Amendment to the Law on Citizen Identification: Proposal to issue ID cards to people under 14 years old

The draft Law on Citizen Identification (amended) supplements regulations on the management and issuance of ID cards for people under 14 years old; however, the issuance of cards for this group of subjects will be carried out according to demand, while it is mandatory for people aged 14 and over.

On the afternoon of June 2, continuing the 5th Session, Minister of Public Security To Lam, authorized by the Prime Minister, presented the Report on the draft Law on Citizen Identification (amended).

Perfecting the ecosystem to serve connection, exploitation, and enrichment of population data

The Minister stated that currently, the provisions of the Law on Citizen Identification on the management, operation, exploitation and use of information in the National Population Database and the Citizen Identification Database are not yet complete and comprehensive.

The new Law on Citizen Identification only focuses on citizen management through the Citizen Identification Database, the National Population Database, and citizen identification cards, but does not have regulations on electronic identification accounts for organizations and individuals in the electronic environment.

Therefore, to remove difficulties and obstacles in implementing the 2014 Law on Citizen Identification and meet current requirements and tasks, it is necessary to amend the 2014 Law on Citizen Identification to create a legal basis for implementation, creating a breakthrough in digital transformation in our country.

The amendment of the Law on Citizen Identification aims to serve the settlement of administrative procedures and provision of online public services; socio-economic development; building digital citizens; perfecting the ecosystem serving connection, exploitation, supplementation and enrichment of population data...

According to the Minister, in the process of proposing the Law on Citizen Identification (amended), the Government unanimously approved 4 policies in the proposal to develop the Law; including the policy on granting identity certificates to people of Vietnamese origin living in Vietnam but whose nationality has not been determined and electronic citizen identification (electronic identification account of Vietnamese citizens).

To fully and closely specify the above policies in the draft Law, ensuring comprehensiveness and conformity with the scope of regulation and subjects of application of the Law, the Government has revised the name of the draft Law from "Law on Citizen Identification (amended)" to "Law on Identification".

The Law on Identification is built on the viewpoint of: creating a more complete and appropriate legal basis for identification management; ensuring consistency and unity in the legal system regulating people's identification documents; serving national digital transformation, contributing to the construction of e-Government, digital Government, digital society...

The draft Law consists of 7 Chapters and 46 Articles, stipulating the scope of regulation, subjects of application of the law; requirements for the establishment and management of the National Population Database; content shown on the ID card, the person issued the ID card, the validity of the ID card; age for changing the ID card; electronic ID, electronic identity of Vietnamese citizens; responsibility for state management of ID, etc.

Change the name to "ID card"

Presenting some basic contents of the draft Law, Minister To Lam said that in addition to applying to Vietnamese citizens, relevant agencies, organizations and individuals, this Law also applies to people of Vietnamese origin living in Vietnam but whose nationality has not been determined. The draft Law has added an Article on identity certificates and management of people of Vietnamese origin; regulating the issuance of identity certificates to these people.

Regarding prohibited acts, the draft Law basically maintains the same provisions as the 2014 Law on Citizen Identification; including adjusting and supplementing the content prohibiting the purchase, sale, exchange, sharing, appropriation, and illegal use of data information in the National Population Database and the Identification Database to be consistent with the orientation of identification management in the draft Law.

Regarding the content shown on the ID card, the draft Law amends and supplements in the direction of removing fingerprints; amending regulations on information on ID card number, the words "citizen identification card", hometown, permanent residence, signature of the card issuer to personal identification number, the words "ID card", place of birth registration, place of residence...

“The above changes and improvements are to make it more convenient for people to use their ID cards, limit the need to issue new ID cards, and ensure people's privacy. People's basic identification information will be stored, exploited, and used through the electronic chip on the ID card,” the Minister emphasized. At the same time, he said that the issued ID cards are still valid and are not affected by this regulation.

Issue, change, reissue ID cards within 7 working days

Regarding the people who are granted ID cards, the draft Law supplements regulations on the management and issuance of ID cards for people under 14 years old and the issuance of ID certificates for people of Vietnamese origin to ensure their legitimate rights and interests and serve state management; promote the value and utility of ID cards in the activities of the digital government and digital society. However, the issuance of cards for people under 14 years old will be carried out according to demand, while it is mandatory for people aged 14 and over.

Regarding the time limit for issuing, exchanging, and re-issuing ID cards, the draft Law has been amended in the direction that from the date of receiving complete documents, the ID management agency must issue, exchange, and re-issue ID cards to people within 7 working days (this is a general regulation, applied nationwide, regardless of the place of residence of people as in the 2014 Law on Citizen Identification).

In particular, the draft Law adds new content about electronic identification, which stipulates that each citizen has only 1 electronic identification, which is an electronic identification account created by the electronic identification and authentication system. The implementation of administrative procedures and public administrative services in the electronic environment must use electronic identification. Electronic identification is used to perform other transactions and activities according to the needs of the people.
