The Investigation Police Agency (C01) of the Ministry of Public Security has just completed the supplementary investigation conclusion and proposed to prosecute 51 defendants in the case of "manipulating the stock market, fraudulently appropriating assets, intentionally publishing false information or concealing information in securities activities and taking advantage of positions and powers while performing official duties" occurring at FLC Group Joint Stock Company (FLC Group) and related companies and units.
Previously, in October 2023, C01 completed the investigation conclusion, proposing to prosecute 21 defendants in this case in two groups of crimes: stock market manipulation and fraud to appropriate assets. However, the Supreme People's Procuracy returned the case file requesting additional investigation to "ensure prosecution". During the additional investigation, C01 prosecuted 30 more defendants.
The Investigation Police Agency searched FLC headquarters on the evening of March 29, 2022.
Of the 51 defendants proposed for prosecution this time, 13 defendants were proposed for prosecution for stock market manipulation; 23 defendants were proposed for prosecution for fraud and appropriation of property; 4 defendants were proposed for prosecution for abuse of position and power while performing official duties; 3 defendants were proposed for prosecution for intentionally publishing false information or concealing information in securities activities; 8 defendants were proposed for prosecution for 2 crimes of stock market manipulation and fraud and appropriation of property, including Mr. Trinh Van Quyet, former Chairman of FLC Group.
According to the additional investigation conclusion, from May 26, 2017 to January 10, 2022, Mr. Quyet directed his sister Trinh Thi Minh Hue and his accomplices to manipulate the stock market for 5 stock codes AMD, HAI, GAB, FLC, ART, thereby illegally profiting more than 723 billion VND.
Proposal to prosecute 30 more defendants in the case of Mr. Trinh Van Quyet manipulating stocks
C01 also determined that from 2014 to September 2016, Mr. Quyet also directed individuals who were leaders and employees of Faros Company, companies under FLC Group; relatives and family members to act as shareholders contributing capital, to carry out tricks to create and sign fake capital contribution documents, to inflate the capital contribution to Faros Company by more than VND 3,102 billion, increasing the company's charter capital from VND 1.5 billion to more than VND 4,300 billion; then created documents, requested state securities management agencies to approve the registration of a public company, register securities depository and list 430 million shares formed from the fake capital contribution of Faros Company at the Ho Chi Minh City Stock Exchange.
After listing Faros Company's shares on the stock exchange, from September 2016 to March 2022, Mr. Quyet and his accomplices sold more than 391 million shares formed from fake capital contributions held at Faros Company, earning more than VND 4,818 billion, of which more than VND 3,620 billion was appropriated from investors.
In addition to those who helped Mr. Quyet commit the crime, C01 also clarified the violations of individuals belonging to the state management agency with the authority to approve the registration of public companies, securities depository and stock listing.
C01 has prosecuted 4 defendants from the Ho Chi Minh City Stock Exchange for abusing their positions and powers while performing official duties and 3 defendants from the Department of Public Company Supervision (State Securities Commission) and the Vietnam Securities Depository Center for intentionally disclosing false information or concealing information in securities activities.
