities of the project.
This employee also guaranteed a 100% return on investment for the developer, adding that they had sold almost all of these land plots, with only a few remaining, so if the reporter bought one, they would receive a priority discount.
To verify the above information, our reporter went to Song Thao commune (Trang Bom district) and visited the location where land plots were allegedly being advertised for sale at The Long Eyes project.
Here, our reporter observed that at the location believed to be The Long Eyes project, there was no information about the project's name in the surrounding area. Within this plot of land, there is only a paved road, approximately 5 meters wide and 200 meters long, leading inside.
Along both sides of the road are boundary markers indicating the land plots, each plot measuring over 80 square meters. Drainage pipes are haphazardly covered with pieces of wood, and some sections of the sidewalks are dilapidated and damaged.
Unveiling the truth
To obtain objective information, a reporter from Nguoi Dua Tin contacted and scheduled a meeting with the People's Committee of Song Thao commune to verify the project.
On January 29th, the People's Committee of Song Thao Commune issued Official Document No. 12/UBND-DC regarding the provision of information on The Long Eyes project.
Accordingly, after reviewing and cross-referencing the information reported by the journalist, the area advertised as The Long Eyes project is being developed by Asian Holding Real Estate Joint Stock Company, headquartered in Trung Son Residential Area (Binh Chanh District, Ho Chi Minh City).
This land is actually privately owned. They then go through the process of converting the land use from agricultural to residential for housing construction and subsequently transfer or gift the land use rights. There is absolutely no project called The Long Eyes as advertised on various websites and by real estate agents.
Regarding road construction projects, on June 28, 2013, the Dong Nai Department of Natural Resources and Environment approved the land plot No. 138, map sheet No. 45, in Song Thao commune, as public transportation land managed by the commune People's Committee.
By March 3, 2023, households with land in this area had submitted a petition to the People's Committee of Song Thao commune, requesting to self-fund the construction of a hot asphalt concrete road according to the existing road's dimensions, and the households agreed to donate an additional 1 meter of land depth for the sidewalk.
However, while the commune authorities were in the process of reviewing the households' petitions and seeking guidance from higher authorities, these households arbitrarily constructed roads and paved them with asphalt without the approval of the relevant agencies.
Currently, the road, which was constructed by local residents without authorization, has not yet been inspected and approved by the Song Thao Commune People's Committee for management and use.
Based on the above information, we request that the competent authorities investigate and strictly handle whether Asian Holding Joint Stock Company has engaged in deceptive practices by creating a "fictitious" project with false information to sell to customers.
Specific measures are needed to warn customers and encourage them to carefully consider all aspects before engaging in any form of real estate transactions or land sales, in order to avoid unfortunate incidents.
According to Clauses 1, 2, 3, and 4 of Article 8 of the 2014 Law on Real Estate Business, which stipulates prohibited acts in real estate business, the Long Eyes project by Asian Holding Real Estate Joint Stock Company shows signs of providing false information about land plots in Song Thao commune, which is a violation of regulations on real estate business.
Depending on the nature and extent of the acts of soliciting, deceiving, or providing false information to customers, the investor may be subject to administrative penalties or criminal prosecution.
Depending on the specific offense, if a person who violates the law provides incomplete or inaccurate information about the real estate they are brokering, they will be subject to administrative penalties with fines up to VND 50,000,000 as stipulated in Point B, Clause 3, Article 58 of Government Decree 139/2017/ND-CP dated November 27, 2017.
