Most of the apartments are from two projects, including Sunrise Riverside in Nha Be (3,117 units) and The Sun Avenue in Thu Duc City (2,894 units). In addition, the list also includes more than 500 officetels in the Sunrise Riverside and Orchard Garden projects.
This is certainly good news for Novaland homebuyers, because the pink book is considered a “legal certificate” of property, but it is also the source of many worries for people: from the initial joy when receiving the house, to the worry when the project owner has not fulfilled his commitment. Then comes the insecurity when knowing that the project is stuck in legal issues, making it uncertain when the pink book will be delivered.
The story of apartment pink books is always topical in both Ho Chi Minh City and Hanoi, because while many difficulties have not been resolved, new problems arise.
A series of causes were pointed out by the authorities and hundreds of projects had to be divided into groups to resolve. Looking at that, we can see how complicated the “pink book world” is.
In June 2023, the Department of Natural Resources and Environment of Ho Chi Minh City said that since the 2013 Land Law took effect, Ho Chi Minh City has had 335 projects implemented, with more than 191,000 apartments, but more than 81,000 apartments have not been granted certificates. The reason stems from legal problems related to financial obligations, land valuation procedures and many other issues. After a year and a half of solving, the Department has completed the removal of difficulties and obstacles for 43,121 apartments, reaching a rate of 53%. It is expected that in 2025, departments, branches and sectors will complete the removal of difficulties and obstacles for the remaining apartments.
For the group of new investment projects that have completed construction and been put into use, but have not yet completed the issuance of certificates, the City also issued a plan and established a working group with a clear roadmap through 3 stages: from review, to implementation and preliminary summary. The grouping of problems and providing solutions suitable for each level of authority has shown clear effectiveness. The working group has resolved 40 projects, with a total of nearly 27,000 apartments, houses, land plots, officetels, along with 655 car parking spaces and 206 commercial service spaces.
It must be emphasized that living in apartments without a pink book is like renting an apartment that they saved every penny to buy, because besides living there, they cannot exercise their rights in civil transactions because the property has not been recognized by the State.
It can be seen that one of the major obstacles is the financial obligation when making a pink book. Previously, because the appraisal unit was not "keen" on participating in bidding for appraisal of land plots and projects invited by the City Department of Natural Resources and Environment, a series of projects fell into a difficult situation because they had to wait a long time to complete their financial obligations. Currently, based on the new guiding decree on land prices, the City Department of Natural Resources and Environment has handled the situation by establishing an interdisciplinary working group or a public service unit with the function of consulting on land price determination. This unit will propose to add the function of land price consulting to units under the Department, thereby minimizing the waiting time when completing financial obligations. Thoroughly resolving the issuance of pink books and certificates of land use rights for land plots left by history, but meeting the conditions prescribed in the 2024 Land Law, not only meets the urgent needs of the people, but also helps increase revenue for the budget. For Ho Chi Minh City alone, as of December 18, 2024, the City has collected more than VND 25,300 billion from land, an increase of VND 8,000 billion compared to 2023.
The expectations of people across the country in granting pink books in many apartment projects, granting red books for land plots that meet the conditions for granting certificates of land use rights under the 2024 Land Law are extremely high, especially when tens of thousands of home buyers in many big cities are having the same dream of owning property protected by law. This is something that the authorities need to pay attention to, do not let that dream become too far away for many people who have to "rent" in their own homes.
