(NLDO) - Trang Nguyen Cultural Training Center in Binh Tan District, Ho Chi Minh City was required to return all primary school students it was teaching and strictly comply with the closure order.
Immediately after the Lao Dong Newspaper published the article "Many ways to circumvent the system to teach extra classes for primary school students in Ho Chi Minh City", the People's Committee of Binh Hung Hoa B Ward, Binh Tan District established a working group to conduct surprise inspections of tutoring centers and facilities in the area.
At the time of the inspection, the center was teaching Vietnamese to many primary school students.
On the morning of July 18, Ms. Phan Thi Minh, Vice Chairwoman of the People's Committee of Binh Hung Hoa B Ward, said that she had drawn up a record of violations against the Trang Nguyen Cultural Training Center (legal name is Trang Nguyen Cultural Education Company Limited), requesting the suspension of all tutoring activities for primary school students and strict compliance with the closure.
On the afternoon of February 17, the working group made a surprise inspection of the Trang Nguyen Cultural Training Center in Binh Hung Hoa B Ward. At the time of the inspection, 18 primary school students were studying on the ground floor. Most of the students were studying Vietnamese, with teachers guiding them, and some were practicing their writing.
The center’s representative, Ms. Nguyen Thi Dang, presented a business registration certificate and a fire prevention plan. However, although the center organized lunch for several students, it failed to present documents related to food safety, food origin, and sample storage as required.
The working group conducted a surprise inspection and discovered many violations at the Trang Nguyen Cultural Training Center.
At the time of the inspection, Ms. Dang said that the center's extra teaching was not against the law and did not violate Circular 29.
"I registered my business as a tutor, and the center's teaching staff does not work at any school. Therefore, I think I can still tutor elementary school students. In addition to teaching cultural subjects, my center also tutors gifted subjects," Ms. Dang explained.
Circular 29/2024/TT-BGDDT, dated December 30, 2024 of the Ministry of Education and Training, regulating extra teaching and learning, takes effect from February 14. The Circular clearly states that extra teaching will not be organized for primary school students, except for 3 cases including: training in arts, physical education and sports, and life skills training.
Ms. Phan Thi Minh, Vice Chairwoman of the People's Committee of Binh Hung Hoa B Ward, affirmed that teaching Vietnamese to primary school students is a violation of Circular 29.
The working group drew up a report and requested the center to return all primary school students it was teaching to their families, remove illegal advertising signs, strictly comply with the closure from the afternoon of February 17 until it is corrected, and comply with legal regulations.
"In November 2024, this center was proposed to be closed due to lack of license. To thoroughly overcome the violation, the Ward People's Committee assigned the local police and the neighborhood chief to regularly monitor and supervise the closure of this facility," Ms. Minh emphasized.
The working group disseminated Circular 29 so that the center could understand clearly.
In addition, the working group inspected and made a record of Nhan Tai Education Company Limited at 11 Street No. 6, Binh Hung Hoa B Ward, requesting the owner to remove illegal advertising signs.
Ms. Minh said that she will continue to thoroughly instruct the school boards and teachers in the area to strictly implement Circular 29 and the guidance documents of the Department of Education and Training; strengthen propaganda, receive feedback from 40 neighborhoods and people in the area. At the same time, continuously check and review the tutoring centers that are operating or have arisen and handle violations according to regulations.
Discussing this violation, lawyer Phan Van Tu, Nhat Binh Law Office (Ho Chi Minh City Bar Association), said that although the teacher participating in teaching at the center is not a teacher at the school, and registered to operate as a tutor, he still violated the provisions of Clause 1, Article 4 of Circular 29.
According to Point b, Clause 2, Article 6 of the 2019 Law on Education, general education includes: primary education, secondary education and high school education. Article 1 of Circular 29/2024/TT-BGDDT clearly states that extra teaching and learning activities for general education and continuing education are within the scope of this Circular. Therefore, tutors when performing extra teaching activities for primary school students in the above case must comply with Circular 29.
