New regulations on functions, tasks and organizational structure of the Ministry of Finance.

The Government issued Decree 29/2025/ND-CP stipulating the functions, tasks, powers and organizational structure of the Ministry of Finance.

The Government issues new regulations on functions, tasks, powers and organizational structure of the Ministry of Finance.

The Decree clearly states that the Ministry of Finance is a Government agency, performing the state management function on: Socio-economic development strategies and plans; planning; development investment, business investment in Vietnam and business investment from Vietnam to foreign countries, investment promotion; state budget; state treasury; public debt; foreign aid to Vietnam and Vietnam's aid to foreign countries; taxes, fees, charges and other revenues of the state budget; state reserves; finance for extra-budgetary state financial funds; public assets; customs; accounting; auditing; prices; securities; insurance; bidding; enterprises, collective economy, cooperative economy, business households; economic zones; financial services and other services under the state management scope of the Ministry; statistics; implementation of social insurance and health insurance policies, representative of owners for state capital invested in enterprises according to the provisions of law.

Duties and Powers

The Ministry of Finance has the duties and powers prescribed in the Law on Organization of the Government, the Decree stipulating the functions, duties, powers and organizational structure of ministries, ministerial-level agencies and the following specific duties and powers:

Regarding socio-economic development strategies and plans; sectoral development strategies and plans under its management; planning , the Ministry of Finance develops socio-economic development strategies and 5-year and annual socio-economic development plans for the whole country; sectoral and sectoral development strategies and plans under its management; national master plans and regional plans; implementation plans, policies, solutions, resource allocation and organization of the announcement of national master plans and regional plans after approval; develops the Government's action program to implement the 5-year socio-economic development plan after approval by the National Assembly.

The Ministry of Finance guides ministries, branches and localities to monitor and evaluate the implementation of plans of ministries, branches and localities; organizes monitoring, evaluation and reporting on the implementation of the national socio-economic development plan on a monthly, quarterly, annual, mid-term and 5-year basis; presides over the appraisal of provincial planning tasks and provincial planning; submits to the Government the establishment of a Council for appraisal of national master planning tasks and a Council for appraisal of national master planning; submits to the Prime Minister the establishment of a Council for appraisal of regional planning tasks and a Council for appraisal of regional planning; guides ministries, ministerial-level agencies and provincial People's Committees in the preparation and implementation of planning.

Regarding state budget management , the Ministry of Finance synthesizes, prepares and submits to the Government the national 5-year financial plan, the national 3-year financial-state budget plan; the state budget estimate and the annual central budget allocation plan according to the provisions of the State Budget Law; adjusts the national 5-year financial plan, the state budget estimate and the central budget allocation plan (if any); presides over the review and proposal of the total regular expenditure for national target programs during the development process and submits it to competent authorities; balances and arranges annual regular expenditure for implementation after the Program is approved; develops and submits to the Government a plan to supplement the estimate of increased state budget revenue, a plan to allocate and use increased revenue and save expenditure of the central budget, and a plan to adjust the state budget estimate according to regulations.

The Ministry of Finance shall develop and submit to the Prime Minister a draft decision assigning budget revenue and expenditure tasks to each ministry, ministerial-level agency, government agency and other central agency, revenue and expenditure tasks, percentage (%) of division of divided revenues and additional levels from the central budget to each province and centrally run city in accordance with the provisions of the State Budget Law; decide within its authority or submit to the Prime Minister for decision on the use of central budget reserves, the use of central financial reserve funds and other financial reserve sources in accordance with the provisions of law.

The Ministry of Finance organizes the implementation of the state budget and manages the central budget according to its authority; monitors and urges the implementation of budget estimates at all levels; inspects the allocation of assigned budget estimates of ministries, ministerial-level agencies, government agencies, and other central agencies; guides the management and operation of budgets of ministries, branches, and localities; directs and inspects the implementation of budget collection and expenditure tasks of ministries, ministerial-level agencies, government agencies, other central agencies, and localities.

The Ministry of Finance helps the Government unify state management of public investment, PPP investment, and other development investment.

Regarding development investment management , the Ministry of Finance assists the Government in unifying state management of public investment, investment under the public-private partnership (PPP) method and other development investment; promulgates or submits to competent authorities for promulgation legal documents on public investment, investment under the PPP method, other development investment, general regulations on management of national target programs; presides over and coordinates with relevant ministries, branches and localities to develop principles, criteria and norms for allocating public investment capital from the state budget; develops principles and criteria for allocating capital for key, large-scale, regionally linked projects, creating momentum for socio-economic development of the country and regions.

