National Assembly deputies raise the need to regulate alcohol concentration to 0 when driving

The draft Law on Road Traffic Order and Safety was introduced at the 6th session of the 15th National Assembly. Article 8 of the draft law stipulates prohibited acts, including "driving a vehicle while having alcohol in the blood or breath". This is also the basis for the authorities to stop vehicles for inspection and control.

Regarding this draft law, there are many conflicting opinions from National Assembly deputies about the regulation of "zero alcohol concentration" when driving. Expressing his opinion to Nguoi Dua Tin , National Assembly deputy Truong Xuan Cu - Member of the National Assembly's Social Committee, delegate from Hanoi, said that he completely supports the regulation of absolutely banning alcohol concentration for drivers when participating in traffic.

"This is one of the most effective and practical ways to handle violations of alcohol concentration when participating in traffic," said Mr. Cu.

According to the Hanoi delegation, although the alcohol concentration limit for traffic participants has been set at 0 for a long time, the number of violators at certain times is still increasing. Therefore, the requirement for a 0 alcohol concentration for traffic participants is correct.

“If we allow alcohol levels at a certain threshold before imposing penalties, I think it will be difficult to manage. Because it involves science, technology, and equipment to measure what is enough and what is too much…”, Mr. Cu said, adding that each person has a different “alcohol tolerance” when drinking alcohol. Therefore, it is impossible to give a general allowable level. If we give a general level, it can cause drunkenness and loss of control over behavior. Prohibiting alcohol levels at 0 is completely reasonable.

In addition, delegate Truong Xuan Cu also noted that cases of spontaneous blood alcohol concentration when taking medicine, eating fruit, etc. need to be seriously studied and reconsidered.

In response to many opinions surrounding customs and practices that require alcohol and that drinking a few glasses of wine will not make one drunk and unable to drive, Mr. Cu said that this is just one of the excuses for alcohol abuse.

We do not prohibit drinking alcohol, but how to drink alcohol in moderation, at the right time, to ensure good health. If we abuse it, it will cause harmful effects to health as pointed out by medical experts.

“Therefore, if you drink alcohol, do not drive,” Mr. Cu said, emphasizing that a complete ban on driving with an alcohol concentration of zero not only ensures security and safety for society but also ensures health and the race.

Based on the above analysis, delegate Truong Xuan Cu said that when he presses the button to pass the Law on Road Traffic Order and Safety, he will also support the viewpoint of absolutely banning alcohol concentration when driving. "Only by banning can we manage, but if we do not ban but open up, we will not be able to manage," Mr. Cu shared.

Regarding the issues with different opinions surrounding the regulation of zero alcohol concentration, the Ministry of Public Security recently drafted a report to the National Assembly explaining the regulation of "driving a vehicle while having alcohol concentration in the blood or breath" in the draft Law on Road Traffic Order and Safety, which was commented on by National Assembly deputies at the 6th session.

According to the draft report of the Ministry of Public Security, drinking alcohol and then driving is a social problem not only in Vietnam, but also in the world. Therefore, countries around the world currently have very strict regulations on handling this behavior. These are divided into 2 groups, the group that absolutely prohibits violations of alcohol concentration and the group that regulates the alcohol concentration threshold allowed for drivers.

However, in Vietnam, culture and traffic currently require a zero alcohol concentration when driving because traffic conditions in our country have many unique characteristics.

Besides, according to surveys by some international organizations, Vietnam is one of the countries with the highest consumption of wine, beer and alcoholic beverages in the world, ranking 2nd in Southeast Asia, 10th in Asia and 29th in the world. This is a very alarming rate...

Therefore, the Ministry of Public Security believes that it is necessary to strictly control alcohol concentration, not only for ensuring traffic order and safety but also for profound social significance.

According to the Ministry of Public Security, Vietnamese culinary culture has many unique features, and is lenient. If the concentration is set at 0, then no drinking is allowed. But if there is a limit, drivers may be forced to drink. In addition, alcoholic beverages are addictive, once you start drinking, it is not easy to stop, and when you are drunk, it is difficult to remember what the law says.

There are cases where people get fined the next day for drinking too much or due to their physical condition. Many people get drunk the day before and still have a headache all day the next day, affecting their ability to drive.

Driving while intoxicated can cause disaster to innocent people, as seen in some recent cases of drunk driving causing multiple accidents.

Not to mention the traffic awareness of a part of the population is not good, disregarding the law, intentionally violating traffic laws, even challenging the authorities when being checked and handled. When a bad awareness can take the lives of many people. Therefore, society really needs strictness.

It is an order and must be carried out.

Nguyen Minh Duc, Vice Chairman of the National Assembly’s Committee on National Defense and Security, said that the draft Law on Road Traffic Order and Safety stipulates an absolute ban on breath alcohol. The Law on Prevention and Control of Alcohol Harm, Clause 6, Article 5 stipulates prohibited acts, including an absolute ban on drinking alcohol before and while driving.

Mr. Nguyen Minh Duc said that in principle, in the legal system of Vietnam, all laws need to be unified. The next law should be built based on the source of the previous law. Based on the source of the Law on Prevention and Control of Alcohol Harm, the drafting agency and the reviewing agency have proposed the above content in the Law on Road Traffic Order and Safety.

Of course, the opinions of the National Assembly deputies through discussion, the most complete and thorough assessment. The viewpoint of the examining agency is completely in agreement with the drafting agency that is to comply with the provisions of the legal system.

At the same time, based on the annual assessment and inspection of traffic safety implementation by the National Defense and Security Committee, the summary shows that 43% of road traffic accidents are caused by alcohol.

“I think this is an order and needs to be implemented. We hope that the press will propagate to change awareness and that people will support it. We believe that the National Assembly will basically agree to this content,” Mr. Nguyen Minh Duc emphasized .
