RECOGNIZING RELEASE FOR POSITIONS AND POWER IN PERSONNEL WORK
Accordingly, acts considered as bribery in personnel work include directly or indirectly brokering, giving and receiving bribes to help others obtain positions, titles, and benefits. Giving gifts, money, real estate or other material or non-material benefits, arranging entertainment activities for people with authority and responsibility for the purpose of gaining support, trust, positions, titles, and benefits.
Running after age, seniority, emulation titles, rewards, degrees, assignments, appointments, nominations, nominations, designations, transfers, rotations, secondments, conferments, military rank promotions... for the purpose of meeting standards, conditions, obtaining positions and benefits. Taking advantage of familiar relationships or using the advantages, working positions, and prestige of others to influence, gain favor, and put pressure on people with authority and responsibility for the purpose of obtaining positions, titles, and benefits. Taking advantage of having internal information or unfavorable information of organizations and individuals to set conditions, put pressure on people with authority and responsibility in assigning, appointing, introducing, nominating, and designating oneself. Using one's personal history, family background, and work achievements to make unreasonable demands on organizations and individuals with authority and responsibility for obtaining positions, titles, and benefits.
In addition, negative behaviors in personnel work are identified as meeting, contacting, and exchanging with personnel in violation of regulations during the implementation of personnel work; harassment, causing difficulties, troubles, prolonging time, setting conditions for personnel and personnel submitting agencies; falsifying or distorting records and documents for consideration and implementation of regulations, processes, rules, and decisions on personnel work; reporting, making records, declaring party member and cadre backgrounds, especially personal and family history that are incomplete or dishonest.
STRICTLY HANDLING PARTY MEMBERS WHO VIOLATE
There are many forms of handling party members who violate the law. In cases where the consequences are less serious, disciplinary action is taken in the form of reprimand when approaching, establishing relationships, giving gifts to people with responsibilities, positions, powers or related people to gain favor and support; influencing, bribing, putting pressure on people with authority and responsibility in introducing and appointing; setting conditions, putting pressure on people with authority and responsibility in introducing, nominating and appointing; bargaining, setting conditions, making unreasonable demands on organizations and individuals with authority and responsibility to be arranged into positions, work positions...
In case of disciplinary action in the form of reprimand but re-offending or first-time violation causing serious consequences, the disciplinary action shall be in the form of warning or dismissal from office (if holding a position). Or falling into manifestations of not directing the consideration and handling of recommendations of the Fatherland Front, socio-political organizations on negative behavior in personnel work or covering up, assisting in this negative behavior; taking advantage of position and authority to manipulate, cover up negative behavior in evaluating cadres, arranging, appointing cadres, elections; making incorrect decisions for others to obtain positions, titles, benefits contrary to regulations; interfering, influencing cadre work contrary to regulations; appointing, assigning cadres who do not meet the prescribed standards and conditions; allowing others to take advantage of their position and authority to arrange, appoint cadres; covering up, not handling, not resolving complaints, denunciations of party organizations, party members with negative behavior in arranging, appointing cadres.
Discipline in the form of expulsion in cases of violations causing very serious consequences or giving or receiving bribes to be assigned or appointed or appointing many unqualified cadres, causing very serious consequences.