The Ministry of Finance shall preside over and coordinate with relevant agencies to appraise capital sources and the ability to balance capital for national target programs, important national projects, public investment programs and projects for which the Government and the Prime Minister decide on investment policies; the standing State Appraisal Council for national target programs and projects under the National Assembly's authority to approve investment policies; the standing Inter-sectoral Appraisal Council for investment projects under the PPP method under the Prime Minister's authority to decide on investment policies; appraise investment policies for programs and projects under the Prime Minister's authority to decide and approve investment policies according to the provisions of the Law on Public Investment and the Law on Investment under the Public-Private Partnership method; inspect, supervise and evaluate overall investment activities; inspect, supervise and supervise public investment programs and projects and investment under the PPP method according to the provisions of law.

The Ministry of Finance is the focal agency performing state management of industrial parks and economic zones, free trade zones and other types of economic zones; proposing models, mechanisms and policies on the development of industrial parks and economic zones, free trade zones and other types of economic zones; appraising the establishment, expansion and adjustment of boundaries of economic zones, free trade zones and other types of economic zones.

Regarding business investment in Vietnam and business investment from Vietnam to foreign countries; investment promotion , the Ministry of Finance manages business investment activities in Vietnam and business investment activities from Vietnam to foreign countries; organizes investment promotion activities, guides investment procedures; presides over the appraisal of investment policies for investment projects under the approval authority of the Prime Minister and the National Assembly according to the provisions of the Investment Law; carries out procedures for granting, adjusting and terminating the validity of the Certificate of registration of overseas investment; organizes inspection, supervision and assessment of domestic investment activities, foreign investment and overseas investment according to the provisions of law.

Regarding taxes, fees, charges and other revenues of the state budget , the Ministry of Finance shall preside over and coordinate with relevant agencies to develop, submit to competent authorities for promulgation and guide and inspect the implementation of legal documents on taxes, fees, charges and other revenues of the state budget; unify the management, direction and inspection of the organization of the implementation of tax, fee, charge and other revenues of the state budget in accordance with the provisions of law for tax agencies, customs agencies and other agencies assigned by the state to collect fees, charges or other revenues of the state budget.

The Ministry of Finance shall decide within its authority or submit to competent authorities for decision on exemption, reduction, refund, collection, debt cancellation, extension of late payment, fines for taxes, fees, charges and other revenues of the state budget in accordance with the provisions of law and issues arising in the process of implementing bilateral or multilateral international treaties and agreements on taxes, fees, charges and other revenues of the state budget; promulgate regulations on procedures and processes for the collection and payment of taxes, fees, charges and other revenues of the state budget in accordance with the provisions of law; provide guidance on the following operations: Declaration, calculation and payment of taxes, fees, charges and other revenues of the state budget and other related operations.

The Ministry of Finance inspects and controls state budget revenue sources, compliance with legal provisions on state budget collection and payment, and handles violations of laws on taxes, fees, charges and other state budget revenues according to law; assesses the conformity of tax, fee, charge policies and other state budget revenues with other current mechanisms and policies and the socio-economic situation in each period to adjust, amend and supplement according to its authority or proposes to competent authorities to promptly adjust, amend and supplement.

Regarding national reserve management , the Ministry of Finance shall preside over and coordinate with relevant ministries and agencies to develop and submit to competent authorities a list, a detailed list of national reserve goods, the total national reserve level, and a national reserve plan; promulgate national technical regulations, economic-technical norms and quality management for national reserve goods and national reserve warehouse standards (except for national reserve warehouse standards of the Ministry of Public Security and the Ministry of National Defense) in accordance with the provisions of law; promulgate regulations on financial management regime, maximum purchase price, minimum sale price, compensation price for damage to national reserve goods, cost levels for purchasing, selling, importing, exporting, preserving, insuring, providing relief and aid for national reserve goods in accordance with the provisions of law.

Regarding public asset management , the Ministry of Finance shall unify the state management of public assets in accordance with the law; preside over and coordinate with ministries, branches and localities to develop and submit to competent authorities for promulgation legal documents on the management, use and exploitation of public assets and the requisition and confiscation of assets in accordance with the law; decide within its authority or submit to the Prime Minister for decision on the establishment of ownership, assignment, transfer, assignment, sale and assignment of public assets in accordance with the law; promulgate the list of goods and services subject to national centralized procurement in accordance with the authority and roadmap decided by the Prime Minister; preside over and coordinate with relevant agencies to guide the implementation of centralized procurement in accordance with the law.

The Ministry of Finance unifies state management of bidding according to the provisions of law.

