Proposed guidelines for organization and operation of villages and residential groups

The Ministry of Home Affairs is seeking public opinions on the draft Circular guiding the organization and operation of villages and residential groups.

The draft Circular clearly states that the principles of organization and operation of villages and residential groups must ensure the self-management of the residential community, comply with the leadership of the Party Committee and the direct state management of the commune-level government.

Comply with the Constitution and the Law on Democracy at the grassroots level, follow the Village Covenants and Conventions; ensure democracy, publicity and transparency. Do not separate villages and residential groups that are operating stably.

Continue to promote the merger of villages and residential groups in accordance with the provisions of law and in accordance with the conditions and characteristics of each locality. Apply information technology and digital transformation to the activities of villages and residential groups.

In cases where there is land clearance planning, population dispersion planning, or migration from mountainous, highland, remote, or isolated areas or where the terrain is complex, the area is large, and transportation is difficult, the conditions for establishing new villages and residential groups may be lower than those prescribed in this Circular.

Organization of villages and residential groups

According to the draft, each village has a Village Chief; each residential group has a Head of the Residential Group. If necessary, a Deputy Village Chief and Deputy Head of the Residential Group will be assigned.

Based on the population size and characteristics of each type of village and residential group, the Provincial People's Committee shall specify the appropriate number of Deputy Village Heads and Deputy Heads of Residential Groups, but each village and residential group shall not exceed 02 Deputy Village Heads and Deputy Heads of Residential Groups.

The Deputy Village Head and Deputy Head of the Residential Group are selected by the Village Head and the Residential Group Head after consulting with the Party Cell and agreeing with the Head of the Village and Residential Group Front Work Committee. The Chairman of the Commune-level People's Committee (or the Chairman of the District-level People's Committee where there is no commune-level administrative unit) decides to recognize the Deputy Village Head and Deputy Head of the Residential Group.

Contents of activities of villages and residential groupsThe draft clearly states the contents of activities of villages and residential groups, including:

Discuss and decide on policies and levels of contributions to build infrastructure and public works within the commune, village and residential area with people contributing all or part of the funds, assets and labor.

Build and implement community covenants and regulations.

Elect and dismiss Village Chiefs and Heads of Residential Groups. Elect and dismiss members of the People's Inspection Board and Community Investment Supervision Board.

Carry out other self-management tasks within the community that are not contrary to the provisions of law, in accordance with social customs and ethics.

Implement the Party's guidelines and policies, the State's laws and policies, and participate in movements and campaigns launched by superiors.

Collect, spend and manage contributions from the people in the community other than those prescribed by law; collect, spend and manage funds and assets assigned to the community for management or received from other legal sources of revenue, sponsorship and support.
