On the morning of November 21, the National Assembly discussed in the hall the draft Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.

Real estate prices skyrocket

Speaking at the discussion, delegate Nguyen Cong Long (Dong Nai) expressed concerns about the synchronization of the legal system if the above draft resolution is passed by the National Assembly.

According to Mr. Long, the National Assembly has worked hard to promulgate laws on land, real estate and related decrees and regulations. However, if the draft pilot resolution is promulgated, it will create two legal bases for real estate business activities.

Mr. Long raised voters' concerns and worries about the skyrocketing real estate prices, making it very difficult for the poor, workers, low-income earners, officials and civil servants to buy.

"It is calculated that if a civil servant does not eat anything, it will take him several hundred years to buy a house," said Mr. Long.

Besides, according to Mr. Long, voters also raised the question of why there is no pilot mechanism to solve the most current problem, which is social housing. So why is this mechanism not applied to social housing but only to commercial housing?

Commenting on the draft resolution, delegate Pham Van Hoa (Dong Thap) said that the real estate situation has been complicated recently. Some cases of construction but violations without a mechanism to resolve them have caused a waste of social and national resources.

According to Mr. Hoa, although not the state budget, enterprises are also social resources, they also have to borrow from banks, "when enterprises die, banks die too". This is an important and necessary issue to issue this draft resolution.

Implement nationwide to ensure fairness

Explaining the opinions raised by delegates, Minister of Natural Resources and Environment Do Duc Duy said that the nature of the draft resolution is to supplement a method of accessing land in implementing commercial housing projects.

Specifically, the 2024 Land Law stipulates that projects for which the State acquires land for auction and bidding must be synchronous projects in terms of technical infrastructure, social infrastructure and housing.

Mr. Duy said that according to urban law, the State will not reclaim land for projects with an area of ​​less than 20 hectares and that do not ensure synchronous urban elements.

“Because it is not a case of the State reclaiming land and also not a case of the State allowing the receipt of land use rights, it leads to many difficulties for localities, especially in small localities, the real estate market is not large in scale, there are not many urban projects larger than 20 hectares,” said Mr. Duy.

Regarding the scope of regulation, due to the problems occurring nationwide, according to Mr. Duy, it is necessary to implement it nationwide to ensure fairness.
