On January 7, at the Government Headquarters, Prime Minister Pham Minh Chinh chaired the Government's special meeting on law-making in January 2025, discussing 7 draft laws and resolutions to be submitted to the National Assembly at the upcoming session in February.

Also attending were members of the Politburo, members of the Party Central Committee, Deputy Prime Ministers, members of the Government, leaders of ministries, branches and agencies under the Government.

According to the meeting agenda, the Government reviewed and gave opinions on: Draft Law on Government Organization (amended); Draft Law on Organization of Local Government (amended); Draft Resolution of the National Assembly on the establishment of a number of Ministries of the 15th Government, term 2021-2026; Draft Resolution of the National Assembly on the structure of the number of Government members for the 16th National Assembly; Draft Resolution of the National Assembly addressing issues arising in legal provisions related to the arrangement of the apparatus; Draft Law on Promulgation of Legal Documents (amended); Draft Law on Participation in United Nations Peacekeeping Forces.

Speaking at the opening of the meeting, Prime Minister Pham Minh Chinh emphasized that this is the first specialized law-making meeting of 2025 to continue implementing the Party's major policy of identifying institutional building and improvement as one of the three strategic breakthroughs, a "breakthrough of breakthroughs", institutions are resources and driving forces for development, but the current institutions are also "bottlenecks of bottlenecks".

The spirit is "open policies, smooth infrastructure, smart management" to unleash all social resources for investment and development, bringing the country to a new era of rich, civilized and prosperous development.

The Prime Minister stated that the 7 draft laws and resolutions discussed at the meeting are very important in relation to the issue of organization and apparatus, promptly institutionalizing the Party's policies and guidelines on innovation of the organization and operation of the Government and local authorities to ensure "Refined - Compact - Strong - Effective - Effective - Efficient".

With a strong spirit of innovation, working from top to bottom and bottom to top, "The central government sets an example, the local government responds", "running and lining up at the same time", not allowing work to be interrupted, the new organizational model must be better, more effective, and people will enjoy more of this achievement.

The Prime Minister stated that this is a difficult task with many complicated contents, so it must be carried out with great focus and urgency from now until the Central Conference and the National Assembly session to resolve problems related to the organization and operation of the apparatus.

The Prime Minister requested ministers and heads of sectors to continue to directly direct the work of institution building; innovate thinking in building laws related to the organization of the apparatus with a realistic spirit, enhance the responsibility of implementation at all levels, avoid cumbersome procedures, resolutely cut all unnecessary procedures, both manage in an open manner and unblock resources, strengthen decentralization, delegation of authority, and authorization, along with resource allocation, improve implementation capacity and strengthen inspection, supervision, and control of power.

The Prime Minister emphasized that authority goes hand in hand with responsibility; whoever is assigned to decentralize, delegate, or authorize must decide, and when deciding, must take responsibility; all levels of decentralization, delegation, or authorization are responsible before the Government and the law for the implementation of the decentralized, delegated, or authorized authority.

The Prime Minister also said that the powers of the Government and local authorities need to be concentrated in the Law on Government Organization and the Law on Local Government Organization, not scattered, fragmented, or dispersed in specialized laws.

Along with that, abandon the mindset of "if you can't manage, ban it; if you don't know, manage it"; thoroughly grasp the mindset of whoever does it best, hand it over to that person; people and businesses can do it, or can do it better, hand it over to them; what is banned, put it into law, what is not banned, let people and businesses be allowed to do and have space for creativity and innovation.

The Prime Minister noted that decentralization and delegation of power go hand in hand with streamlining the apparatus, streamlining staff, promoting digital transformation, building digital data, and applying artificial intelligence (AI) in the work of agencies, units, and localities.

The Prime Minister requested the need to institutionalize the contents stated in Resolution 27 of the Central Committee on continuing to build and perfect the socialist rule-of-law state in the new period; promptly resolve arising issues, sudden and unexpected problems; and handle contradictory, overlapping and inappropriate regulations.

The Prime Minister said that the current situation is changing very quickly, so the thinking of making laws must be quick, timely, and put into practice, not prolonged or cumbersome, not losing opportunities, trust, and resources; making laws must be easy to understand, easy to remember, easy to implement, easy to check, and easy to monitor.

What is mature, clear, proven to be correct in practice, effectively implemented, and agreed by the majority, is legalized; what is still fluctuating, we design to have room for adjustment according to practical requirements. There are contents that need to be regulated within a framework, on that basis, operating within the regulated framework.

Along with that, the Prime Minister requested to ensure a full, solid, long-term, and stable legal corridor for the deployment of forces to participate in UN peacekeeping; strengthen political consensus and social support to contribute to the noble mission of the United Nations to maintain world peace.

"This institutionalizes our Party's policy that Vietnam is a responsible member of the international community for the goals of peace, cooperation and development," the Prime Minister emphasized.

The Prime Minister requested that members of the Government focus their intelligence, research, speak briefly and concisely, go straight to the core issues, focus on discussing issues with different opinions, issues that can still fluctuate and change, especially those that are stuck, ensuring the progress and quality of the meeting.

On this occasion, the Prime Minister highly appreciated the Ministry of Home Affairs for "working day and night" on very difficult and complicated tasks related to streamlining and reorganizing the apparatus, especially submitting to the Government for promulgation 3 Decrees 177, 178 and 179 on regimes and policies for cadres, civil servants, public employees and workers in implementing the reorganization of the apparatus and policies to attract and promote talented people, basically creating consensus in society and among cadres, civil servants and public employees.

We have also basically completed the plan to merge and consolidate ministries and agencies and the plan to rearrange the internal organization and apparatus of ministries and agencies in accordance with the direction of the Central Steering Committee and the Government to submit to competent authorities.

The Prime Minister stated that we need to continue listening to valid opinions, reflecting the correct procedures and regulations on what is unreasonable; continue reviewing the contents of mechanisms and policies that have not been fully covered or are still missing.

Along with that, the Prime Minister requested ministers, heads of sectors and the Ministry of Home Affairs to continue to complete plans to continue to arrange and streamline the internal apparatus, functions, tasks and powers of ministries, sectors and agencies to report to competent authorities.

Some ministries and sectors whose streamlining plans have not yet achieved their set goals need to be reviewed to achieve the goals, ensuring substance, and doing what is allowed immediately, without backlog or prolongation, except for ministries and sectors that require the opinions of the Central Government and the National Assembly.

The Prime Minister emphasized that on issues where there are still different opinions, we should continue to listen and discuss to create a high consensus, first of all within the Government, and encourage discussion to find the best solution.

In discussion, democracy must be promoted. Once a decision has been made and an agreement has been reached, it must be implemented according to the principle of democratic centralism, the minority must obey the majority, the subordinate must obey the superior, the individual must obey the collective, in accordance with the Party's leadership principles.
