Circular amending and supplementing a number of regulations on support for production land. Accordingly, the Circular clearly states that the subjects receiving support for production land include:
1. Poor ethnic minority households living in ethnic minority and mountainous areas; poor Kinh households living in extremely disadvantaged communes and extremely disadvantaged villages in ethnic minority and mountainous areas who make a living from agriculture, forestry and fishery and do not have land for production and are in need of support for production land will be considered by local authorities for direct support in the form of production land.
2. Poor ethnic minority households living in ethnic minority and mountainous areas; poor Kinh households living in extremely disadvantaged communes and villages in ethnic minority and mountainous areas living on agriculture, forestry and fishery, who do not have or lack more than 50% of production land according to the prescribed norms of each locality, who need to change their occupation or need support for production land but cannot arrange production land, will be considered and supported for job change.
Provincial People's Committees shall base on land funds and actual conditions of the locality to prescribe land production quotas but not exceeding the limit of agricultural land allocation for each household and individual according to the provisions of the law on land as a basis for determining households lacking land for production.
Support content and implementation method Direct support with production land: In case the locality still has land fund with production capacity without having to carry out land reclamation, restoration, and improvement, the People's Committee at the district level, based on the planning and land use plan approved by the competent state agency, shall allocate production land to households that are beneficiaries of the policy but do not have production land according to the provisions of the law on land.
In cases where the locality still has land for production but must reclaim, restore, and improve the land to be able to produce, the People's Committee at the district level shall direct the organization to establish and implement land reclamation, restoration, and improvement projects according to the land use planning and plans approved by competent state agencies to allocate production land to households that are beneficiaries of the policy but do not have land for production according to the provisions of the law on land. The level of support from the central budget to implement land reclamation, restoration, and improvement projects is specified in Clause 3, Article 3 of Decision No. 04/2023/QD-TTg.
Households that are eligible for direct support for production land but cannot be allocated land by the local government and need to borrow capital to create a land fund for production will be considered for credit loans from the Social Policy Bank according to the provisions of Articles 20, 21, 22, 23, 24 and 25 of Decree No. 28/2022/ND-CP and will not be supported for job conversion.
The provincial People's Committee directs the district People's Committee to arrange local budgets and issue land use right certificates to households supported with production land according to regulations.
Support for career conversion Households that are eligible for consideration and support for purchasing agricultural tools, machinery, providing agricultural production services, converting to other fields of cultivation, animal husbandry, production, business or vocational training support to convert careers and are eligible for credit loans according to the provisions of Articles 20, 21, 22, 23, 24 and 25 of Decree No. 28/2022/ND-CP.
Based on the list of households receiving support for career conversion approved by competent authorities, the list of households registering for support methods (in cash, in kind or vocational training), the People's Committee at the commune level synthesizes the needs and classifies them according to each implementation method and sends them to the district-level ethnic affairs agency to preside over and coordinate with the financial agency at the same level to synthesize and report to the District People's Committee to decide on the level of support for each household (each household is only supported once).
In case households receive financial support, the People's Committee at the commune level will guide households to purchase agricultural tools, machinery, provide agricultural production services, learn a trade, switch to other farming, livestock, and production and business sectors according to registered needs and make payments according to regulations. In case households register to receive support in kind, the People's Committee at the district level will, based on the needs, direct specialized units or the People's Committee at the commune level to organize purchases according to the provisions of law and distribute them to households. In case households register to learn a trade, the People's Committee at the district level will synthesize and assign specialized units to coordinate with training institutions to support vocational training for households according to regulations.
