Gap in cosmetic surgery

Complications not only lurk when customers undergo surgery at "underground" cosmetic clinics, but also at licensed cosmetic facilities that operate irresponsibly, customers are at risk of "losing money and getting sick".

Renting an operating room to practice "illegally"

At the end of July, Ms. NTKN went to Phap A Beauty Salon (FA Plus Beauty Salon Co., Ltd.) in District 1 (HCMC) to have liposuction of the abdomen, hips, arms, armpits, and fat grafting on the back of the hand at a cost of 95 million VND. Two days later, Ms. N. was admitted to Cho Ray Hospital for emergency treatment with a diagnosis of cellulitis. According to the verification results of the HCMC Department of Health, Mr. Huynh Thanh Hai rented an operating room at Phap A Beauty Salon for 15 million VND to "practice" illegally, directly performing surgery on Ms. N. The beauty salon could not provide professional qualifications or practice licenses of the person renting the operating room. When inspected, Mr. Huynh Thanh Hai did not cooperate with the authorities!

According to Dr. Nguyen Thanh Van, Permanent Vice President of the Ho Chi Minh City Association of Plastic Surgery, the situation of private hospitals renting out cosmetic surgery rooms for profit and lacking control is one of the causes of complications for customers. "At some private medical facilities, anyone can bring a customer for surgery, regardless of whether they have a practice certificate or not. This is extremely dangerous," Dr. Nguyen Thanh Van commented. When personnel issues are not controlled, surgical complications are likely to occur due to incompetent doctors, practicing beyond their professional scope, performing multiple surgeries on customers at the same time, unsafe anesthesia and resuscitation, poor skills... As a result, customers often suffer serious complications, even intestinal perforation during liposuction, lung perforation during breast implant placement, and more seriously, death.

Dr. Nguyen Thanh Van said that the problem lies in the fact that the current cosmetic surgery practice certificate has a wide scope, so doctors can perform all categories, while not everyone is capable.

“Previously, the cosmetic surgery practice certificate clearly stated the scope of expertise. However, it is now generally stated as “cosmetic surgery examination and treatment”. Therefore, it is necessary to stipulate that the hospital director must take joint responsibility if an incident occurs when renting an operating room to surgeons who do not have the appropriate practice certificate and do not have the required skills,” Dr. Nguyen Thanh Van suggested.

Associate Professor, Doctor, Doctor Nguyen Thi Thanh, Vice President of the Ho Chi Minh City Association of Anesthesia and Resuscitation, expressed her indignation at the fact that many people were operated on just a few hours after a pre-anesthesia examination. While according to regulations, a pre-anesthesia examination must be performed within 1-7 days before surgery so that the doctor can assess the condition and discuss the risks. Complications are more serious when the anesthesiologist is not capable of assessing the risks and handling them. That is also the reason why a woman went into anaphylactic shock after undergoing a cosmetic procedure on her private area at the Diva Saigon Cosmetic Clinic. The team that performed the cosmetic procedure for this customer was not on the clinic's list of practitioners, impersonated doctors, and did not have a practice certificate.

Specific technical catalog regulations

According to Associate Professor, Doctor, Doctor Nguyen Anh Dung, Deputy Director of the Ho Chi Minh City Department of Health, there are currently many gaps in the field of aesthetics that need to be "filled" to increase customer safety, such as licensing conditions and scope of practice; capacity and training of doctors; regulations on purchasing and using aesthetic medical equipment and machinery... For example, Circular 32 of the Ministry of Health stipulates that the field of cosmetic surgery is allowed to perform 517 related technical services, including 504 specialized techniques for examining and treating patients for cosmetic surgery practitioners. "With such a scope of practice, what are the standards for the practitioner's capacity, or is it only necessary to have a license to practice cosmetic surgery to be able to perform all 504 techniques?", Associate Professor, Doctor, Doctor Nguyen Anh Dung raised the issue. Therefore, the Ho Chi Minh City Department of Health proposed that the Ministry of Health supplement regulations to more specifically divide the list of techniques that cosmetic plastic surgeons are allowed to perform.

The leader of the Ho Chi Minh City Department of Health also emphasized that one of the causes of cosmetic accidents is that the capacity of practitioners does not meet the practical requirements, many people do not comply with or intentionally violate the law for profit. On the other hand, most practitioners exceed their expertise and capacity and endanger customers; do not participate or do not fully participate in training courses to update professional knowledge, treatment regimens, and legal regulations...

Proposal to implement electronic medical records for aesthetics

The Ho Chi Minh City Department of Health is implementing 5 groups of solutions to minimize medical incidents in cosmetic activities.

The first group of solutions is to tighten compliance with regulations in cosmetic practice.

The second group of solutions is to promote communication activities and publicly disclose information about cosmetic establishments that violate the law.

The third group of solutions is to standardize professional guidelines and technical procedures of cosmetic specialties.

The next group of solutions is to recommend that the Ministry of Health supplement legal regulations to strictly control products used in the field of aesthetics (including drugs, supplies, and medical equipment).

The final group of solutions is to create digital data in management work in the field of aesthetics, deploying electronic aesthetic medical records.
