Workshop to contribute ideas to complete the draft Law on Atomic Energy (amended)

On the afternoon of March 18, 2025, at the headquarters of the National Assembly Office, the Standing Committee of the Science, Technology and Environment Committee in coordination with the Vietnam Union of Science and Technology Associations (VUSTA) organized a workshop to contribute ideas to complete the Draft Law on Atomic Energy (amended).

Attending the workshop were: Deputy Minister of Science and Technology (MOST) Le Xuan Dinh; experts, scientists, and managers working in the field of atomic energy.

At the workshop, Deputy Director of the Department of Radiation and Nuclear Safety Nguyen Hoang Linh said that after more than 17 years of implementation, the 2008 Law on Atomic Energy has revealed shortcomings and limitations: Many provisions of the Law have not met the requirements of state management, are not compatible with a number of newly issued laws and have not met the requirements of internalization related to international treaties in the field of atomic energy of which Vietnam is a member, are not suitable with the new requirements and standards of the International Atomic Energy Agency (IAEA) on nuclear safety and security; there is an overlap in the management functions of a number of ministries and branches.

In addition, the Law also contains a number of provisions that are not feasible, do not meet or do not keep up with the development of nuclear science, technology, and radiation technology; regulations on safety, security, and nuclear inspection for nuclear power plants are still inadequate and incomplete. Therefore, the 2008 Law on Atomic Energy needs to be studied, amended, and supplemented.

Regarding the Draft Law on Atomic Energy (amended), Mr. Nguyen Hoang Linh also said that the Draft consists of 12 chapters and 73 articles, a reduction of 20 articles, equivalent to more than 20% of the number of articles compared to the 2008 Law on Atomic Energy.

The draft closely follows four policies that the Government has basically agreed upon in Resolution No. 240/NQ-CP dated December 17, 2024 at the Special Session on Lawmaking in November 2024, including: Promoting the development and socialization of atomic energy applications; ensuring radiation safety, nuclear safety and security, decentralization in state management; facilitating nuclear inspection activities; managing radioactive waste, spent radioactive sources and spent nuclear fuel; responding to radiation incidents, nuclear incidents; civil liability for nuclear damage.

At the workshop, delegates agreed on the need to amend the Law on Atomic Energy to overcome the shortcomings of the current Law and said that, along with the restart of the Ninh Thuan nuclear power plant project, amending the 2008 Law on Atomic Energy is necessary and urgent. At the same time, they focused on giving comments on the contents of the draft Law, such as: Scope of regulation; regulations on nuclear regulatory agencies; State policies in the field of atomic energy; regulations on appraisal of nuclear power plant designs; policies on training and development of human resources in the field of atomic energy, etc.

Vice Chairman of the Committee for Science, Technology and Environment Ta Dinh Thi suggested that the Ministry of Science and Technology take into account the opinions at the Workshop, and on that basis, complete the draft Law dossier, submit it to the Government and the National Assembly Standing Committee for comments. The Vietnam Union of Science and Technology Associations, experts and scientists will continue to accompany and coordinate with the drafting agency and the agency in charge of reviewing the draft Law during the review and completion process in the coming time./.
