In October 2024, many new policies come into effect.

A series of policy relate to economic problem such as the periodic reporting regime on industrial clusters; Regulations on the exploitation of houses and land that are public assets not used for residence; New points of the Project management cost norms and construction investment consultancy will officially take effect from October 2024.
* Periodic reporting regime on industrial clusters
The Ministry of Industry and Trade issued Circular No. 14/2024/TT-BCT dated August 15, 2024 regulating the periodic reporting regime on industrial clusters, the national industrial cluster database, and a number of sample documents on the management and development of industrial clusters.
This Circular stipulates the periodic reporting regime on industrial clusters as prescribed in Decree No. 09/2019/ND-CP dated January 24, 2019 of the Government on the reporting regime of state administrative agencies; the national industrial cluster database and a number of sample documents on the management and development of industrial clusters as prescribed in Decree No. 32/2024/ND-CP dated March 15, 2024 of the Government on the management and development of industrial clusters.
The subjects of application are enterprises, cooperatives, organizations investing in the construction of technical infrastructure of industrial clusters; organizations and individuals engaged in production and business in industrial clusters; other agencies, organizations and individuals related to the management, investment and operation of industrial clusters.
According to the Circular, the subjects implementing the reporting regime are the Department of Industry and Trade of provinces and centrally-run cities (Department of Industry and Trade); District People's Committees; investors in the construction of technical infrastructure of industrial clusters; organizations and individuals investing in production and business in industrial clusters.
The closing time for 6-month (beginning of year) reporting data is calculated from December 15 of the year before the reporting period to June 14 of the reporting period.
The closing date for annual reporting data is calculated from December 15 of the year before the reporting period to December 14 of the reporting period.
Periodically, before June 20 and before December 20 every year, organizations and individuals investing in production and business in industrial parks must report on the operation of investment projects in industrial parks for 6 months and the whole year to the district-level statistical agency and at the same time to the district-level People's Committee.
Periodically before June 20 and before December 20 of each year, investors in the construction of technical infrastructure of industrial clusters shall report on the operation of the investment project in the construction of technical infrastructure of industrial clusters for 6 months and the whole year to the district-level statistical agency, and at the same time to the district-level People's Committee and the Department of Industry and Trade.
Periodically before June 25 and before December 25 every year, the District People's Committee reports on the situation of industrial clusters in the area for 6 months and the whole year to the Provincial People's Committee and the Department of Industry and Trade.
Periodically before June 30 and before December 31 of each year, the Department of Industry and Trade reports the situation of industrial clusters in the province for 6 months and the whole year to the Provincial People's Committee and the Ministry of Industry and Trade (local Department of Industry and Trade).
The Circular clearly states that periodic reports are presented in the form of paper documents or electronic documents, sent to the reporting agency by one of the following methods: directly, via postal service, via the national document exchange axis, email or other methods as prescribed by law.
In case the National Industrial Cluster Database has been built and operated, the Department of Industry and Trade shall send periodic reports to the Ministry of Industry and Trade (local Department of Industry and Trade) through updating data and sending reports to the National Industrial Cluster Database.
In addition, Circular No. 14/2024/TT-BCT also regulates the construction and operation of the National Industrial Cluster Database.
Accordingly, the local Department of Industry and Trade coordinates with the Department of E-commerce and Digital Economy and relevant agencies and units to organize the construction and operation of the National Industrial Cluster Database.
The Department of Industry and Trade is responsible for updating data on industrial clusters at the provincial level into the National Industrial Cluster Database according to regulations and instructions of the Ministry of Industry and Trade.
Circular No. 14/2024/TT-BCT also promulgates regulations on a number of document templates on management and development of industrial clusters in Appendix II, including: Document requesting to be the investor in building technical infrastructure of industrial clusters; Decision to establish/expand industrial clusters;
Decision to promulgate the Regulation on management of industrial clusters at the provincial level and the attached Regulation; Decision to promulgate the Regulation on management of public services and utilities in industrial clusters and the attached Regulation.
This Circular takes effect from October 1, 2024.

* Regulations on the exploitation of houses and land that are public assets not used for residence
On August 23, 2024, the Government issued Decree No. 108/2024/ND-CP regulating the management, use and exploitation of houses and land that are public assets not used for residential purposes and assigned to local organizations with the function of managing and trading houses for management and exploitation.
This Decree regulates the management, use and exploitation of houses and construction works attached to land which are public assets not used for residential purposes (hereinafter referred to as houses and land) assigned to organizations with the function of managing and trading local houses for management and exploitation for the purposes of: Renting houses (attached to land use rights); Temporary management while waiting for the handling of houses and land according to the provisions of law.
The Decree requires that the management, use and exploitation of houses and land must ensure efficiency, address the need for houses and land to serve the tasks of local economic and social development; be public, transparent and in accordance with the law.
The assignment of houses and land to organizations for management and business management and exploitation is carried out in the form of recording an increase in assets and the value of assets does not include the State capital component in the enterprise.
Organizations managing and trading houses; organizations and individuals renting houses; agencies, organizations and units that are arranged houses and land for temporary use must fully perform their responsibilities according to regulations.
The management, use and exploitation of houses and land must be monitored, inspected, checked and audited in accordance with the provisions of law; any violations of the law on the management, use and exploitation of houses and land must be promptly detected and strictly handled in accordance with the provisions of law.
According to regulations, the leasing of houses (associated with land use rights) by housing management and business organizations is carried out by auction, except for cases carried out by price listing method.
This Decree comes into force from October 15, 2024.
* New points of project management cost norms and construction investment consulting
The Ministry of Construction issued Circular 09/2024/TT-BXD dated August 30, 2024 amending and supplementing a number of construction norms in Circular 12/2021/TT-BXD dated August 31, 2021 of the Minister of Construction.
Circular 09/2024/TT-BXD amends and supplements a number of construction norms issued in Circular 12/2021/TT-BXD dated August 31, 2021 of the Minister of Construction, including: Construction cost estimates; Installation cost estimates for machinery and technological equipment; Repair and maintenance cost estimates for construction works; Construction material usage rates; Project management cost and construction investment consultancy rates.
In addition, Circular 09/2024/TT-BXD also clearly stipulates that the transition to applying the revised and supplemented construction norms issued in this Circular shall be implemented in accordance with the provisions of Clause 8, Article 44 of Decree 10/2021/ND-CP dated February 9, 2021 of the Government on management of construction investment costs.
This Circular takes effect from October 15, 2024.
