From March 1, many new regulations on the organization of the State apparatus will come into effect. The apparatus under the new organization will begin to perform its functions and tasks according to regulations.

The Law on Government Organization has new provisions on decentralization, delegation of power, and authorization.

The Law on Government Organization 2025 was passed by the National Assembly on February 18, 2025, at the 9th Extraordinary Session. The law has just been promulgated by President Luong Cuong and will take effect from March 1, 2025.

The Law on Government Organization 2025 has many new regulations on organizational structure, authority division, decentralization, delegation of authority, and authorization.

Including specific contents to clearly define the tasks and powers of the Government, Prime Minister, Ministers, Heads of ministerial-level agencies and the relationship between the Government and agencies exercising legislative power, agencies exercising judicial power; the relationship between the Government and local authorities.

The Law on Government Organization 2025 has clarified the duties, powers and authority of the Prime Minister; ministers, heads of ministerial-level agencies with two roles - head of ministry and member of the Government, in which the responsibility as a member of the Government is emphasized, responsible to the Government for state management of the assigned sectors and fields.

Ministers and heads of ministerial-level agencies must be personally responsible to the Prime Minister, the Government and the National Assembly for the sectors and fields they are assigned to manage; and must explain and answer questions from National Assembly deputies. According to the explanation of the agency in charge of drafting the law, clearly defining the responsibilities of Ministers and Heads of ministerial-level agencies will create conditions to enhance the responsibilities of ministers in the Government's Working Regulations, not pushing the responsibility of deciding specific issues in sectors and fields to the Prime Minister as is currently the case.

Also according to the introduction of the drafting agency, the Law on Organization of Local Government 2025 has clarified the relationship between the Government, the Prime Minister, Ministers, Heads of ministerial-level agencies and local governments through the principles of decentralization, decentralization, delegation, ensuring adherence to the motto: "Locals decide, localities do, localities take responsibility", creating a mechanism to promptly resolve difficulties and institutional problems, unlocking resources, contributing to improving the effectiveness and efficiency of State management from the central to local levels.

Decentralization, delegation of authority, authorization according to the Law on Organization of Local Government

The Law on Organization of Local Government 2025 was passed by the National Assembly on February 19, 2025, at the 9th Extraordinary Session. The law has just been signed by President Luong Cuong and will also take effect from March 1, 2025.

In line with the Law on Organization of the Government 2025, the Law on Organization of Local Government has many new regulations on organizational structure, decentralization, delegation of authority, and authorization, aiming to promote local initiative and creativity according to the motto "locality decides, locality does, locality is responsible"; "whichever level solves the problem more effectively, assign tasks and authority to that level".

The Law on Organization of Local Government 2025 adds a provision that “local governments shall proactively propose to competent authorities the decentralization and delegation of authority to competent agencies, organizations and individuals in the locality to perform tasks and powers in accordance with the capacity and practical conditions of the locality”. This provision is designed to encourage the spirit of initiative and creativity of localities.

According to the introduction of the drafting agency, implementing the principle of "clear people, clear work, clear responsibilities" and avoiding overlapping regulations and duplication of tasks and powers between local government levels and between local government agencies, the Law on Organization of Local Government 2025 specifically stipulates the tasks and powers of the People's Council and People's Committee in each administrative unit.

In particular, the Law on Organization of Local Government has defined the tasks and powers between local government levels and between the People's Council and the People's Committee at the same level; the collective People's Committee and the individual Chairman of the People's Committee where the local government level is organized, in the direction of increasing the tasks, authority and responsibility of the individual Chairman of the People's Committee.

The new Government apparatus has 17 ministries and ministerial-level agencies.

From March 1, 2025, the regulations on the new organization of the Government apparatus will take effect, according to the Resolution on the organizational structure of the Government for the 15th National Assembly term, approved by the National Assembly on February 18 at the 9th Extraordinary Session.

Accordingly, the organizational structure of the Government for the 15th National Assembly term includes 14 ministries and 3 ministerial-level agencies.

The 14 ministries include: Ministry of National Defense; Ministry of Public Security; Ministry of Foreign Affairs; Ministry of Home Affairs; Ministry of Justice; Ministry of Finance; Ministry of Industry and Trade; Ministry of Agriculture and Environment; Ministry of Construction; Ministry of Culture, Sports and Tourism; Ministry of Science and Technology; Ministry of Education and Training; Ministry of Health; Ministry of Ethnic Minorities and Religions.

3 ministerial-level agencies include: State Bank of Vietnam; Government Inspectorate; Government Office.

According to the Resolution on the structure of the number of Government members for the 15th National Assembly term, also passed by the National Assembly on February 18, the Government for the 15th National Assembly term consists of 25 members: Prime Minister, 7 Deputy Prime Ministers, 14 ministers and 3 heads of ministerial-level agencies.

Also on February 18, the National Assembly passed resolutions approving the Prime Minister's proposal to appoint deputy prime ministers and ministers for the 2021-2026 term.

Thus, the members of the Government for the 15th National Assembly term (2021-2026) include: Prime Minister Pham Minh Chinh, Permanent Deputy Prime Minister Nguyen Hoa Binh; Deputy Prime Ministers: Tran Hong Ha, Le Thanh Long, Ho Duc Phoc, Bui Thanh Son (also Minister of Foreign Affairs), Nguyen Chi Dung, Mai Van Chinh; General Phan Van Giang, Minister of National Defense; General Luong Tam Quang, Minister of Public Security; Minister of Home Affairs Pham Thi Thanh Tra; Minister of Justice Nguyen Hai Ninh; Minister of Finance Nguyen Van Thang; Minister of Industry and Trade Nguyen Hong Dien; Minister of Agriculture and Environment Do Duc Duy; Minister of Construction Tran Hong Minh; Minister of Culture, Sports and Tourism Nguyen Van Hung; Minister of Science and Technology Nguyen Manh Hung; Minister of Education and Training Nguyen Kim Son; Minister of Health Dao Hong Lan; Minister of Ethnic Minorities and Religions Dao Ngoc Dung; Governor of the State Bank of Vietnam Nguyen Thi Hong; Government Inspector General Doan Hong Phong; Minister, Head of the Government Office Tran Van Son.

Because Deputy Prime Minister Bui Thanh Son concurrently holds the position of Minister of Foreign Affairs, in reality, the number of Government members for the 2021-2026 term is 24 people.

The new regulations on the organizational structure and number of members of the Government are a drastic step of our Party and State in restructuring the State apparatus, aiming to implement the Party's policy on comprehensive innovation and reform, reorganizing the apparatus of the political system in the direction of "refined, compact, strong, effective and efficient operation", with the spirit of "the Central Committee is exemplary and takes the lead".

After the National Assembly passed resolutions regulating the organizational structure and number of members of the Government, many localities have resolutely implemented and completed the restructuring of the local government apparatus according to the direction from the Central Government.
