The Investigation Police Agency of Thach Thanh District Police has just initiated a case, prosecuted the accused, and temporarily detained Mr. Le Dinh Cuong and his wife Nguyen Thi Thuy, both born in 1974, and their son Le Dinh Canh, born in 1996, in Thanh My Commune, Thach Thanh District, for resisting a person on official duty.
The subjects were detained at Thach Thanh District Police.
According to initial investigation documents, around September 2003, Mr. Le Dinh Cuong and his wife, Ms. Nguyen Thi Thuy, signed a contract with Thach Quang Farm (Thach Thanh) to receive 10,000 m2 of land for annual crop cultivation, with a contract term of 20 years.
Recently, the Thanh My Commune government and Thach Quang Farm have reviewed the land use of households and individuals who had previously signed contracts and received contracts and requested that households not build houses on agricultural land. However, Mr. Cuong and Ms. Thuy's family not only did not comply but also arbitrarily transported and gathered many iron bars, bricks, and machinery into the family's expired contracted land for the purpose of building a house.
Upon discovering the incident, the People's Committee of Thanh My commune conducted an inspection, made a record and requested Mr. Cuong and Ms. Thuy's household to move all materials and vehicles out of the agricultural land. The local government also requested the household not to build illegal structures on agricultural land.
Although the local authorities had drawn up a record and requested that no illegal construction be carried out on agricultural land, Mr. Cuong and Ms. Thuy's family did not comply and continued to violate the law.
On May 2, 2023, the People's Committee of Thanh My commune inspected and discovered that this household continued to build a house on agricultural land, so they drew up a record of administrative violations and requested Mr. Cuong and Ms. Thuy's household to immediately stop construction on agricultural land and move all machinery and materials out of the land plot. At the same time, dismantle all constructed structures and restore the original state.
On May 11, 2023, Chairman of Thanh My Commune People's Committee Ha Duc Tam signed Decision No. 26/QD-XPHC to administratively fine Mr. Le Dinh Cuong's household VND 3.5 million for land destruction, terrain deformation or land quality degradation. At the same time, Mr. Cuong was forced to dismantle the illegal construction and restore the land to its original state before the violation within 30 days from May 11. However, after the deadline to remedy the consequences and restore the original state, Mr. Cuong's household still did not comply.
Faced with this insolent behavior, on July 4, 2023, Chairman of Thanh My Commune People's Committee Ha Duc Tam signed Decision No. 33/QD-CCXP on compulsory enforcement of remedial measures according to Decision on administrative sanction No. 26/QD-XPHC against Mr. Le Dinh Cuong.
On July 7, 2023, the Thanh My Commune Enforcement Council, chaired by Mr. Ha Duc Tam, Chairman of the Commune People's Committee, was present at the house of Mr. Cuong and Ms. Thuy to implement Enforcement Decision No. 33/QD-CCXP. However, Mr. Cuong's family did not cooperate, but instead cursed, insulted, threatened with a knife, threw cow dung, and sprayed water at the authorities.
Thanh My Commune Police have made a record of the arrest of Le Dinh Cuong, Nguyen Thi Thuy and Le Dinh Canh for the act of resisting people on duty, and handed them over to the Investigation Police Agency of Thach Thanh District Police for further investigation and clarification.