Regarding bidding management , the Ministry of Finance shall unify state management of bidding in accordance with the provisions of law; preside over, develop and submit to competent authorities for promulgation legal documents on contractor selection and investor selection in accordance with the provisions of law on bidding and investment under the PPP method; preside over the development and promulgation under its authority of sample documents on contractor selection and investor selection in accordance with the provisions of law on bidding and investment under the PPP method; organize the appraisal of the overall plan for contractor selection and contractor selection plans under the Prime Minister's decision-making authority and other cases assigned by the Prime Minister in accordance with the provisions of law; guide and inspect the implementation of regulations on contractor and investor selection in accordance with the provisions of law on bidding and investment under the PPP method; annually summarize and report to the Prime Minister on the implementation of bidding work.

Regarding the management of State capital in enterprises; registration, development and management of corporate finance, collective economy, and business households , the Ministry of Finance shall preside over and coordinate with ministries and branches to develop and submit to the Government or the Prime Minister for promulgation, according to its authority, programs, plans, mechanisms and policies on registration and development of enterprises, collective economy, and business households; policies to improve the investment and business environment; mechanisms for managing corporate finance for all types of enterprises of all economic sectors; financial mechanisms to serve the policy of developing collective economy and cooperatives; preside over or participate in the investment of State capital and financial support in enterprises; monitor, supervise, check and inspect the implementation of State capital investment in enterprises after approval by competent authorities; resolve policies when arranging and restructuring State capital in enterprises according to the provisions of law; Monitor and synthesize the situation of arrangement and innovation of enterprises with state capital investment nationwide; organize the implementation of supervision, inspection and examination of the situation of state capital investment in enterprises by capital owner representative agencies according to the provisions of law.

Regarding accounting and auditing , the Ministry of Finance shall develop and submit to competent authorities for promulgation policies on the development of accounting and auditing activities, regulations on accounting and auditing (including independent auditing and internal auditing), reporting regimes, and financial and budgetary disclosure; promulgate regulations on principles, standards, professional methods, and accounting and auditing practices; submit to competent authorities for promulgation standards and conditions for accountants, chief accountants, auditors, practicing auditors, and practicing accountants; standards and conditions for establishing independent accounting and auditing service enterprises; issue, reissue, adjust, and revoke certificates of eligibility to conduct independent accounting and auditing services; certificates of registration to practice independent accounting and auditing; suspend the practice of independent accounting and auditing services and suspend the business of independent accounting and auditing services in accordance with the provisions of law.

The Ministry of Finance guides, inspects and supervises the implementation of legal provisions on accounting, auditing, accounting services, independent auditing; accounting practice, independent auditing and handles violations in the implementation of legal provisions on accounting, auditing, accounting practice, independent auditing.

Ministry of Finance manages the state on securities and the securities market.

The Ministry of Finance manages the state on insurance business : Develops and submits to the Government for promulgation legal documents on insurance business; develops policies for developing the insurance market; grants, re-grants, amends, supplements and revokes licenses for establishment and operation, suspends the activities of insurance enterprises, reinsurance enterprises, foreign branches in Vietnam, insurance brokerage enterprises, mutual insurance organizations; grants, re-grants, amends, supplements, extends, revokes licenses for establishing foreign representative offices in Vietnam, terminates the operations of foreign representative offices in Vietnam; inspects and supervises the operations of insurance enterprises; reinsurance enterprises; foreign branches and representative offices in Vietnam; mutual organizations providing micro-insurance; insurance brokerage enterprises according to the provisions of law; Preside over and coordinate with relevant agencies to apply necessary measures to ensure that insurance market activities are carried out in accordance with the law; manage the use of the Insured Person Protection Fund; organize information and forecast the insurance market situation.

Regarding financial management of financial institutions and financial services , the Ministry of Finance shall develop mechanisms and policies on the issuance of government bonds, local government bonds, government-guaranteed bonds and corporate bonds in accordance with the law; develop mechanisms and policies and implement the issuance, re-issuance, adjustment, extension and revocation of Certificates of eligibility for business for credit rating activities, supplementary pension insurance and financial institutions operating in the financial market under the state management of the Ministry of Finance in accordance with the law; develop and submit to competent authorities for promulgation or promulgate and guide mechanisms, policies and models for organizing lottery, betting, casino and prize-winning electronic games in accordance with the law; inspect and handle violations of the law in the implementation of legal provisions on lottery, betting, casino and prize-winning electronic games; Grant, re-grant, adjust, extend and revoke Certificates of eligibility for lottery, betting, casino and electronic games with prizes business according to current law provisions.

The Ministry of Finance shall develop and submit to competent authorities for promulgation the State's policy credit mechanism and the financial mechanism for policy banks in accordance with the provisions of law; develop and submit to the Prime Minister for approval the annual State development investment credit capital plan for policy banks; inspect the implementation of money printing, minting and destruction operations and inspect the management of State foreign exchange reserves by the State Bank of Vietnam in accordance with the Government's regulations.

