The draft Circular of the Ministry of Agriculture and Environment detailing a number of articles of the Law on Geology and Minerals on mineral exploitation, mineral recovery and mineral recovery is being put out for public consultation.
The draft clearly stipulates the registration and notification of the date of commencement of basic construction of the mine and the date of commencement of mineral exploitation. Accordingly, organizations and individuals granted mineral exploitation licenses and mineral exploitation licenses must:
Register the date of commencement of basic mine construction and the date of commencement of mineral exploitation with the competent state management agency that issues mineral exploitation licenses and mineral exploitation licenses at least 15 days before implementation. In case of any change in implementation time, the organization or individual must notify in writing.
Notify in writing the date of commencement of basic construction of the mine and the date of commencement of mineral exploitation to the People's Committees at all levels where the mine is located (for licenses under the authority of the Ministry of Agriculture and Environment), to the People's Committees at district level and the People's Committees at commune level (for licenses under the authority of the People's Committees at provincial level) at least 07 working days before implementation.
The dossier for registration of the date of commencement of basic construction of the mine and the date of commencement of mineral exploitation includes: a) Original document registering the date of commencement of basic construction of the mine; b) Certified copy or copy with original for comparison or certified electronic copy of the original: document of land revocation, land allocation, land lease or land lease contract.
The agency appraising mineral activity dossiers under the competent state management agency that grants mineral exploitation licenses and mineral exploitation licenses is responsible for updating the registration content of the date of commencement of basic mine construction and the date of commencement of mineral exploitation for monitoring and management.
Control of mineral exploitation output
Organizations and individuals exploiting minerals and exploiting minerals must install control equipment at necessary locations to ensure control of the transportation of minerals out of the mineral exploitation area, including:
Install smart camera systems at locations where raw minerals are transported out of mining sites and exploitation sites (except for cases of mineral exploitation on rivers, lakes, and sea areas; exploitation of natural hot water and natural mineral water);
Install smart camera systems at mineral mining equipment on rivers, lakes, and sea areas to ensure observation of mineral mining activities;
Install measuring equipment capable of connecting, analyzing, and automatically sharing data with the information system and data on mineral activities to measure the volume of exploitation of natural hot water, natural mineral water, gas associated with natural hot water, and natural mineral water;
Installing a journey monitoring system for mining and mineral transportation equipment on rivers, lakes and sea areas.
In addition, organizations and individuals exploiting minerals and exploiting minerals must keep books, documents and reports to monitor and control mineral exploitation output regularly and periodically as follows:
Logbook to track and count the volume of raw minerals, the volume of waste rock and soil (if any), the volume of minerals put into processing and the volume of minerals after processing. Data is recorded and counted daily in the logbook according to regulations.
Book to track the content and ratio of useful minerals in exploited raw minerals, in ore concentrates or products obtained after processing according to mineral exploitation projects, except for the case of exploiting natural hot water and natural mineral water. Data is recorded and monitored monthly in the logbook according to regulations.
Organizations and individuals exploiting minerals and exploiting minerals must take full responsibility before the law as well as state management agencies for the accuracy, honesty and completeness of information recorded, monitored and statistically recorded in books, documents and reports.
Adjusting the license in case the mining area still has reserves
During the process of mineral exploitation (except for sand and gravel in riverbeds, lake beds, and sea areas), based on the results of statistical results of reserves and volume of exploited minerals, inventory of reserves and volume of remaining unexploited minerals, if there is a possibility that the reserves and volume of remaining unexploited minerals are larger than the reserves and volume of remaining minerals permitted for exploitation and the organization or individual exploiting minerals has a need to exploit, they must report to the competent licensing authority to adjust the mineral exploitation license and the mineral exploitation license according to regulations.
When the mineral reserves and volume permitted for exploitation as prescribed in the mineral exploitation license or mineral exploitation license have been exploited sufficiently, but the procedures for adjusting the mineral exploitation license or mineral exploitation license have not been completed, the organization or individual must stop the exploitation activities, even in cases where the exploitation period has not expired.
Mineral exploitation activities may only be continued after the competent state management agency of minerals permits the adjustment of the mineral exploitation license and the mineral recovery exploitation license to supplement the reserves and volume of minerals permitted for exploitation according to regulations.
