Support career conversion for ethnic minorities lacking production land

This is a regulation in Circular 55/2023/TT-BTC of the Ministry of Finance regulating the management, use and settlement of career funds from the state budget to implement national target programs for the 2021-2025 period.

The Circular clearly stipulates a number of regulations to implement the National Target Program on Socio-Economic Development in Ethnic Minorities and Mountainous Areas for the period 2021 - 2030, Phase I: from 2021 to 2025. In particular, regarding Project 1 to address the shortage of residential land, housing, production land, and domestic water, the Circular has regulations on supporting job conversion.

Accordingly, in case the local government cannot arrange land for production, households without land or lacking land for production will be supported 01 time for career conversion. Households that are eligible under the guidance of the Ethnic Committee will be considered and supported with a maximum of 10 million VND/household to purchase agricultural tools, machinery, provide agricultural production services, and convert to other fields of cultivation, animal husbandry, production, and business; the method of support implementation is according to the guidance of the Ethnic Committee; or receive vocational training support to change careers according to the provisions of Articles 7 and 8 of Circular No. 152/2016/TT-BTC dated October 17, 2016 of the Ministry of Finance regulating the management and use of funds to support elementary level training and training under 3 months, Clause 3, Article 1 of Circular No. 40/2019/TT-BTC dated June 28, 2019 of the Ministry of Finance amending and supplementing a number of articles of Circular No. 152/2016/TT-BTC.

Regarding decentralized domestic water support, the Circular stipulates that based on the list of households receiving decentralized domestic water support approved by competent authorities, households' registration of implementation methods; the assigned agency and budget estimate synthesizes the needs and classifies them according to each implementation method (households receive jars, tanks, cisterns, water containers, water supply devices; make their own water tanks; dig wells or create other water sources) and sends them to the district-level ethnic affairs agency to preside over, coordinate with the financial agency at the same level to synthesize, report to the district-level People's Committee to decide on the specific support level for each household, up to 3 million VND/household (each household is only supported once). In case of purchasing in-kind items to provide to households, the above expenditure norms include costs incurred when organizing contractor selection.

The allocation and payment for beneficiaries of the policy are implemented as follows: For households provided with jars, tanks, tanks, water containers, and water conduction equipment: Based on the registration list of households, the supply contract between the unit assigned by the competent authority and the unit supplying jars, tanks, tanks, water containers, and water conduction equipment; the actual quantity provided to households according to the handover minutes between the supplying unit and each household (with the signature of the household representative), the assigned agency and the budget estimate shall conduct inspections and withdraw the budget at the State Treasury to pay the units supplying jars, tanks, tanks, water containers, and water conduction equipment according to regulations;

For households that build their own water tanks, dig wells or create other water sources: Based on the support level according to regulations and the registration list of households, after having a record of acceptance of completed volume (with confirmation signatures of household representatives and at least one local socio-political organization), the agency assigned with the task and budget estimate will inspect and withdraw the budget estimate from the State Treasury to pay the households.

Regarding project 2 of planning, arranging, relocating and stabilizing residents in necessary places, the Circular stipulates policies to directly support households, including: Support for moving costs for households from their old residence to resettlement areas. Accordingly, the level of support for moving costs is calculated based on the actual project preparation, based on the actual distance and unit price of common vehicles in the locality.

In case of self-sufficient means of transport, self-travel by road: The support level is 0.2 liters of gasoline/km calculated according to the administrative distance and gasoline price at the time of performing the activity; In case of transporting many goods, equipment, and materials on the same vehicle, the maximum payment level shall not exceed the above prescribed level.

At the same time, support for households is implemented according to the provisions of this Circular. Specifically, for projects and sub-projects that support households, support for households is implemented through the representative of the household, who is the head of the household or the representative of the household (a person with full civil capacity, authorized in writing to receive support on behalf of the family).

The agency assigned to support the implementation of the household support list must clearly state the full name and address of the representative of the supported household; the amount of support or the name, quantity, technical specifications, symbols, labels, and manufacturing unit of the supported in-kind products; the signature (fingerprint) of the representative of the supported household or the confirmation of the paying service organization (in case of payment through the paying service organization) as a payment and settlement document.

In addition, implement other current support policies from the state budget's career funding source (if any) for households that are arranged to settle down as local people.

Regarding the policy of supporting areas for intermixed population arrangement, the Circular stipulates that the central budget supports areas for intermixed population arrangement at the rate of 60 million VND/household to implement the following contents: adjusting residential land and production land allocated to newly arrived households (reclamation, compensation according to regulations when reclaiming land from organizations and individuals when reclaiming land).