Regarding customs , the Ministry of Finance shall develop and submit to the Government and the Prime Minister for promulgation specific regulations on customs procedures, customs inspection and supervision; prevention and combat of smuggling and illegal transportation of goods across borders; promulgate, within its authority, documents guiding and directing the implementation of customs inspection and supervision; organize the implementation of laws on taxes and other revenues of the state budget for exported and imported goods; prevent and combat smuggling and conduct customs statistics in accordance with the provisions of law; organize, guide, direct, inspect and take responsibility for the performance of customs duties in accordance with the provisions of the Customs Law and other provisions of law; inspect and handle, within its authority, violations of customs laws.

In the field of prices , the Ministry of Finance shall develop, submit to the Government and the Prime Minister for approval and organize the implementation of price management orientations, report on price management periodically or suddenly; develop and submit to the Government for promulgation regulations on price management decentralization and price management mechanisms for goods and services priced by the State; preside over and coordinate with ministries, branches and provincial People's Committees to inspect price-forming factors for goods and services under its authority according to the provisions of law; coordinate with relevant ministries and agencies to develop and submit to competent authorities for decision on prices of goods and services in the list of goods and services priced by the State.

The Ministry of Finance determines the prices of goods and services under its pricing authority in accordance with the provisions of the law on prices and under the pricing authority of the Ministry of Finance; goods and services in many sectors and fields under its management and affecting the state budget and included in the list of goods and services subject to state pricing under the pricing authority of the Ministry of Finance in accordance with the provisions of law based on the proposal of the agency assigned to appraise the price plan (ministries and ministerial-level agencies managing sectors and fields); issue, reissue and revoke certificates of eligibility for price appraisal services; suspend the business of price appraisal services; preside over and coordinate with relevant ministries and agencies to promulgate the list of goods and services for which prices are declared; methods of implementing and receiving price declarations.

The Ministry of Finance organizes the implementation of social insurance and health insurance policies and regimes.

In the field of social insurance , the Ministry of Finance organizes the implementation of social insurance and health insurance regimes and policies; organizes the collection and disbursement of unemployment insurance regimes; manages and uses non-budgetary state financial funds: social insurance, unemployment insurance, health insurance; inspects the implementation of legal provisions on social insurance; the payment and payment of unemployment insurance and health insurance for agencies, units, organizations using labor and individuals; inspects the use of health insurance funds for health insurance medical examination and treatment facilities that have signed contracts with social insurance agencies according to the provisions of law; conducts specialized inspections on social insurance, unemployment insurance, health insurance payment according to the provisions of law; participates with competent state agencies in developing, supplementing, and perfecting policies and laws on social insurance, unemployment insurance, and health insurance.

In the field of statistics , the Ministry of Finance develops and organizes the implementation of strategies, plans and policies for the development of statistical activities; coordinates and organizes statistical activities and provides statistical information in accordance with the provisions of law; builds and unifies the management of national, provincial and district statistical information systems; organizes and coordinates the connection and provision of data and information between state statistical information systems; develops standards and conducts quality assessment of statistical information in state statistical activities; develops a system of statistical indicators, statistical reporting regimes, statistical investigation programs and statistical classification in accordance with the provisions of law.

Organizational structure of the Ministry of Finance

The Ministry of Finance has 35 units, of which 30 units are administrative organizations assisting the Minister in performing the state management function, including: 1- Department of National Economic Synthesis; 2- Department of State Budget; 3- Department of Investment; 4- Department of Finance - Sectoral Economics; 5- Department of National Defense, Security, Special (Department I); 6- Department of Local and Territorial Economy; 7- Department of Planning Management; 8- Department of Financial Institutions; 9- Department of Organization and Personnel; 10- Department of Legal Affairs; 11- Inspectorate; 12- Office; 13- Department of Debt Management and Foreign Economic Relations; 14- Department of Public Asset Management; 15- Department of Bidding Management; 16- Department of Tax, Fee and Charge Policy Management and Supervision; 17- Department of Insurance Management and Supervision; 18- Department of Accounting and Audit Management and Supervision; 19- Department of Price Management; 20 State Bureau of State Development; 21- Department of Private Enterprise Development and Collective Economy; 22- Department of Foreign Investment;

4 is a public non-business unit including: 1- Strategy and Economic Policy Institute; 2- Financial- Investment Newspaper; 3- Journal of Economic- Finance;

Besides, Vietnam Social Insurance is a specific unit of the Ministry of Finance.

This Decree takes effect from March 1, 2025.
