Comprehensive adjustment of all economic and social aspects

The National Assembly Standing Committee (NASC) has just issued report No. 606 assessing the implementation of laws and resolutions of the National Assembly passed from the beginning of the 15th tenure to the end of the 4th session and the implementation of laws, resolutions, and law and ordinance building programs passed by the National Assembly at the 5th session.

The report stated that the 15th National Assembly and other central government agencies and local governments at all levels began their new term with many difficulties and challenges. In the first year of the term, they must focus on both the transition of the term and the efforts to prevent and control the Covid-19 pandemic.

In 2022 and 2023, the pandemic will gradually be controlled, but many new difficulties will arise due to the consequences of the pandemic as well as the impact of the complicated and unpredictable developments of the world and regional situation; these are also the key years to implement the Resolution of the 13th National Party Congress.

Therefore, many practical requirements arise, requiring the work of building and implementing laws to be carried out very urgently with a very large amount of work.

Policy - Proactively and promptly bring laws and resolutions of the National Assembly into life

Remove difficulties and obstacles, promote decentralization and delegation of power.

From the beginning of the 15th National Assembly's term to the end of the 5th session, the National Assembly and the National Assembly Standing Committee issued 1,010 documents, including 23 laws and 101 Resolutions of the National Assembly, 4 ordinances and 882 Resolutions of the National Assembly Standing Committee, promptly institutionalizing the Party's policies and guidelines, comprehensively adjusting all aspects of economic and social life, supremely supervising and deciding many important issues of the country.

Within the framework of the conference, the National Assembly Standing Committee focused on assessing the implementation of laws and a number of Resolutions of the National Assembly, including 15 laws and 20 Resolutions passed by the National Assembly from the beginning of the term to the end of the 4th session, and the implementation of 8 laws and 8 Resolutions passed by the National Assembly at the 5th session.

Regarding the implementation of laws and resolutions issued from the beginning of the term to the end of the 4th session (including 15 laws and 20 resolutions of the National Assembly), the report also pointed out that the laws and resolutions issued by the National Assembly have created an important legal basis for implementing drastic and effective solutions to prevent and combat the Covid-19 pandemic; removing difficulties and obstacles, promoting decentralization and delegation of power, creating initiative for the Government and local authorities in management and operation;

Continue to synchronously perfect the socialist-oriented market economic institution, develop culture and society, ensure social security, national defense and security, promote democracy, strengthen the guarantee of human rights and citizens' rights, improve the efficiency of the State apparatus, continue to build and perfect the socialist rule-of-law State of Vietnam;

At the same time, pilot regulations on a number of new policies, a number of specific mechanisms and policies in a number of fields and specific mechanisms and policies for the development of a number of provinces and cities (Hai Phong, Can Tho, Nghe An, Thanh Hoa, Thua Thien - Hue, Khanh Hoa and Buon Ma Thuot city, Dak Lak province), creating conditions for localities to promote their potential and advantages, attract investment resources for rapid and sustainable development, creating a driving force to promote the development of socio-economic regions and the whole country.

Review and correct loopholes and shortcomings

For the National Assembly, National Assembly agencies and National Assembly deputies: The Standing Committee of the National Assembly directs the Secretary General of the National Assembly to organize press conferences after each National Assembly session to promptly inform about the results of the session, including laws and resolutions passed by the National Assembly; promote communication on mass media; direct the preparation of basic contents of laws and resolutions so that National Assembly deputies can promptly report at meetings with voters after the session.

Thereby, helping local authorities at all levels, people and businesses to quickly grasp new policies in the law and Resolution, proactively prepare plans and resources for implementation.

The National Assembly and the National Assembly Standing Committee shall strengthen thematic supervision of the implementation of policies and laws in various fields; direct the Nationalities Council and the National Assembly Committees to monitor, urge and supervise agencies in the implementation of laws and resolutions; issue Resolution No. 560 guiding the organization of supervision of normative documents;

The National Assembly Committees focus on substantive supervision of content, avoiding formality, focusing on key points, closely following the requirements and tasks of socio-economic development of each quarter and each year to remove obstacles, propose solutions to overcome shortcomings and limitations in law enforcement...

The agencies have reviewed 1,651 legal documents, thereby discovering a number of provisions in 7 laws and 130 sub-law documents that have loopholes, inadequacies, potential risks of corruption, negativity, or contradictory, overlapping content, and are no longer appropriate; on that basis, the Government and relevant agencies have been requested to direct research, amendment, supplementation, and abolition according to their authority or to recommend competent agencies to amend and supplement to overcome.

Every year, the National Assembly reviews and comprehensively evaluates the situation and results of law enforcement through reviewing and giving opinions on the Reports of the Government, the Supreme People's Court, and the Supreme People's Procuracy on the implementation of the Constitution, laws, ordinances, and resolutions;

In-depth assessment of law enforcement in specific areas through reviewing and commenting on other regular reports of the Government and agencies, reviewing reports on monitoring results of the National Assembly's monitoring delegations and the National Assembly Standing Committee, clearly indicating the results achieved, shortcomings, limitations and causes, and solutions to overcome them.

For the Government, Ministries, branches and localities: Through monitoring and supervision by the National Assembly, the National Assembly Standing Committee, the Ethnic Council and the National Assembly Committees, it can be seen that the Government, the Prime Minister, Ministries, branches and localities have proactively, resolutely and synchronously implemented many solutions to implement laws and Resolutions of the National Assembly.

The Government and the Prime Minister have increased supervision, inspection, focused resources, promoted the responsibility of leaders, and had many innovative solutions to speed up the drafting and promulgation of documents detailing the implementation of laws and resolutions.

Through supervision by the National Assembly's agencies, it can be seen that the issued documents basically ensure the correct authority, order, and procedures, are consistent with the Party's policies and guidelines, and ensure the constitutionality, legality, consistency of the legal system, and feasibility, actively contributing to bringing the laws and resolutions of the National Assembly into life.

Conduct social criticism on many important draft laws directly related to promoting people's mastery, protecting people's legitimate rights and interests such as the draft Law on Grassroots Democracy Implementation, the Law on Inspection (amended), the Land Law (amended), the Housing Law (amended), the Law on Real Estate Business (amended)...

The Standing Committee of the National Assembly recognizes that the above-mentioned shortcomings and limitations have many causes, both objective and subjective, but first of all, it is because the heads of some ministries, branches and localities have not fully promoted their responsibilities and have not paid due attention to the work of building and perfecting institutions and organizing law enforcement in the fields and areas under their responsibility.

Discipline and order enforcement in some cases are not strict; there is still a situation of shirking, not daring to do, fear of making mistakes, and avoiding responsibility by a number of cadres and civil servants; the responsibility of organizations and individuals in the delay and debt in issuing documents detailing the implementation of laws and resolutions, and issuing documents with illegal content...

Some ministries and agencies have not seriously summarized the implementation of laws, surveyed practices, assessed policy impacts, and received opinions from people, businesses, and affected subjects during the process of drafting assigned laws and resolutions, leading to many difficulties in the implementation process after the documents are issued ...
