On October 10, Mr. Nguyen Nhu Cong, Chief of Office of Quang Nam Provincial People's Committee signed a notice conveying the opinion of Mr. Tran Nam Hung - Vice Chairman of the Provincial People's Committee - on the assessment of the implementation status of projects invested by Bach Dat An Joint Stock Company (hereinafter referred to as Bach Dat An Company).
Bach Dat An Joint Stock Company is the investor of many projects in the new urban area of Dien Nam - Dien Ngoc, Dien Ban town; including 3 projects related to the dispute with Hoang Nhat Nam Investment Joint Stock Company (abbreviated as Hoang Nhat Nam) from 2017 to present.
The three projects include Bach Dat urban area, the expanded 7B urban area and the Hera Complex Riverside urban area in the new Dien Nam - Dien Ngoc urban area. These projects owe 1,000 red books to land buyers.

Accordingly, the Vice Chairman of the People's Committee of Quang Nam province requested the legal representative of Bach Dat An Company to work hard to request relevant individuals in the old leadership to promptly hand over, provide relevant records, documents, and data to transfer to the Land Fund Development Center of Dien Ban town before October 30, and continue to coordinate in organizing compensation payments.
"In case by October 30, the company does not provide sufficient documents to the Dien Ban Town Land Fund Development Center to coordinate compensation payments, sufficient funds will be allocated to pay according to the approved plans," the notice stated.
Quang Nam provincial leaders also requested Bach Dat An Company to coordinate with Dien Ban Town People's Committee, Town Land Fund Development Center, and relevant agencies to organize compensation payments to households, organizations, and individuals affected by the 7B urban area expansion project and Hera Complex Riverside urban area according to the approved plans before November 15.

In addition, Bach Dat An Company cooperated with Hoang Nhat Nam to work with households and individuals related to capital contribution transactions, sale and purchase contracts, land use rights transfers, and to collect opinions on the contents of the expected adjustment of detailed planning of projects for areas that cannot be compensated or cleared.
In case the households have high consensus, complete the documents and procedures, evaluate the implementation of the detailed planning in accordance with current regulations of the law on urban planning, propose adjustment contents, and submit to competent authorities for consensus for implementation.
In 2017, Bach Dat An Company signed a contract with Hoang Nhat Nam to distribute nearly 1,000 land lots in 3 projects of the 7B urban area expansion, Hera Complex Riverside and Bach Dat, in the new urban area of Dien Nam - Dien Ngoc (Dien Ban town). After that, the two companies had a dispute and took each other to court.
Courts at all levels have issued legally effective judgments, forcing Bach Dat An to continue to perform the deposit and land distribution contract, the agreement minutes, and attached appendices... between the two companies.
During the execution of the judgment, the Civil Judgment Enforcement Department of Quang Nam province repeatedly urged and requested Bach Dat An to voluntarily execute the judgment. However, this company did not execute the judgment, violated its commitments on project implementation deadlines, and failed to fulfill its financial obligations...
The Department of Planning and Investment of Quang Nam province also revoked the business registration certificate of Bach Dat An Company, due to tax arrears of more than 90 days from the deadline for payment as prescribed.
The dispute between the two companies has lasted for many years, causing nearly 1,000 land buyers to suffer in demanding their red books for many years, causing public outrage and affecting local security and order...
