The Law on Teachers updates world trends, motivating teachers to develop

That is the opinion of Associate Professor, Dr. Tran Thanh Nam, Vice Principal of the University of Education, Vietnam National University, Hanoi, about the draft Law on Teachers.

The draft Law on Teachers will be presented to the National Assembly for its first comments at the 8th Session of the 15th National Assembly. From your perspective, what role does the Law on Teachers play in protecting the rights and enhancing the status of Vietnamese teachers?

I believe that the Law on Teachers has institutionalized the views of the Party and State on the position, role, importance, and professional characteristics of teachers in a unified legal framework, overcoming shortcomings in the implementation of the Law on Education, the Law on Civil Servants, and other relevant laws. Thereby, improving the feasibility, effectiveness, and efficiency in implementing policies on the development of teachers, ensuring the autonomy of educational institutions in developing teachers, not discriminating between teachers in public, private, and at the same time, creating a mechanism to promote the motivation and capacity of teachers.

The Law on Teachers is also expected to build a framework to protect and develop the special labor of teachers in the context of digital transformation, AI application and international integration. On the one hand, it standardizes the teaching staff to ensure the quality of national education, on the other hand, it attracts foreign teachers to contribute to Vietnamese education, contributing to raising our country's education to be on par with that of developed countries.

So how do you evaluate the completion of the draft Law on Teachers compared to reality and new requirements of society?

I see that the latest draft of the Law on Teachers has clarified the identity of teachers (including teachers in the public and non-public systems, and foreigners), thereby proposing synchronous and focused regimes and policies; re-establishing the mission and role of teachers; clearly and fully regulating the rights and obligations of teachers.

The Law on Teachers has established and promoted the professionalism of the teaching profession, created motivation and fair opportunities for all teachers to continuously develop their careers; and served as a unified basis for educational institutions to recruit and evaluate teachers according to job positions.

The law also provides mechanisms to facilitate international cooperation on teachers. Implement reasonable decentralization among management agencies in recruiting and effectively managing teaching human resources to ensure both the quality of education and the dignity of the teaching profession.

At the same time, the Law also completes the legal framework for training, fostering and responsibilities of relevant parties, aiming to build a team of teachers with sufficient quantity, improve quality, and ensure equality between teachers at public and private educational institutions to meet the context of the 4.0 Industrial Revolution.

One of the issues of concern is the treatment of teachers. What adjustments are needed to attract and retain talent in the education sector, in your opinion?

It must be admitted that although the industry has made many efforts, the current policies and regimes for teachers such as salaries, allowances, benefits, incentives, social recognition of teachers, etc. are not really commensurate with the mission, position, and role of teachers.

Teachers' lives are still difficult, they cannot make a living from their profession. Salaries are not really the main source of income to ensure their lives and living, especially for young teachers and preschool teachers. Teachers have not received the attention and protection they deserve from society, so there are still many sad incidents about the way they behave from society, from parents, and students. This leads to a situation where teachers are not confident in their work, a large number have quit their jobs, changed jobs, especially young teachers; it is difficult to attract talented people to the teaching profession.

Therefore, this Law has paid great attention to the life and working conditions of teachers through proposals such as salaries according to the teacher salary scale being ranked highest in the administrative career salary scale system; Seniority allowance; The highest vocational preferential allowance in the industries and fields entitled to vocational preferential allowance; Other allowances according to the provisions of law.

Or teachers working in specific sectors and fields are entitled to the prescribed regime and are only entitled to the highest level if that policy coincides with the policy for teachers. The State has policies to support young teachers; working in difficult areas; teaching in specialized schools, teaching children with disabilities, teaching ethnic minority languages, teaching Vietnamese to ethnic minority students, teaching gifted subjects and arts.

Teachers' support policies include housing, allowances, subsidies, training and fostering policies, periodic health care, occupational health and other policies to ensure social security for teachers. In addition, policies to attract talented people to become teachers or policies to attract teachers to work long-term in ethnic minority and mountainous areas, especially disadvantaged communes in coastal areas, communes with especially difficult socio-economic conditions, island communes, islands, border communes, and safe zone communes according to Government regulations (including policies such as priority recruitment, housing loans, allowances and subsidies to attract, training and fostering policies and other policies for teachers).

In addition, each locality and educational institution is encouraged to have specific policies to support and attract teachers. Regulations on funds to encourage and develop teaching staff from socialized sources...

Surely the positive impact of the Teachers Law is not small?

It can be said that the draft Law on Teachers reflects the consistent policy of the Party and the State, updating world trends to meet the specific regulations for the teaching profession. As mentioned above, the adjustments related to training and fostering have created conditions for both public and private teachers to ensure conditions to improve their professional and technical capacity. Training and fostering have become a self-motivating force for teachers.

In addition, the professional status is not only limited to the domestic level but also raised to an international level, so that teachers are ready to participate in the labor market of countries in the region and internationally. At the same time, mobilizing international human resources for development. Regulations on financial support responsibilities also help educational institutions attract good candidates, passionate about the profession to choose to study at teacher training colleges to supplement teacher resources, avoiding the crisis of human resource shortage.

If teachers are considered as professional human resources in the teaching profession, they need to be trained, nurtured, recruited, used, rewarded and honored according to a strategic plan. From there, ensure the connection between the quantity, capacity, motivation and structure of the teaching staff with the goals and development requirements of education.

Minister of Education and Training Nguyen Kim Son, first emphasized that the education sector will be proactive in recruiting, using, and developing the teaching staff because there are strong enough legal sanctions to remove bottlenecks in recruiting and using teachers in the past, attracting talented people to the teaching profession, and retaining talented teachers in the profession. From there, improve the quality of the education system on the basis of standardizing and improving the quality of the teaching staff.

Along with that, teachers will be elevated in status and role, recognized, honored and protected by society in professional activities; expand opportunities for professional development; create conditions and prescribe responsibilities for teachers in cultivating moral qualities, always striving in studying, training, constantly updating professional knowledge and skills, innovating and creating, meeting the requirements of continuous development of education; contribute to improving life, helping teachers feel secure in their work and creating motivation for teachers to be dedicated to their profession, with the highest responsibility for their profession.

Create equality in development opportunities between public and non-public teachers. For the first time, the legal status of non-public teachers is established - not only as employees under the labor contract mechanism but also with full qualifications of teachers.
