(NLDO) - Deputy Prime Minister Tran Hong Ha requested to ensure feasibility when piloting commercial housing projects through receiving land use rights.
On the afternoon of February 18, Deputy Prime Minister Tran Hong Ha chaired a direct meeting, combined with online meetings with a number of ministries, branches and localities to give opinions on the Draft Decree detailing the implementation of the National Assembly's Resolution on piloting the implementation of commercial housing projects (pilot projects) through agreements on receiving land use rights or having land use rights.

According to the report of the Ministry of Natural Resources and Environment, the Draft Decree consists of 3 chapters and 8 articles, applicable to: State agencies; real estate business organizations according to the provisions of the law on real estate business, land users according to the provisions of the Land Law.
Accordingly, real estate business organizations that meet the conditions for implementing the pilot project are allowed to receive land use rights transfer and change land use purposes for one, some or the following types of land to implement the pilot project: Agricultural land, non-agricultural land that is not residential land, residential land and other land in the same land plot in case of agreement on receiving land use rights.
From there, expanding the conditions for real estate business organizations to receive the transfer of land use rights to implement commercial housing projects, contributing to limiting complaints from people; ensuring fairness in land access among investors and localities, maintaining a stable supply of commercial housing, contributing to the development of a transparent and healthy real estate market.
The Deputy Prime Minister requested that ministries, branches and localities contribute specific opinions to clearly define the scope, objects and scale of the pilot project; the feasibility and preparation work of localities after the Decree is issued.
Leaders of some ministries, sectors, localities, and real estate associations proposed to supplement regulations on handling transitional issues for pilot projects that have been approved for investment policies, determine financial obligations, extend implementation time, etc.; clarify procedures for real estate enterprises that have land use rights, are receiving land use rights, or both; procedures, time for handling and focal agencies for receiving proposals, making a list of pilot projects; principles for prioritizing pilot projects; editing technical documents, etc.
Concluding the meeting, Deputy Prime Minister Tran Hong Ha stated that the National Assembly Resolution clearly stipulates the space, scope, scale, and implementation time of the pilot project, along with specific mechanisms and policies.
Therefore, the Decree needs to specify the order, procedures, and organize scientific and clear implementation steps when implementing the pilot project.
The drafting agency continues to clarify regulations on land use rights with annual and one-time rental payments when implementing commercial housing projects; procedures for real estate enterprises in each type of pilot commercial housing project (having land use rights, receiving land use rights, or not having land use rights, etc.); develop criteria and principles for determining priority pilot projects (urban beautification, detailed planning, subject to relocation, relocation, etc.)
The Deputy Prime Minister requested the drafting agency to fully absorb comments from ministries, branches, localities, associations, and enterprises, and promptly complete the Draft Decree.
