The development of the Law on Digital Technology Industry contributes to making Vietnam a favorable environment to nurture and develop digital technology enterprises.
Inevitable trend
The Draft Law on Digital Technology Industry is being publicly solicited for comments from affected subjects by the Ministry of Science and Technology. The draft stipulates policies to support the development of the digital technology industry, including: Support for building and developing brands; developing foreign and domestic markets; incentives (tax, land, credit, finance, etc.); developing human resources and digital technology talents; incentives for digital technology zones; management and exploitation of digital data; promoting the smartening of industries through the application of digital technology; procedures for establishing and investing in digital technology zones, etc.
According to the draft of the Government's Submission by the Ministry of Science and Technology, the drafting of the Law on Digital Technology Industry aims to resolve existing problems and shortcomings in the implementation of regulations on information technology industry in the Law on Information Technology; propose breakthrough policies to promote development while limiting risks, if any, in digital technology industry activities.

In the inevitable trend of digital transformation, creating a legal corridor to develop the digital technology industry, shifting from assembly and processing to design and production of digital technology products and digital platforms to serve national digital transformation, digital government, digital economy, and digital society is necessary to ensure national digital sovereignty.
In terms of resources for digital industry development, Vietnam has the advantage of a large population (nearly 100 million people, ranking 15th in the world), which is a large market to nurture and develop Vietnamese digital technology enterprises. However, current laws have not yet provided for breakthrough measures to develop the domestic market for digital technology enterprises, especially small and medium-sized digital technology enterprises.
“In order for the digital technology industry to develop rapidly and sustainably, there needs to be a policy to promote businesses to develop domestically designed and manufactured digital technology products. However, current laws do not have regulations and policies to promote the development of domestically designed and manufactured digital technology products,” the draft content of the Government’s Submission on the Digital Technology Industry Law of the Ministry of Science and Technology stated.
Therefore, the development of the Law on Digital Technology Industry is extremely necessary to institutionalize the viewpoints, goals, and orientations for the development of the digital technology industry; overcome shortcomings and limitations as well as create a solid legal basis for implementing outstanding and breakthrough policy mechanisms.
At the same time, mobilize all resources to effectively develop the potential for the development of Vietnam's digital technology industry, contributing to promoting national digital transformation, developing the digital economy - digital society in Vietnam; striving to make Vietnam one of the countries with developed digital technology industry.

According to the Ministry of Science and Technology, the purpose of building the Law on Digital Technology Industry is to contribute to promoting the development of the digital technology industry to become an economic sector that contributes greatly to the country's economy, making Vietnam the most favorable environment to nurture and develop digital technology enterprises.
At the same time, develop the digital technology industry with a focus on Vietnamese digital technology enterprises, shifting from assembly and processing to innovation, design and production in Vietnam; contributing to building a digital government, a driving force for the development of the digital economy and digital society.

The development of the Law on Digital Technology Industry affirms the legal value of the digital technology industry; forms regulations and policies to promote the development of the digital technology industry; replaces the contents on information technology industry and information technology services in the Law on Information Technology with the contents of the Law on Digital Technology Industry.
Promote the smartening of industries by bringing digital technology into and converging industries and fields, changing working methods, bringing new values, and creating a revolution in smartening.
In terms of viewpoints, the development of the Law on Digital Technology Industry institutionalizes the Party's guidelines and policies and the State's policies on the development of the digital technology industry; overcomes current limitations and shortcomings; on the other hand, it is necessary to have specific regulations and create a clear legal corridor to promote the development of the digital technology industry.
The Law on Digital Technology Industry will be built on the basis of selectively inheriting the relevant provisions of the Law on Information Technology and documents guiding the implementation of the information technology industry, while amending and supplementing new contents on the basis of selectively referring to international laws and experiences to apply appropriately to Vietnam's practice to meet the development requirements of Industry 4.0 and the digital economy in particular.
The Law on Digital Technology Industry does not change the state management responsibilities of ministries and branches in the fields. When digital technology products and services are applied in the fields of which ministries and branches, the ministries and branches are responsible for managing them in accordance with that field.
