1. What date is the Duanwu Festival (May 5) in 2023?

2. Do I get a day off for the Duanwu Festival (May 5)?

According to the provisions of Clause 1, Article 112 of the 2019 Labor Code, employees are entitled to take time off work and receive full pay on the following holidays and Tet:

- New Year's Day: 01 day (January 1st);

- Lunar New Year: 05 days;

- Victory Day: 01 day (April 30th);

- International Labor Day: 01 day (May 1st);

- National Day: 02 days (September 2 and 01 day before or after);

- Hung King's Commemoration Day: 01 day (10th day of the 3rd lunar month).

In addition, according to Article 13 of the Law on Cadres and Civil Servants 2008 and Article 13 of the Law on Public Employees 2010, cadres, civil servants and public employees are entitled to annual leave, holidays and personal leave in accordance with the provisions of the law on labor.

Thus, on the Doan Ngo Festival (May 5), cadres, civil servants, public employees and workers are not allowed to take time off according to the above regulations.

3. Some other holidays of employees

3.1. Annual leave of employees

- Employees who have worked for 12 months for an employer are entitled to annual leave with full pay according to the labor contract as follows:

+ 14 working days for underage workers, disabled workers, workers in heavy, toxic, or dangerous jobs;

- In case of resignation or job loss without taking annual leave or not taking all annual leave days, the employer shall pay salary for the days not taken.

- Employers are responsible for regulating annual leave schedules after consulting with employees and must notify employees in advance.

Employees can negotiate with their employers to take annual leave in multiple installments or combine leave for up to 3 years at a time.

- When taking annual leave before the salary payment date, employees are entitled to an advance salary according to the provisions of Clause 3, Article 101 of the 2019 Labor Code.

- When taking annual leave, if the employee travels by road, rail or waterway and the number of days for round trip travel is more than 02 days, from the 03rd day onwards, the travel time will be calculated in addition to the annual leave and will only be counted for 01 leave per year.

- Annual leave increases according to seniority:

For every 5 years of working for an employer, the employee's annual leave is increased by 1 day.

3.2. Personal leave, unpaid leave

- Employees are entitled to take personal leave with full pay and must notify the employer in the following cases:

+ Marriage: 03 days off;

+ Biological or adopted children get married: 1 day off;

+ Biological father, biological mother, adoptive father, adoptive mother; biological father, biological mother, adoptive father, adoptive mother of wife or husband; wife or husband; biological child, adopted child dies: 03 days off.

- Employees are entitled to 01 day of unpaid leave and must notify the employer when their paternal or maternal grandfather, grandmother, brother, sister, or sibling dies; their father or mother gets married; or their brother or sister gets married.

- In addition, employees can negotiate with their employers to take unpaid leave.
