Not receiving money from Viet A, former CDC director recommended sentence of days in detention

After a week of trial, on the morning of January 8, a representative of the Hanoi City Procuracy proposed sentences for 38 defendants in the Viet A case.

Notably, the former Director of CDC Binh Duong Nguyen Thanh Danh was proposed by the Procuracy to be sentenced to 10 months and 4 days in prison (equal to the period of detention). Mr. Danh was prosecuted and tried for the crime of Violating bidding regulations causing serious consequences.

The prosecution agency stated that Mr. Nguyen Thanh Danh had no element of profiteering in the case, and that the defendant had refused to receive money from the General Director of Viet A. During the trial, Mr. Danh received a petition from the Binh Duong Provincial CDC to reduce his sentence.

Previously, in court, defendant Nguyen Thanh Danh said he worked as Director of the CDC of Binh Duong province from July 2019 to December 2021.

According to Mr. Danh's testimony, he was prosecuted by the Procuracy for the crime of violating bidding regulations causing serious consequences, which is the right person and the right crime.

The former Director of the CDC of Binh Duong province admitted that during the COVID-19 outbreak, the defendant had advanced test kits from Viet A Company and VNDAT Company for use first and then legally paid later, through 5 bidding packages and 7 contracts.

According to Mr. Danh, during the working process, no one agreed or gave him any material benefits. The defendant himself applied for the test kit to use first and paid later, following instructions from the Director of Binh Duong Department of Health.

Defendant Danh said that he was aware of his violations and that the prosecution was correct. However, defendant Danh said that there were shortcomings in the indictment and that he did not agree with borrowing the test kit from Viet A.

According to the defendant, as Director of the Binh Duong Provincial CDC, the defendant received instructions from the Director of the Provincial Department of Health and from the advisory team regarding the advance payment of test kits. The defendant explained that the Binh Duong CDC was newly established and had no experience in procurement.

"The defendant is aware of his criminal behavior. In the process of performing his duties, the defendant unintentionally violated the law on bidding. I hope the panel of judges will consider this," said defendant Danh.

"The conclusion of damage of more than 55 billion VND, do you think it is correct?" , the panel of judges asked.

" Yes, " defendant Danh replied and affirmed that he did not receive any thank you money from Viet A.

According to the indictment, defendant Nguyen Thanh Danh agreed with Viet A Company, VNDAT Company and directed CDC Binh Duong staff to prepare test kits, test extractions and medical supplies for use first, then legalized the procedures for Viet A Company to win the bid.

The defendant agreed to let Viet A Company bid on behalf of VNDAT Company to legalize the payment for the CDC extraction test that VNDAT had advanced.

In addition, the former Director of CDC Binh Duong also directed his subordinates to contact and coordinate with employees of Viet A Company and VNDAT Company to collude and provide technical documents and quotes to the valuation unit to issue the Valuation Certificate... causing damage to the State budget of more than 55 billion VND.
