On the afternoon of March 25, full-time National Assembly deputies gave their opinions on the draft Law on Teachers.
Commenting on the draft Law on Teachers, Deputy Le Thanh Hoan (Thanh Hoa Delegation) suggested that it is necessary to clarify the retirement regime for teachers when the draft law allows teachers at preschools to retire at a younger age if they wish, but not more than 5 years, without reducing the pension percentage when they have 20 years of insurance contributions or more.
Mr. Hoan analyzed that: Clause 3, Article 169 of the Labor Code stipulates that workers with reduced working capacity who do heavy, hazardous, or dangerous work in areas with difficult economic conditions can retire at a lower age but not more than 5 years older than the regulation and the Government is assigned to specify the details. Therefore, if it is considered that preschool teachers are a heavy profession, the Government has the right to stipulate this content.
Regarding the retirement regime at a higher age for teachers, Article 29 of the draft law stipulates that the working time at retirement of those who can enjoy a higher retirement regime is not more than 5 years for teachers with a doctorate degree, not more than 7 years for teachers who are associate professors, and not more than 10 years for teachers who are professors, and during this time the teacher does not hold a management position. According to Resolution 28 of the 12th tenure, it is clearly stated that for special occupations, employees have the right to retire early, or 5 years later than the general retirement age. Thoroughly implementing the spirit of Resolution 28, the Labor Code has stipulated that employees with high technical expertise and some special cases can retire at a higher age but not more than 5 years, except in cases where the law provides otherwise.
“In addition, Decree 50 guiding the Labor Code and the Law on Public Employees stipulates a higher retirement age for public employees in public service units, the applicable subjects are those with a doctorate, associate professor, or professor degree and are working for no more than 5 years without distinguishing between 3 levels as in the draft law. Therefore, the draft law needs to stipulate that the working time of teachers who are public employees when retiring at a higher age is no more than 5 years to be consistent with Resolution 28,” Mr. Hoan suggested.
According to Deputy Duong Khac Mai (Dak Nong Delegation), Resolution 57 of the Politburo on scientific and technological breakthroughs, innovation and national digital transformation has put forward a number of very important tasks and solutions related to teachers and educational institutions such as: developing a team of lecturers and scientists with sufficient capacity and qualifications to meet the requirements of teaching in the fields of basic science, semiconductor chip technology, microchips, engineering and key technologies; promoting cooperation with prestigious foreign universities; strongly innovating training programs according to international standards; modernizing training methods and applying advanced technologies, especially artificial intelligence; building a number of advanced training centers specializing in artificial intelligence; having a specific mechanism for public-private partnership in digital technology training; building an online education and training platform, a digital university education model, improving the quality of digital capacity in society.
From the above analysis, Mr. Mai suggested: "The draft law needs to specifically and deeply elaborate the viewpoints in Resolution 57 related to teachers to supplement appropriate policies and regulations in the current situation."
In addition, regarding the salary and allowance policy for teachers, according to Mr. Mai, teachers' salaries are ranked highest in the administrative career salary scale system. However, for the policy to be effectively implemented, the ranking of the highest salary in the salary scale system must go hand in hand with the quality of teachers. Because of the importance of the decisive role of the teaching staff in improving the quality of education, a factor that has a decisive meaning for the development of high-quality human resources, human development to meet the requirements of industrialization, modernization and international integration.
“Along with the implementation of specific policies on salaries, during the implementation of the law, there must be regulations to improve the quality of the teaching staff, gradually building a team that is truly good at expertise, fully meeting the regulations on teacher ethics, dedication, and responsibility for the profession. The draft law should be assigned to the Government to have a roadmap, review, arrange, select, and attract to improve the quality of teachers,” Mr. Mai suggested.
Meanwhile, Deputy Vuong Quoc Thang (Quang Nam Delegation) stated that, in the spirit of Resolution 57, higher education will be the place where the state focuses on adjusting the mechanism to strongly promote autonomy and self-responsibility, creating motivation in mobilizing resources to develop breakthroughs in training high-quality human resources to meet the needs of breakthrough development in science, technology, innovation and digital transformation. Therefore, it is proposed that the draft law needs to supplement policies to develop teachers, meet the requirements of training and developing human resources in the new period, especially meeting the requirements set out in Resolution 57.
