According to the report, the subjects and conditions for calculating temporary housing cost support include cases where a part of the house is recovered but the remaining structure outside the land recovery boundary is determined to not meet technical standards, so a new house must be built or repaired or renovated to live on the remaining land area outside the land recovery boundary of the project.
In cases where people whose residential land is recovered are arranged for on-site resettlement (for housing and residential land construction projects) or in cases where residential land is recovered and arranged for resettlement, it is necessary to urgently hand over the site to implement the project but there is no temporary residence.
The condition for calculating the temporary housing rental cost support is that the households and individuals are permanent or temporary residents at the location of the house being cleared. The level of temporary housing rental cost support is applied according to the area where the house and land being recovered are located.
There are many old apartment buildings in Ho Chi Minh City that are difficult to relocate residents because of unsatisfactory resettlement and temporary residence policies.
Specifically, in area 1 (including districts 1, 3, and 5), the support level is 8 million VND/household/month for households with 4 or fewer people. For households with 5 or more people, the support level is 2 million VND/person/month. However, the total support level does not exceed 24 million VND/household/month.
Area 2 (including District 4, District 6, District 10, District 11, Binh Thanh District, Phu Nhuan District, Tan Binh District and Go Vap District) supports 7 million VND/household/month for households with 4 or less people. For households with 5 or more people, support is 1,750 million VND/person/month. But the total support level does not exceed 21 million VND/household/month.
Area 3 (including Thu Duc City, District 7, District 8, District 12, Binh Tan District, Tan Phu District) supports 6 million VND/household/month for households with 4 or less people. For households with 5 or more people, support is 1.5 million VND/person/month. But the total support level does not exceed 18 million VND/household/month.
Region 4 (including Binh Chanh district, Cu Chi district, Hoc Mon district, Can Gio district and Nha Be district) supports 5 million VND/household/month for households with 4 or less people. For households with 5 or more people, support is 1,250 million VND/person/month. But the total support level does not exceed 15 million VND/household/month.
Previously, the Ho Chi Minh City People's Committee issued Decision No. 10 applying the policy on supporting the cost of renting temporary housing for people while waiting for resettlement. However, according to the Inspection Conclusion No. 27 of the Department of Inspection of Legal Normative Documents (Ministry of Justice), the authority to issue regulations on budget expenditure regimes is the People's Council. Therefore, the Ho Chi Minh City People's Committee's issuance of the above legal normative documents is not in accordance with its authority and must be submitted to the Ho Chi Minh City People's Council for approval. Therefore, the Ho Chi Minh City People's Committee had to issue a decision to abolish the above decisions.
According to the analysis of the Ho Chi Minh City People's Committee, the application of the above policy on temporary housing rental cost support aims to ensure strict regulations on subjects, support calculation time, appropriate support levels for each area and coordination between departments, branches, districts and counties to implement promptly, seriously, publicly and transparently.
This not only helps speed up site clearance for project implementation, especially emergency relocation projects from severely damaged apartment buildings at risk of collapse and landslide areas, but also ensures the safety of people and guarantees the rights of people whose land is recovered in the area.
