1. What is land inventory?
According to Clause 29, Article 3 of the 2024 Land Law, land inventory is the State's organization of investigation, synthesis, and assessment based on cadastral records and in the field of the current land use status at the time of inventory and land changes between two inventories.
2. Principles of land inventory
According to Article 56 of the 2024 Land Law, the principles of land statistics and inventory are as follows:
- Honest, objective, accurate, timely, fully reflecting the current status and structure of land use.
- Open, transparent, independent in expertise and profession.
- Unify the operations, statistical methods, land inventory and reporting regime.
- Ensure unified and synchronized land statistics and inventory indicators from central to local levels; the land statistics and inventory data system is synthesized from lower to higher levels.
- Timely provide data to serve the state management of land and land information needs for economic, social, defense, security, scientific research, education and training activities and other needs of the State and society.
3. Scope and subjects of land inventory
According to Article 57 of the 2024 Land Law, the scope and subjects of land statistics and inventories are as follows:
- Land statistics and inventories are conducted at the commune, district, provincial and national administrative levels.
- Time to conduct land statistics and inventory is as follows:
+ Land statistics are conducted annually, up to December 31 of the statistical year, except for the year of land inventory;
+ Land inventory is conducted every 5 years, up to December 31 of the year with the last digit being 4 or 9.
- Thematic land inventories are conducted according to the requirements of state land management in each period as decided by the Minister of Natural Resources and Environment and the Chairman of the Provincial People's Committee.
4. Land inventory indicators, contents and activities
According to Article 58 of the 2024 Land Law, the criteria, contents, and activities of land statistics and inventories are as follows:
- Statistical and land inventory indicators for land types specified in Article 9 of the 2024 Land Law include:
+ Area;
+ Land users;
+ Subject assigned to land management.
- The basis for determining statistical and land inventory indicators includes:
+ Land statistics indicators are determined according to land records at the time of statistics;
+ Land inventory indicators are determined based on cadastral records and on the current land use status at the time of inventory.
- The content of land statistics and inventories by administrative unit at commune, district, provincial levels and nationwide includes: determining the total area of land types, area structure by land type, land users, subjects assigned to land management; land area assigned, leased, and changed land use purposes.
- Land statistics activities are carried out as follows:
+ Collect records, documents, maps, and data related to land changes during the statistical period; land inventory data from the previous period or land statistics conducted in the previous year;
+ Review, update and correct land fluctuations during the statistical year;
+ Process, synthesize data and create land statistics tables according to administrative units at all levels;
+ Analyze and evaluate the current status of land use and land fluctuations during the statistical period, propose solutions to strengthen management and improve land use efficiency;
+ Build land statistics report.
- Land inventory activities are carried out as follows:
+ Collect records, documents, maps, and data related to land changes during the land inventory period; records of previous land inventory results and annual land statistics results during the land inventory period;
+ Investigate, review, update and correct land changes during the inventory period;
+ Process, synthesize data and create land inventory tables according to administrative units at all levels; develop reports explaining the current status of land use;
+ Create a map of current land use status; develop a report explaining the current land use status map;
+ Develop land inventory results report.
5. Responsibility for organizing land inventory
Responsibilities for organizing the implementation of land statistics and inventories according to Article 59 of the 2024 Land Law are as follows:
- People's Committees at all levels organize and approve the implementation of local land statistics and inventories.
- The People's Committees at commune and district levels report to the People's Committees at the next higher level on the results of land statistics and inventories.
- The People's Committee at the provincial level is responsible for announcing the results of land statistics and reporting to the Ministry of Natural Resources and Environment before March 31 of the following year, except for the year of land inventory.
- The provincial People's Committee is responsible for reporting the results of land inventory to the Ministry of Natural Resources and Environment before June 30 of the year following the year of land inventory.
- The Ministry of National Defense and the Ministry of Public Security are responsible for presiding over and coordinating with the People's Committees at the provincial level to conduct statistics and inventory of national defense and security land.
- The Ministry of Natural Resources and Environment synthesizes the results of the annual land statistics of the whole country and announces them before June 30 every year; synthesizes the report to the Prime Minister and announces the results of the 5-year land inventory of the whole country before September 30 of the year following the year of land inventory.
- The Minister of Natural Resources and Environment and the Chairman of the Provincial People's Committee decide on the content and activities of thematic land inventory.
- The Minister of Natural Resources and Environment shall detail the land statistics, inventory and mapping of current land use status.
- The budget for conducting land statistics and inventories is guaranteed by the state budget and arranged according to the provisions of law.
The Land Law 2024 takes effect from August 1, 2024, except for the cases specified in Clauses 2 and 3, Article 252 of the Land Law 2024.
